I most strongly OBJECT to the above application because:
§ It does not represent Sustainable Development
§ It is not in conformity with the Mid Sussex local development plan – Policies C1, C2, C5, G3 and T4
§ It is not inconformity with the National Planning Policy Framework (NPPF) – Paras 14, 32, 118, 119, 126, 132
§ It is not in conformity with the Habitats Regulations Regulation 61
§ It is also against the wishes of the local residents that further development should be limited to the existing urban boundary
This application conflicts with the law, Government policy and the emerging East Grinstead Neighbourhood Plan and so with the emerging Mid Sussex Local Plan (District Plan) which is taking a bottom up approach, and places Neighbourhood Plans at its core. The emerging Neighbourhood Plan sets out to contain development within the existing town boundary.
§ Recent assessments of this site by MSDC (SHLAAs: 2010/2012/2013/Feb 2015) all conclude that the site is unsuitable and unsustainable and would need to be allocated via the Neighbourhood Plan.
§ The development would cause irreparable damage to Heritage Asset Imberhorne Bluebell railway Viaduct contrary to the NPPF and the law.
§ The JUBB report demonstrates that the impact on the East Grinstead Road network would be ‘severe’ as defined by WSCC and so contrary to the NPPF.
§ MSDC must comply with the Habitats Regulations (Reg 61) that protects Ashdown Forest by producing an Appropriate Assessment that demonstrates that any adverse impact on Ashdown Forest will be fully mitigated.
§ Because the development lies within the 7km protection zone around Ashdown Forest the “presumption in favour of sustainable development” does not apply.
This application should be refused on the planning grounds set out above.
