Post Title :Legal Consultant

Salary :NJC Point 35 - £29,236

Hours :35 Hours

Responsible to:Chief Executive

Job Purpose:To develop and establish a sustainable, income generating legal service, working with civil society organisations through the provision of advice, information, support and training on legal issues including charity law and other legal matters relevant to the administration and management of civil society organisations.

DUTIES and RESPONSIBILITIES:

Business Development

1Develop a service to provide affordable legal advice appropriate to the needs of civil society organisations.

2Devise and implement an appropriate charging structure in consultation with the Chief Executive.

3Promote the legal service through outreach work and appropriate publicity with a particular emphasis on:

a)Charity and Company law and registration, legal structures, administration and governing documents;

b)Premises and tenure, health and safety, insurance and community asset transfer;

c)Contracts/licences;

d)Trustee/Director liability;

Provision of Legal advice and support

4Provide legal advice for civil society organisations, including:

a)One-to-one consultations

b)Providing model contractsand supporting the development of tailor made contracts,

c)Supporting organisations involved in tribunals and legal action where appropriate;

d)Advocate on behalf of organisations to appropriate bodies;

e)Referring groups to other agencies and support as appropriate;

5Develop and provide services to promote knowledge and good practice in the above through:

a)Producing information leaflets and resource packs, briefings and articles for newsletters/websites and other publications;

b)Organising and delivering one off events and advice surgeries;

6Keep up to date with developments in legislation and related good practice and obtain suitable information materials and publications.

7Develop knowledge of other sources of advice, support and services relevant to civil society and, when appropriate, signpost groups to these services

Training

8Organising and delivering training courses to civil society organisations.

9Contributing to the training and development programme within RCVDA and MVDA to provide information, advice and training as a resource for staff and Directors as appropriate.

10To advise staff and Directors on relevant legislation and good practice and participate in the general development through staff meetings and development/review sessions.

11To be willing to undertake training in line with the developing needs of the post.

Other

12To prepare and submit regular reports and undertake such other monitoring and evaluation procedures as may be required.

13To take responsibility for meeting targets and deadlines according to agreed work plans.

14To carry out all work with reference to RCVDA’s policies, procedures and values.

15To carry out any other duties as may be defined by the needs of the post and/or the RCVDA Executive Management Committee.

WORKING CONDITIONS:

35 hours per week to be worked over five days, Monday to Friday inclusive.

Flexible working within the times of 8.30 am – 5.30 pm will be permitted subject to the demands of the service. Some evening or weekend work may be required.

Overtime will not be paid but approved time outside office hours should be taken off as time in lieu.

26 working days holiday per year not including statutory holidays.

This post is subject to funding. Due notice will be given according to contract.
