Chairman Pratt convened the meeting at 7:09 PM by introducing the Board members. He then opened the public hearing on the request by Robert C. I. & Donna M. Odell for a variance from Article VIII, Section C.3 of the zoning ordinance to permit the expansion of an existing structure within the100 foot set back from the high water mark of Steels Pond for property located at 17 Masquanipi Drive, Antrim, NH, Tax Map 8A, Lot 41 located in the Lakefront Residential District. The applicant proposes to expand an existing dwelling which is within 100 feet from the high water mark.
Mr. Odell spoke briefly on his plans to place an addition on the existing dwelling. A plot plan showed that the addition would not further encroach on the high water mark of Steels Pond and would be within the 20-foot sideline setback. Although the hearing was duly advertised and all abutters notified no abutters were present to speak either in support or opposition to the application.
There was some discussion regarding the length of Mr. Odell’s residency in Antrim. The Secretary called the Board’s attention to Article XVI, Section C.1 of the Zoning Ordinance (non conforming structures) which would be pertinent to the application for a variance. Mr. Pratt called for a roll call vote on the five conditions required in order to grant a variance.
- There would be no diminution in value of surrounding properties as a result the granting of this variance. Roll call vote: John Kendall – aye, Ben Pratt – aye, Don Winchester – aye.
- The granting of this variance would not be contrary to the public interest. Roll call vote: John Kendall – aye, Ben Pratt – aye, Don Winchester – aye.
- A. The zoning restriction as applied to the property does interfere with the reasonable use of the property considering the unique setting of the property in its environment. Roll call vote: John Kendall – aye, Ben Pratt – aye, Don Winchester – aye.
B. There is a fair and substantial relationship between the general purpose of the zoning ordinance which permits the expansion of a non conforming use. Roll call vote: John Kendall – aye, Ben Pratt – aye, Don Winchester – aye.
C. The variance would not injure the public or private rights of others. Roll call vote: John Kendall – aye, Ben Pratt – aye, Don Winchester – aye.
- By granting this variance substantial justice would be done: Roll call vote: John Kendall – aye, Ben Pratt – aye, Don Winchester – aye.
- The use contemplated by the petitioner as a result of obtaining this variance
would not be contrary to the spirit of the ordinance. Roll call vote: John Kendall – aye, Ben Pratt – aye, Don Winchester – aye.
Mr. Pratt then declared that the requested variance had been granted and the public hearing closed. The Secretary advised Mr. Odell that he would receive notification of the approval and that the next step would be for Mr. Odell to meet with the Building Inspector and obtain a building permit.
Mr. Kendell moved that the minutes of the April 29, 2003 meeting be approved as presented. The motion was seconded by Mr. Pratt and passed.
A motion made by Mr. Winchester to adjourn the meeting was seconded by Mr. Kendall and passed.
Mr. Pratt adjourned the meeting at 7:50 PM.
