AN ACT TO AMEND SECTION 5051335, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE USE OF CRAB POTS, SO AS TO DELETE LANGUAGE PERMITTING THE USE OF CRAB POTS FOR COMMERCIAL PURPOSES BETWEEN MAY FIRST AND OCTOBER FIRST WITHIN PAWLEY’S ISLAND CREEK AND MIDWAY CREEK ON PAWLEY’S ISLAND AND TO FURTHER PROVIDE THAT IT IS UNLAWFUL TO SET OR USE CRAB POTS IN THE ATLANTIC OCEAN WITHIN ONE HUNDRED FIFTY FEET OF THE MEAN LOW TIDE WATERMARK ON PAWLEY’S ISLAND.

Be it enacted by the General Assembly of the State of South Carolina:

Use of crab pots in certain Pawley’s Island creeks and Atlantic Ocean within one hundred fifty feet of mean low tide watermark on Pawley’s Island

SECTION1.Section 5051335 of the 1976 Code, as added by Act 245 of 2000, is amended to read:

“Section 5051335.(A)It is unlawful to set or use a trap or basket commonly termed a ‘crab pot’ to catch crab for commercial purposes within Pawley’s Island Creek and Midway Creek on Pawley’s Island in Georgetown County. Individuals may set two crab pots to catch crabs for personal consumption and not for sale.

(B)It is unlawful to set or use a trap or basket commonly termed a ‘crab pot’ to catch crab in the Atlantic Ocean within one hundred fifty feet of the mean low tide watermark on Pawley’s Island in Georgetown County. Individuals may catch crabs in the Atlantic Ocean within one hundred fifty feet of the mean low tide watermark on Pawley’s Island by means other than the use of a ‘crab pot’ for personal consumption and not for sale.”

Time effective

SECTION2.This act takes effect upon approval by the Governor.

Ratified the 8th day of May, 2002.
