  1. Data Users Declaration

I understand that in using data provided by the Hampshire Biodiversity Information Centre (“Data”) I am aware of, and agree to, the following :-

  1. The Hampshire Biodiversity Information Centre is a Partnership hosted by Hampshire County Council(“We/Us/Our”). The Council holds copyright of the Data on behalf of the Partnership except where service level agreements and data exchange agreements state otherwise. No reproduction of this Data will be allowed as a direct copy, except for the purpose of the project as stated in the Data Request Form
  2. Data provided by the Hampshire Biodiversity Information Centre will only be used for the purpose stated in the Data Request Form and will not be stored beyond the life of the project for which it was acquired. The Data must not be added to any permanent database system and must not be passed to any third party except as stated in the Data Request Form.
  3. Any personal information supplied in association with these records will not be used, copied, or passed to any third party without the consent of the Hampshire Biodiversity Information Centre and in accordance with the Data Protection Act.
  4. Whilst every reasonable effort is made to validate information supplied to and by the Hampshire Biodiversity Information Centre, owing to the dynamic and judgmental nature of information relating to wildlife, the Hampshire Biodiversity Information Centre disclaims any responsibility for the accuracy or comprehensiveness of the information supplied, and accepts no liability for any indirect, consequential, or incidental damages or losses arising from use of the information.
  5. The whereabouts of other material, documentary sources etc. referred to cannot be guaranteed.
  6. Acknowledgement of the use of the Data supplied by the Hampshire Biodiversity Information Centre (including acknowledgement of any stated third party supplier) must be given in any published documents.
  7. I am aware of theHampshire Biodiversity Information Centre charging schedule and understand I may be charged for the supply of the Data. Ialso am aware that the Hampshire Biodiversity Information Centre may make a charge if anestimate has been requested but that this fee will be waived if the estimate is acceptable and confirmation has been received to proceed.

6.Re-Use Declaration “Licence”

1.I understand that in using theData provided to me (“You/Your/I”), I am aware of, and agree to, the following conditions and obligations of Licence:-

  • That theLicence begins on the date that We provide You with the Dataand will continuefor a period of one year.
  • To let us know in writing (by post or email) of any change toYour details.
  • Not to present out-of-date Data as being current.
  • To ensure that You do not use the Data in a way that suggests any official status or that We endorse Youor Your use of the Data.
  • To ensure that You do not mislead others or misrepresent us or the Data.
  • To acknowledge the source of the Data.
  • To feature any copyright statement as directed by Us.
  • Not to reproduce Our logo(s)unless they form an integral part of the Data and You are reproducing them in that context.
  • To send Us, if we ask for it, one complimentary copy of your product.
  • Sub clauses 2, 3, 4, 5 and 6 in the above data users declaration are incorporated into this Licence.

2.This Licence is granted to You subject to Your payment of the fee in accordance Our charging schedule.

3. All payments will be subject to VAT (where applicable) at the rate in force at the due time for payment.

4. This Licence may be ended by Us at any time if there is a material breach of the terms of this Licence and you do not put this right within 30days of Our telling You or in order for Us to comply with any legal requirement.

5.Ending this Licence shall not affect Our right to payments and information related to payments under this Licence and no refunds will be given to You.

6.You must not assign or sub-license(without Our written consent) your rights under this Licence to any other person.

7.This Licence is governed by the laws of England.
