2010 -2011 OFFICIAL CAR RAFFLE RULES

The Hernando de Soto Historical Society, Inc. is a Florida non-profit corporation. The Official Rules and Regulations of the Hernando de Soto Historical Society, Inc.’s Car Raffle are set forth below. By entering the raffle, all entrants agree to be fully and unconditionally bound by these Official Rules and Regulations, waive any right to claim ambiguity in the raffle or these Official Rules and Regulations, and further agree to be bound by the Hernando de Soto Historical Society, Inc.’s decisions and interpretation of these Official Rules.

DRAWING

Winner need not be present to win. All sold tickets will be counted and validated by the Society’s Treasurer and placed in a container. Drawing will take place at the After Parade Party’s designated location no later then 12:00 am. The committee will select the appropriate number of persons to draw the winning ticket(s). If the predetermined number of awards is three, then the first ticket to be drawn will be the winning ticket but opened last. The second ticket to be drawn will be the second place award and opened second. The third ticket to be pulled will be the Third place award but will be opened first. If the predetermined number of awards is two, then the first ticket to be drawn will be the winning ticket but opened last. The second ticket to be drawn will be the second place award but will be opened first. If the predetermined number of awards is only one, then the ticket drawn will be the winner.

ELIGIBILITY: Anyone 18 years of age or older may enter. All federal, state and local laws and regulations apply. This is not a lottery; this is a drawing by chance. All federal, state and local laws associated with receipt or use of prize, including without limitation all applicable sales, use, luxury, income and special taxes are the sole responsibility of the winner. The IRS has decided that amounts paid for chances in raffles, lotteries, or similar drawings for prizes are not gifts, and do not qualify as tax deductible charitable contributions

ENTRY: A maximum of5000 tickets will be sold. By entering this raffle, entrants accept and agree (1) to be bound by all the rules, limitations and restrictions set forth herein, and, (2) that their names and/or likeness may be disclosed to and used by the news media and may, otherwise, be used by the Hernando de Soto Historical Society, Inc. for publicity purposes. The winners name and/or likeness may be published in newspapers and announced on theHernando de Soto Historical Society, Inc.’s website. Other rules and regulations may apply. The Hernando de Soto Historical Society, Inc.’s interpretation and application of the rules and regulations shall be final. No contribution necessary. By entering this raffle, each participant releases the Hernando de Soto Historical Society, Inc., its employees, founders, directors, officers, agents or any sponsor or any of its subsidiaries, affiliated companies, franchisees, service agencies, shareholders, members, representatives, or independent contractors or any of its affiliates from any and all liability for injuries, losses or damages of any kind caused by participating in the raffle or winning any prize or resulting from acceptance, possession, use or misuse of any prize. The winner also agrees to defend, indemnify and hold the Hernando de Soto Historical Society, Inc., and/or sponsors and each of their respective officers, directors, shareholders, employees, agents and affiliates and identities harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of participating in the raffle or the winners acceptance or use of any prize. The Hernando de Soto Historical Society, Inc. WILL NOT share, sell, or otherwise distribute personal information collected by sponsor except as stated above.

TICKETS: Tickets are $25.OO each or 5 for $100.00 U.S. Dollars suggested minimum donation. Payment methods accepted are credit cards, personal checks or money orders, made payable to TheHernando de Soto Historical Society, Inc. Tickets may be assigned to and sold by Society members, or may be purchased from the Society’s office. Money for the tickets must be collected at the time of sale. Tickets that have not been sold must be returned to headquarters the week prior to the drawing by the assigned member. A data base of ticket numbers and corresponding buyers name, phone and address will be kept on file as well as the seller’s information. Tickets may also be requested for purchase by using the order form provided on the website and mailed to Hernando de Soto Historical Society, Inc. at 910 3rd Avenue West, Bradenton, Florida34205. Mailed ticket orders must be accompanied by a valid credit card number, expiration date, 3 digit security code (on back), and your name printed as it appears on the credit card and your signature, or by a check or money order.All Payments must be made payable to theHernando de Soto Historical Society, Inc. Tickets may not be purchased via email or voicemail. As soon as payment clears your ticket(s) request will be processed. You will receive a ticket stub in the mail. All tickets purchased before an entry deadline are included in the drawing even if the ticket receipt arrives after the drawing date. Please allow one week for delivery. Tickets will be sold on a first come first serve basis. You may purchase as many tickets as you wish, subject to availability. Each ticket can only be purchased in the name of one person. If more than one name appears on a ticket entry form, then the first name listed will be deemed the purchaser of that ticket. The Hernando de Soto Historical Society, Inc. will reject any ticket order if the check or credit card payment is not honored or returned for insufficient funds. The ticket receipt(s) will be mailed to the name and address on the entry form. Tickets may not be changed, sold or transferred by the purchasing party or anyone else without the express written approval of The Hernando de Soto Historical Society, Inc. at its sole discretion. Tickets must be purchased and paid for by 5:00 p.m. on the day of the specified deadline. If 3150 raffle tickets have not been purchased and paid for by the specified date, then this Car Raffle at the Hernando de Soto Historical Society’s sole and absolute discretion and without prior notice shall become a 50-50 drawing.

REFUNDS: All ticket sales are final. No refunds will be made except under the following circumstances: Any ticket order with payment received after the predetermined number of maximum tickets has been sold. No other refunds are available. A raffle participant's sole and exclusive remedy for the Hernando de Soto Historical Society, Inc.’s breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall The Hernando de Soto Historical Society, Inc., its directors, officers, employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits, or goodwill, or for any incidental, special punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages. The Hernando de Soto Historical Society, Inc. assumes no responsibility for printing errors in any raffle-related material, or for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadline. All entries become the property of Hernando de Soto Historical Society, Inc and will not be returned.

GRAND PRIZE DRAWING: The Hernando de Soto Historical Society, Inc.’s Car Raffle drawing will be held no later then midnight during the Hernando de Soto Historical Society, Inc.’s After Parade Party on April 2011.

PRIZE DETAILS: Hernando de Soto Historical Society, Inc., or any of their employees, affiliates, agents or assigns, will not nor do hereby offer any legal, tax or gifting advice. The winner is advised to seek professional legal, tax and investment advice prior to the purchase of a contest ticket. By acceptance of a title to the vehicle, the winner agrees to hold Hernando de Soto Historical Society, Inc. harmless in any dispute arising over any representations concerning the value of winning vehicle. Winner will have choice of (Describe vehicle(s). Winning vehicle may be upgraded at Winner’s expense. The Hernando de Soto Historical Society will honor a pre determined vehicle value of $38,000.00, or cash value of $25,000.00. Actual prize may vary from photos used in print OR vehicle(s) shown at events.

PRIZE AWARD IN THE EVENT OF NON-SELL OUT OF TICKETS: Rules as stated above shall apply except as follows: In the event that less than 3150 tickets are sold, then this Car Raffle converts to a 50/50 drawing whereas the Hernando de Soto Historical Society, Inc. retains 50% of the net profit and the winning ticket the remaining 50% of the profits. If the Hernando de Soto Historical Society, Inc. decides to have a second or third place awards, then the net profit would be split as 50% for the Hernando de Soto Historical Society, 35% for the winning ticket, 10% for the Second place award and 5% for the Third place award. For the purpose of these rules, net proceeds are defined as the balance of ticket sales revenue remaining after payment of all raffle-related fees and expenses. The net proceeds will then be divided equally between Hernando de Soto Historical Society, Inc. and the winner(s) based on Hernando de Soto Historical Society, Inc. accounting, which shall be final and conclusive with respect to the winner(s). The Hernando de Soto Historical Society reserves the right to end the raffle at any time for any reason at its sole discretion. In that event, the winner(s) will be awarded a cash prize(s) equal to the net proceeds at that time as described above.
