ORDINANCE NO. 27.3

AN ORDINANCE amending the Village of North Branch Rental Dwelling Ordinance, being Ordinance No. 27, to expand the requirements of fire protection systems in rental dwellings, and repealing any and all ordinances and/or resolutions and conflict therewith.

THE VILLAGE OF NORTH BRANCH, LAPEER COUNTY, MICHIGAN, ORDAINS:

SECTION 1. AMENDMENT 1.1

Section 2(U) of The Village of North Branch Rental Dwelling Ordinance, being Ordinance No. 27, is hereby repealed in its entirety and the following substituted therefore:

Section 2

(U) Fire Protection Systems

Fire protection systems including but not limited to smoke and carbon monoxide detectors, emergency lighting, exit signs, manual or automatic fire alarm systems, fire extinguishers, or fire sprinklers shall be maintained in good working order and shall be tested in accordance with the applicable N.F.P.A. standard.

SECTION 2. REPEAL OF CONFLICTING PROVISIONS

All resolutions, ordinances or parts thereof in conflict with the provisions of this Ordinance are to the extent of such conflict hereby repealed.

SECTION 3. SEVERABILITY

If any section, paragraph, clause or provision of this Ordinance is for any reason held to be invalid or unconstitutional, the invalidity or unconstitutionality of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this Ordinance.

SECTION 4. PUBLICATION

A true copy of this Ordinance Amendment or a synopsis thereof shall be published in a newspaper circulated in the Village within fifteen (15) days after the date of adoption.

SECTION 5. EFFECTIVE DATE.

This Ordinance Amendment shall take effect immediately upon publication as set forth in Section 4.
