NootherapplicationswillbeacceptedbytheMichiganStatePolice.SCAOwillthen acceptapplicationsfromlocalprioritypopulationdrugtreatmentcourtsforawardsunder thisprogramarea.
PROBLEMSTATEMENT:
Itiswell-known thatdrugsarerelatedtocrimeinmultipleways. Notonlyisitacriminalactto possess,use,manufacture,and/ordistributedrugsthathaveapotentialforabuse,butdrugs arealsorelatedtocrimethroughtheeffectsthattheyhaveonthebehavior oftheuserandthe violenceandactivitythatisconnectedwithdrugtrafficking. Inthemostrecentstudybythe BureauofJusticeStatistics,17percentofstateprisonersand18percentoffederalinmates reportedthattheycommittedtheircurrentoffensetoobtainmoneyfordrugs,andone-thirdof
stateinmatesreportedthattheyhadcommittedtheircurrentoffensewhileundertheinfluenceof
drugsnationwide. Overtwo-thirds indicatedthattheyhadusedregularly, atsomepointintheir lives.1 Theincarcerationofdrugusersthataresuitablefortreatment-basedalternativesis expensivetotaxpayersandamissedopportunitytoreducebothaddictionandcrime.
PROGRAMDESCRIPTION:
Drugcourtsofferanintegrated, systematicapproachtodealingwithsubstance-abusing offenders.Theyareevidence-basedand have beenfoundtosubstantiallyreducedrug use and recidivismwhileoffendersareintheprogram.Theyrepresentanenhancement ofcommunity supervisionbycloselymonitoringdrugoffendersinthecommunity,placingandretainingthem in intensive treatment services, providing random drug testing, incorporatingrewards and
incentives,andholdingparticipantsaccountablethroughfrequentcourtappearances.
Thisprogramareatargetsadult,substance-abusingfelonyoffenders,toreducecoststothe criminaljusticesystem,reducerelapseandrecidivismrates,andprovidefamilyreunification. Theprimarytargetswithinthatfelonygrouparenon-violent probationviolatorsandothernon- violentfelonyoffenders,particularlystraddlecelloffenderswhohaveapriorrecordvariableof
35pointsormoreand,baseduponstatutorysentencingpractices,areotherwiseboundfor prison.
LIMITATIONS:
Onlydrugcourtsthathavegonethrough,oraregoingthrough,thefederal DrugCourtPlanning Initiative,orexistingdrugcourtsthattargetsubstanceabusingprison-boundfelonyoffenders, areeligible. ClientsmustbewithinthestraddlecellcategoryoftheMichigan Sentencing Guidelines asameanstoreducethestate’sburdenonthecostsofimprisonment. Inorderto generatenewlevelsofcoordination andpartnership,drugcourtswhichfocusonprison-bound populationsshouldworkwithlocalcommunitycorrectionsadvisoryboardsunderMichigan’s
CommunityCorrectionsAct(PublicAct511),paroleandprobationoffices,substanceabuse
coordinatingagencies,andotherstakeholders.
PublicAct224of2004requiresadherencetoThe10KeyComponents ofDrugTreatment Courts,locatedat: Goals,Objectives,andActivitiessectionofthisprogramdescription. Prioritypopulationdrug courtsshallrefertotheviolentoffenderdefinitionoutlinedintheMichiganPublicAct224of
2004andensurethatsuchoffenderswillbeexcludedfromdrugcourtprograms.

Goal / Reducethedemandfordrugsbybreakingthecycleofsubstance abuse throughdrugcourts.Objective1 / Drugcourtsintegratealcoholandotherdrugtreatmentserviceswithjustice caseprocessing.
Activities / Ensurethatlawenforcement isamemberofthedrugcourtteam;judge, prosecutor,defenseattorney,treatmentrepresentative, programcoordinator, andprobation attendteammeetings andcourthearings; treatment communicateswithcourtviaemailortext.
Objective2 / Usinganon-adversarialapproach,prosecutionanddefensecounselpromote publicsafety,whileprotectingparticipants’dueprocessrights.
Activities / Drugcourtsallownon-drug charges; allteammembers(judge,attorneys, coordinator, probation,treatment,lawenforcement)attendcasestaffingand court sessions;ateammemberclearlyexplainstheprogramexpectationsand individualrightstotheparticipant.

troubleshootanyproblemstohelpparticipantsconfidentlyfollowthroughwith
referrals;thetimebetweenarrestandprogramentryislessthan50days.
Objective4 / Drug/sobrietycourtprovidesaccesstoacontinuumofalcohol,drug,and other relatedtreatmentandrehabilitationservices.
Activity / Thedrugcourtworkswithtwoorfewertreatmentagencies;thedrugcourt offersgender-specificservices;thedrugcourtoffersmentalhealthtreatment;
theminimum lengthofthedrugcourtis12months;thedrugcourthas guidelines forthefrequency ofindividualtreatmentsessionsthataparticipant mustreceive.
Objective5 / Abstinenceismonitoredbyfrequentalcoholandotherdrugtesting.
Activities / Drugtestresults arebackintwodaysorless;inthefirstphase ofdrugcourt, drugtestsarecollectedatleasttwotimesperweek;participantsareexpected tohavegreaterthan90daysclean(negativedrugtests)beforegraduation.
Objective6 / Acoordinatedstrategygovernsdrug/sobrietycourtresponsestoparticipants’
compliance.
Activities / Sanctionsareimposed immediatelyafternoncompliantbehavior (meaningthe drugcourtwillimposesanctions inadvanceofaclient’sregularlyscheduled courthearing);teammembersaregivenacopyoftheguidelinesforsanctions; positivereinforcementisincorporatedintoalllevelsofthedrugcourtprogram; whenpossible,tangibleincentives liketokens,giftcards,orsnacksare incorporated into the program’s court session; ideally, incentives should
outnumbersanctionsfourtoone;inordertograduate,participantsmusthave
ajoborbeinschool;inordertograduate,participantsmusthaveasober housingenvironment.
Objective7 / Ongoing judicial interaction with each drug/sobriety court participant is essential.
Activities / Statushearings shouldbeheldatleastbiweekly duringthefirstphaseofthe program--subsequently,thefrequencyofstatushearingscanberatcheted
downward, buthearingsshouldbeheldatleastoncepermonthuntil participants haveachievedstability;thejudgespendsanaverageofthree minutesormoreperparticipantduringstatusreviewhearings;thejudgeis assignedtodrugcourtonavoluntarybasis;thejudge’stermisindefinite.

NOTE: Thisisacompetitivegrantandwillbeawardedbasedonmerit,demonstrated need,data- drivendecisionmaking,andperformancemeasures. SCAOwillbetheawardingagencytothe local drug treatment courts.
PREVIOUSGRANTCOMPLIANCE:
Applicationreviewswillincludescoringontheapplicant’spreviouscompliancewithByrneJAG
federalandstaterequirementsfortimeliness,accuracy,andcompletenessofreports.
UNIFORMCRIMEREPORTINGCOMPLIANCE:
Applicants andallsubcontractorsmustcomplywithMichiganPublicAct319of1968,as amended.Thislawrequirescountysheriff’sdepartments, aswellascity,village,andtownship policedepartments,tosubmitmonthlyuniformcrimereportingdatatotheMichiganState
Police.
BUDGET:
Themaximumstateawardunderthisprogramareawillbe$1,305,000.Allcostsmustbe reasonableandjustified.
MATCHREQUIREMENT:
Thereisnomatchrequirementforthisprogramarea.
BUDGETDEVIATIONALLOWANCES:
Budgetdeviationallowanceswillnolonger beaccepted. Allbudgetandprogrammaticchanges willrequireaformalamendment ontheMichiganAutomaticGrantInformationConnectionPlus
(MAGIC+)system.
UNALLOWABLEEXPENSESANDACTIVITIES:
Alltravelincludingfirstclassorout-of-statetravel(unlesspre-authorizedundercertain programareas).
Anyadministrativecostsnotdirectlyrelatedtotheadministrationofthisgrantaward.

oNote: No funding can be used to purchase food and/or beverages for any meeting, conference, training, or other event.Exceptionsto this restrictionmay be made only in cases where such sustenanceisnototherwise available (e.g.,extremely remoteareas),or where a specialpresentationataconferencerequiresaplenary address wherethereisnoothertime forsustenancetobeattained.Suchanexception wouldrequirepriorapprovalfrom the Departmentandthe U.S.DepartmentofJustice. PERFORMANCE/PROGRESS/PERFORMANCE MEASUREMENTTOOL(PMT)REPORTS:Progressreportingwilltakeplacenolaterthan20daysaftertheendofeachquarterthrough thefederal PMT system located at: Ifapplicable,another programprogressreportalsoduenolaterthan20daysaftertheendofeachquartermustbe submittedthatwillincludeperformanceonimplementation,activity,goals andobjectivesaswell asmetricsspecifictoyourprogramarea.
