AMENDING CHAPTER 30
AN ORDINANCE AMENDING THE GREENSBORO CODE OF ORDINANCES
WITH RESPECT TO ZONING, PLANNING AND DEVELOPMENT
Section 1. That Section 30-2-2.7, General, is hereby amended by adding the following definition in alphabetical sequence:
“Portable Storage Unit: A transportable unit designed and used for the temporary storage of household goods, personal items, construction materials and supplies and other materials which is placed on a site for the use of occupants of a dwelling or buildingon a limited basis. Such containers are uniquely designed for their ease of loading to and from a transport vehicle.”
Section 2. That Table 30-4-5-1, Permitted Use Schedule, is hereby amended by adding “Portable Storage Unit” under the “Other Uses” subsection, by placing a “0000” entry in the Ref SIC column and by placing a “D” entry in the AG, RS-40, RS-30, RS-20, RS-15, RS-12, RS-9, RS-7, RS-5, RM-5, RM-8, RM-12, RM-18, RM-26, LO, GO-M, GO-H, NB, CB, and TN-1 columns.
Section 3. That Section 30-5-2, Development Standards for Individual Uses, is hereby amended by adding a new subsection 30-5-2.62.1 to read as follows:
“30-5-2.62.1 Portable Storage Unit
(A)Where Required: AG, all residential, LO, GO-M, GO-H, NB, CB, and TN-1 Districts
(B)General:
(1)Portable storage units may be up to sixteen (16) feet long, eight (8) feet wide, and eight (8) feet tall.
(2)The storage unit may be placed on the site for up to forty five (45) days.
(3)A residential siteshall have no more than two (2)portable storage units.
(4)The storage unit may be placed in a driveway, a designated parking area, or other location on the site. If, because of lot size or obstructions the portable storage unit cannot be located in a driveway or designated parking area, then the placement of the portable storage unit shall be exempt from thelocation requirements of Section 30-4-8.1 (Location) and the setback requirements of Section 30-4-8.2 (Setback Requirements) and any related rules or regulations.
(5)These standards do not apply to portable units for donating goods to a charitable organization (such as a Goodwill drop off), temporary construction trailers, temporary construction storage, dumpsters, or recycling facilities.”
Section 4. That Section 30-4-7.4, Encroachments into Required Setbacks is hereby amended by adding a new subsection (A) (6) and new subsection (B) (4) to read as follows:
“(6) Portable Storage Units as defined in Section 30-2-2.7”; and
“(4) Portable Storage Units as defined in Section 30-2-2.7”
Section 5. That Section 30-2-2.1 Buildings and Structures is hereby amended by changing the definition of Accessory Structure as follows:
“ Accessory Structure. A detached subordinate structure, including but not limited to a portable storage unit, the use of which is customarily incidental to that of the principal structure and which is located on the same zone lot as the principal structure.”
Section 6. That Section 30-2-2.1 Buildings and Structures is hereby amended by adding the following new subsection:
“Temporary Use Structures. A detached subordinate structure, including but not limited to a portable storage unit, the use of which is temporary to that of the principal structure customarily accompanying the erection of permitted structures, the remodeling of permitted structures, the repair of permitted structures, or the removal of personal property from permitted structures.”
Section 7. That Section 30-2-2.11 Signs is hereby amended by exempting the identifying name and logo on the portable storage unit as follows:
“Commercial Message. Any sign, wording, logo, or other representation that, directly or indirectly, names, advertises, or calls attention to a business, product, service, or other commercial activity, except as that message appears on the side of a portable storage unit and identifies or relates to the business of the portable storage company.”
Section 8. That Section 30-2.2 Definitions is amended by amending the definition of storage trailer as follows:
“Storage trailer. A detached subordinate structure originally constructed with wheels, or a transportable unit transported by trailer or truck, in order to be transported over the highways, originally designed for storage or converted to use as a storage structure on a temporary or long term basis. An uncoupled truck trailer, an inoperable travel trailer, and an uninhabitable manufactured dwelling, a portable storage unit all meet this definition if used for storage of materials of any kind. A storage trailer placed at a church, school, government building, or business for the acceptance of goods donated to charity or dropped off for recycling and towed away on a regular schedule or whenever full does not meet this definition.A storage trailer at a construction site does not meet this definition.”
Section 9. That Section 30-8-3 Enforcement Procedure is amended by adding the following subsection:
“The enforcement officer shall also give the owner of any portable storage unit business
Notice of the violation and of the measures necessary to remedy the violation.”
Section 10. That Section 30-8-3.1 Notice of Violation. is amended to add the following subsection:
“The enforcement officer shall also give the owner of the portable storage unit business Notice of the violation and of the measures necessary to remedy the violation.”
Section 11. All ordinances in conflict with the provisions of this ordinance are repealed to the extent of such conflict.
Section 12. This ordinance shall be effective upon the date of adoption.
