HONG KONG INSTITUTE OF LAND ADMINISTRATION (HKILA)

SCIENCE AND RESEARCH FACULTY REGULATIONS

These regulations were made and the Science And Research Faculty

was established by the Council of the HKILA

Pursuant to the Article 57 of the Article of HKILA

PART I – INTERPRETATION

1.Interpretation

1.1In these regulations, unless the context otherwise requires:-

"The Institute” means The Hong Kong Institute of Land Administration;

"The Council” means the Council of the Institute;

"Member” means a person whose name is included in the register of members of the Institute for the time being;

"The Faculty" means the Science And Research Faculty of the Institute;

"The Dean” means the Dean of the Faculty;

"The Faculty Members” means the members of the Faculty, other than Student Researchers;.

"The Student Researcher" means a person admitted by the Faculty as a student undergo a development programme by research work;

1.2Words denoting the singular shall include the plural and vice versa. Words denoting the masculine shall include the feminine.

1.3The headings are inserted for convenience only and shall not affect the construction of these regulations.

PART II – FACULTY MEMBERS

2Faculty Members

The Faculty shall consist of not less than 4 members. These Faculty members shall include:

2.1a Dean shall be elected among the Council members;

2.2a Chief Researcher shall be appointed by the Council;

2.3a Librarian shall be nominated by the Dean and appointed by the Council;

2.4a Faculty Secretary shall be appointed by the Secretary of the Council; and

2.5not less than 4 Faculty Members shall be nominated by the Dean and appointed by the Council.

PART III – FUNCTION AND POWERS

3Functions

The Faculty shall:

3.1promote land administration for its acceptance as a science and academic discipline by the general public of Hong Kong;

3.2conduct or commission research into the maintenance and advancement of academic standards and develop research programmes to enable members to enhance the academic standards for applying professional registration as qualified land administrators;

3.3organise, conduct or participate in local, regional and international forums and conferences on land administration;

3.4keep under review the needs for development of the land administration discipline and maintain land information system and facilities available to members for their advancement in the discipline;

3.5plan, develop, implement and review the research programmes leading to academic recognition of the institute;

3.6advise the Council on the standards and relevant qualifications required of the land administration profession;

3.7promote Land Administration related research and development activities through inter-institutional, regional and international co-operation and liaison;

3.8advise the Council on subjects of an interest to the Institute and prepare articles for Council publications; and

3.9assist the implementation of the training, continuing education and degree programmes of the Professional Development Committee.

3.10maintain a library to provide information and facilitate research work of members.

4Powers

The Faculty:

4.1may appoint any person or committee in relation to the performance of any duties and functions as specified in Regulation 2 and Regulation 3;

4.2may control the access of Members to the development facilities referred to in Regulation 3;

4.3may publish research reports and other materials and distribute, lend with or without charge or sell such materials in association with the Editorial and Publication Committee of the Institute;

4.4may determine and charge any fees in respect of the exercise of any function referred in Regulation 3; and

4.5subject to prior approval of the Council, may pay honoraria to any person appointed under paragraph 4.1.

PART IV – MEETINGS

5Meetings

The Faculty shall hold meetings once every 3 months, or at the request of the Council or upon the call of the Dean.

6Dean

The Dean, failing him the Chief Researcher, shall preside at a meeting of the Faculty. If both of them do not appear within 20 minutes after the time appointed for holding the meeting or if none of them is willing to preside, the meeting shall adjourn.

7Devolution

During the consideration of a particular case in which the Dean has interest, the chairmanship shall devolve, for the purpose of the consideration of the case, on the Chief Researcher. In the event that the Chief Researcher also has interest in that particular case, the Faculty Members present shall elect one among them to preside during the consideration of that case.

8Adjournment

The Dean may, with the consent of any meeting at which a quorum is present, adjourn the meeting from time to time and from place to place.

PART V – CONDUCT OF BUSINESS

9 Quorum

No business shall be transacted at any meeting unless a quorum of Faculty members is present at the time when the meeting proceeds to business and continues to be present until the conclusion of the meeting, save as provide under Regulation 10, four Faculty members including the Dean or the Chief Researcher who shall preside over the meeting pursuant to Regulation 6 and Regulation 7, shall be a quorum

10Failure to Muster a Quorum

If within 30 minutes from the time appointed for the meeting a quorum is not present, the meeting shall stand adjourned to the same day in the next week, at the same time and place, or to such other day and at such other time and place as the chairman of the meeting may determine, if at the adjourned meeting a quorum is not present within 30 minutes from the time appointed for the meeting shall be aborted and the Council shall be informed.

11To Attend and Vote

No Faculty member may attend or vote in meeting by proxy.

12Meeting of Voting

At any meeting a resolution put to the vote of the meeting shall be decided on a show of hand unless a poll is demanded:

12.1by the Dean, or

12.2by the majority of the Faculty members present.

13Casting Vote

In the case of an equality of votes and where the Dean presides at a meeting, he shall be entitled to a second or casting vote. In the case of an equality of voted happens at meeting presided by the Chief Researcher, the same item shall be put up again at the next meeting.

PART VI – LANGUAGES

14Working and Official Languages

Both Chinese and English shall be the working and official languages of the Faculty. For records of meetings and any other documents drawn up in both languages, the Chinese and English versions shall carry the same weight and be of the same effect.

15Faculty Secretary

The Faculty Secretary shall be appointed, and shall only be removed by the Secretary of the Council.

16Notice of Meeting

The Faculty Secretary shall give to the Faculty members’ notices of meetings of the Faculty.

17Minutes

The Faculty Secretary shall keep minutes of all faculty meetings and such minutes shall record the names of the Faculty members attending as well as all resolutions passed. A copy of such minutes shall be sent to the Secretary of the Council.

PART VIII – POWER OF INTERPRETATION AND AMENDMENT OF REGULATIONS

18 Interpretation and Amendment of Regulations

Notwithstanding anything contained in these regulations, the Council reserves the right to:

18.1 repeal, alter, amend or make exceptions to;

18.2 interpret any of the regulations should it at any time consider this to be necessary.
