The Macomb City Council met in a regular session on Monday, October 20, 2008 at 7:00 p.m. in the Council Chambers in City Hall, 232 East Jackson Street, Macomb, IL

PLEDGE Mayor Wisslead called the meeting to order. The Pledge of Allegiance was led by Eli Blasi and

Gareth Applegate of Boy Scout troop 303.

ROLL CALL City Clerk Melanie Falk called the roll and the following Aldermen answered present: Richard Vick, Louis Gilbert, Mike Inman, Dave Dorsett, and Tim Lobdell. Five Aldermen being present and three absent, Edward Lavin, Ken Zahnle and Dennis Moon, Mayor Wisslead declared a quorum present for the transaction of business. In addition to the Mayor, City Clerk and Aldermen, City Administrator Dean Torreson and Legal Counsel Liz Wilhelm were also present.

PRESENTATION Mayor Wisslead presented the deed for property at 1416 East Pierce Street to Jerry Peabody,

TO HABITAT FOR President of the McDonough County Habitat for Humanity.

HUMANITY

Items on the Consent Agenda:

1.  Minutes of the Macomb City Council meeting held on Monday, October 6, 2008, and the Committee of the Whole meetings held on Monday, October 13, 2008.

2.  Approve claims and accounts submitted on October 13, 2008.

3.  Place on file the following Departmental Reports: Police Department, Fire Department

4.  Accept and place on file Treasurer’s Report for September 2008.

5.  Approve the dates of October 30th and October 31st as Halloween Trick or Treating nights.

CONSENT Alderman Lobdell moved, seconded by Alderman Dorsett to dispense with the reading of the consent

AGENDA agenda and adopt the same as published, on question being put, Aldermen Vick, Gilbert, Inman, ADOPTED Dorsett, and Lobdell, being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor

Wisslead declared the motion carried.

ELIMINATION Alderman Inman moved, seconded by Alderman Gilbert to concur with the recommendation to

MCPT FARES FOR approve the elimination of fares for the MCPT fixed route bus system, on question being put,

FIXED ROUTES Aldermen Gilbert, Inman, Dorsett, Lobdell, and Vick, being all Aldermen voting “Aye” on roll call and

APPROVED no “Nay” votes, Mayor Wisslead declared the motion carried.

Legal Counsel Wilhelm presented the following ordinance for 2nd reading:

An ordinance annexing certain territory located in McDonough County, Illinois and located in the South East Quarter of Section 23 in Emmet Township, McDonough County, Illinois.

ORDINANCE Alderman Dorsett moved, seconded by Alderman Lobdell to approve the ordinance, on question APPROVED being put, Aldermen Inman, Dorsett, Lobdell, Vick and Gilbert, being all Aldermen present voting NO. 08-48 “Aye” and no “Nay” votes, Mayor Wisslead declared the motion carried and the ordinance was

approved and became Ordinance # 08-48.

Legal Counsel Wilhelm presented the following ordinance for 2nd reading:

An ordinance to create a special event liquor license for the McDonough District Hospital annual Festival of Trees Gala.

ORDINANCE Alderman Inman moved, seconded by Alderman Lobdell to approve the ordinance, on question being APPROVED put, Aldermen Lobdell, Vick, Gilbert and Inman, being all Aldermen voting “Aye” and no “Nay” votes, NO. 08-49 and Alderman Dorsett recusing, Mayor Wisslead declared the motion carried and the ordinance was

approved and became Ordinance # 08-49.

Legal Counsel Wilhelm presented the following ordinance for 2nd reading:

An ordinance to create a Class R plus SS plus OL Liquor License for the Ghada Company

d/b/a The Islands.

ORDINANCE Alderman Vick moved, seconded by Alderman Lobdell to approve the ordinance, on question being APPROVED put, Aldermen Lobdell, Vick, and Gilbert voting “Aye” and Alderman Inman voting “Nay” and Alderman NO. 08-50 Dorsett recusing, Mayor Wisslead declared the motion carried and the ordinance was approved and

became Ordinance #08-50.

Legal Counsel Wilhelm presented the following ordinance for 2nd reading:

An ordinance to authorize the sale of certain City personal property (vehicles and equipment)

owned by the City.

ORDINANCE Alderman Lobdell moved, seconded by Alderman Dorsett to approve the ordinance, on question APPROVED being put, Aldermen Vick, Gilbert, Inman, Dorsett, and Lobdell, being all Aldermen present voting NO. 08-51 “Aye” and no “Nay” votes, Mayor Wisslead declared the motion carried and the ordinance was

approved and became Ordinance # 08-51.

Legal Counsel Wilhelm presented the following ordinance for 2nd reading:

An ordinance to amend the City Fee Schedule to increase water rates by amending

Section 24-3(H).

ORDINANCE Alderman Inman moved, seconded by Alderman Gilbert to approve the ordinance effective May 1, APPROVED 2009, on question being put, Aldermen Gilbert, Inman, Dorsett, Lobdell, and Vick, being all Aldermen

NO. 08-52 present voting “Aye” and no “Nay” votes, Mayor Wisslead declared the motion carried and the

ordinance was approved and became Ordinance # 08-52

REJECTION OF Alderman Lobdell moved, seconded by Alderman Inman, to reject all bids for the Oakwood CEMETERY BIDS Cemetery building addition, on question being put, Aldermen Inman, Dorsett, Lobdell, Vick, APPROVED and Gilbert, being all Aldermen present voting “Aye” on roll call and no “Nay” votes, Mayor Wisslead

declared the motion carried.

APPLICATION Alderman Inman moved, seconded by Alderman Dorsett to approve applying for a CDAP grant for the FOR CDAP GRANT E. Carroll Street and E. Calhoun Street water main project and hiring Benton & Associates for APPROVED engineering services not to exceed $23,000.00, on question being put, Aldermen Dorsett, Lobdell,

Vick, Gilbert, and Inman, being all Aldermen present voting “Aye” and no “Nay” votes, Mayor

Wisslead declared the motion carried.

HIRING Alderman Lobdell moved, seconded by Alderman Dorsett to authorize the hiring of Todd Simmons for TODD SIMMONS the position of Water Treatment Plant Operator at the salary of $24,214.48, on question being put, W.T. PLANT Aldermen Lobdell, Vick, Gilbert, Inman, and Dorsett, being all Aldermen present voting “Aye” and no APPROVED “Nay” votes, Mayor Wisslead declared the motion carried.

ALDERMAN INMAN Alderman Dorsett moved, seconded by Alderman Lobdell to concur with the Mayor’s appointment of APPOINTED Mike Inman to the Macomb Park District Committee, on question being put, Aldermen Vick, Gilbert, MACOMB PARK DIST. Inman, Dorsett and Lobdell, being all Aldermen present voting “Aye” and no “Nay” votes, Mayor COMMITTEE Wisslead declared the motion carried.

ALDERMAN MOON Alderman Dorsett moved, seconded by Alderman Inman to concur with the Mayor’s appointment of

APPOINTED Dennis Moon to the Annexation Commission, on question being put, Aldermen Gilbert, Inman, ANNEXATION Dorsett, Lobdell and Vick being all Aldermen present voting “Aye” and no “Nay” votes, Mayor COMMISSION Wisslead declared the motion carried.

EXECUTIVE Alderman Lobdell moved, seconded by Alderman Dorsett to adjourn into executive session for the SESSION purpose of a) Appointment, employment compensation, discipline, performance or dismissal of an

employee of the public body or legal counsel for the public body, pursuant to Sec. 2(c)(1) of the Open

Meetings Act, and b) The purchase or lease of real property for the use of the public body, pursuant to Sec. 2(c) (5) of the Open Meetings Act, on question being put, Inman, Dorsett, Lobdell, Vick, and Gilbert, being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Wisslead declared the motion carried and they adjourned into executive session at 7:28 p.m.

OPEN Alderman Dorsett moved, seconded by Alderman Gilbert to adjourn back into open session, all SESSION Aldermen voted “Aye” and they adjourned back into open session at 7:44 p.m.

COUNCIL There being no further business to come before the Council, Alderman Vick moved, seconded by

ADJOURNMENT Alderman Lobdell to adjourn, all Aldermen voted “Aye” and Mayor Wisslead declared the motion carried and they adjourned at 7:44 p.m.
