The Faribault County Board of Commissioners met pursuant to the recess of August 1, 2000 at the Courthouse in the City of Blue Earth at 9:00 a.m. on August 15, 2000. The following members were present: Gordon Benson, Loren Lein, Paul Meyer, and Ralph Prescher, Commissioners. Commissioner Virgil Klatt was absent. Auditor John Thompson and County Attorney Brian Roverud were also present.
The meeting was called to order by the chairman.

Lein/Meyer motion carried unanimously to approve the synopsis and the official proceedings of August 1, 2000 regular meeting.

Meyer/Benson motion carried unanimously to adopt Resolution 00-CB-28 for a County Veterans Service Officers grant application. Commissioners Benson, Lein, Meyer, and Prescher voted yes.
R E S O L U T I O N
BE IT RESOLVED that Bryan H. Schultz act as the legal sponsor for project(s) contained in the County Veterans Service Officers Grant Application submitted on August 11, 2000 and that the County Veterans Service Officer is hereby authorized to receive grant funds from the Minnesota Department of Veterans Affairs for funding of this project on behalf of Faribault County.
BE IT FURTHER RESOLVED that Bryan H. Schultz has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate construction, operation, maintenance and replacement of the proposed project.
BE IT FURTHER RESOLVED that Faribault County has not violated any Federal, State, or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practices.

Meyer/Benson motion carried unanimously to advertise for diesel and gas bids on October 11, 2000 at 11:00 a.m.
Meyer/Benson motion carried unanimously to purchase a scale from Wayne T. Hansen Corp. of Algona IA for $9,000.
Lein/Benson motion carried unanimously to adopt Resolution 00-CB-29 an agreement with the State of Minnesota to provide public transportation service in Faribault County for the calendar year 2001. Commissioners Benson, Lein, Meyer, and Prescher voted yes.
R E S O L U T I O N
BE IT RESOLVED that Faribault County enter into an Agreement with the State of Minnesota, Department of Transportation, to provide public transportation service in Faribault County for the calendar year 2001.
BE IT FURTHER RESOLVED that Faribault County agrees to provide 35 percent of the total operating cost from local funds and 20 percent of the total capital costs.
BE IT FURTHER RESOLVED that Faribault County authorizes the County Board Chairman and the Public Works Director to execute the aforementioned agreement and any amendments thereto.

Sheriff Scott Campbell and Chief Deputy Bob Toland met regarding office business.
Meyer/Benson motion carried unanimously to authorize the purchase of two GeoLynx GIS mapping workstations for $22,495 and $7,500 to develop a GIS digital base map from GEO Comm of St. Cloud.
Benson/Meyer motion carried unanimously to authorize the sheriff to obtain bids on a radio counsel and to hire Mankato Radio to write the specs.

Meyer/Lein motion carried unanimously to approve Resolution 00-PZ04-30 granting a conditional use permit to Dennis and Jane Simon for a communication tower in Winnebago City Township. Commissioners Benson, Lein, Meyer, and Prescher voted yes.
RESOLUTION
CONDITIONAL USE PERMIT
DENNIS AND JANE SIMON
SECTIONS 12, WINNEBAGO CITY TOWNSHIP
WHEREAS: Dennis and Jane Simon applied under the Faribault County Zoning Ordinance for a Conditional Use Permit for a 300’ communication tower in the A-2 General Agriculture District located at the following described property:
The Northeast Quarter (NE ¼) of Section Twenty-two (22) of Township One Hundred Four (104) North, Range Twenty-eight (28) West , Winnebago City Township, Faribault County, Minnesota. The property is located in the A-2 General Agriculture District.
See Exhibit A.
WHEREAS: The Planning Commission finds:
a. That the conditional use will not be injurious to the use and
enjoyment of other property in the immediate vicinity for the purposes already permitted, not substantially diminish and impair property values within the immediate vicinity, and is compatible with the existing neighborhood;
b. That the establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding vacant property for uses predominant in the area, conforms to the comprehensive land use plan of the county;
c. That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided;
d. That adequate measures have been or will be taken to provide sufficient off-street parking and loading space to serve the proposed use;
e. That adequate measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration, so that none of these will constitute a nuisance, and to control lighted signs and other lights in such a manner that no disturbance to the neighboring properties will result;
f. That soils conditions are adequate to accommodate the proposed use; and
g. That proper facilities are provided which would eliminate any traffic congestion or traffic hazard which may result from the proposed use.
h. The use is of the same general character as other conditional uses in the Agriculture District and will not be detrimental to the general health and welfare of the county.
NOW THEREFORE, BE IT RESOLVED: The Faribault County Board of
Commissioners approve the Conditional Use Permit to Dennis and Jane Simon for a 300’ communication tower at said tract in the A-2 General Agricultural District conditioned that:
1. The site shall be restored to the original condition if the structures are abandoned.
2. The applicant shall comply with the Federal Aviation Administration and the Federal Communication Commission regulations.
3. American Tower Corp. and PCS Services, LLC will make the site whole during construction.
