Compulsory BRIEFING session:
A compulsory clarification meeting with representatives of the Employer will take place at Transnet Engineering, PCO Building Germiston Office (3 Keswick Road)on Tuesday8November 2017 starting at 10H00. Tenderers need to bring their down loaded tender document to the compulsory clarification session.
Transnet reserves the right to accept the whole or any part of a tender. Transnet also reserves the right to negotiate terms and conditions with all, or a short-listed group of contenders, or the preferred tenderer, should it be deemed necessary. Furthermore, Transnet reserves the right to accept a complete Bid, even if it is not the lowest, provided it is in the best interest of Transnet.
In summary, Transnet reserves the right to:
- Modify the RFP’s Services or other terms and conditions and request respondents to re-bid on any changes;
- Reject any proposal which does not conform to the detailed instructions and specifications;
- Disqualify proposals submitted after the stated submission deadline;
- Not necessarily accept the lowest priced proposal;
- Reject all proposals, if it so decides;
- Award a contract in connection with the NEC/RFPat any time after the NEC/RFP’s closing date;
- Award only a portion of the proposed services which are reflected in the scope of the NEC/RFP;
- Split the award of the contract between more than one supplier; or
- Make no award of a contract.
The successful tenderer will be required to enter into a NEC (VOL 3) Part C1-C2 Contract (pricing schedule/activities schedule of the contract).

Please note that this tender closes punctually at 10H00 am (South African Time) on Tuesday, 28 November 2017.
If responses are not delivered as stipulated herein, such responses will not be considered and will be treated as "NON-RESPONSIVE" and will be disqualified.
Telegraphic, telephonic, facsimile, e-mail and late tenders will not be accepted.
The responses to this tender will be opened as soon as practicable after the expiry of the time advertised for receiving them.
Transnet shall not, at the opening of responses, disclose to any other company any confidential details pertaining to the Proposals / information received, i.e. pricing, delivery, etc. The names and locations of the Respondents will be divulged to other Respondents upon request.
Envelopes must not contain documents relating to any tender other than that shown on the envelope.
Tenders may only be submitted on the tender documentation that is issued.
COMMUNICATION
Respondents are warned that a Proposal will be liable to disqualification should any attempt be made by a Respondent either directly or indirectly to canvass any officer or employee of Transnet in respect of this tender between the closing date and the date of the award of the business.
For all technical or tender document queries, clarification questions can be submitted to Transnet as from 8thNovember 2017 until 21November2017 before 10:00am. Please note that no further queries will be accepted after 10:00am on 21November 2017.
In the interest of fairness and transparency Transnet’s response to such a query will be made available to the other Respondents who have collected tender documents. For this purpose Transnet will communicate with Respondents using the contact details provided to the Secretariat on issue of the bid documentation to the Respondent. Kindly ensure that you provide the Secretariat with the correct contact details, as Transnet will not accept responsibility for being unable to contact a bidder who provided incorrect contact details.
After the closing date of the tender, a Respondent may only communicate with the Secretariat of the Transnet Acquisition Council, at telephone number 011 820 2296, email Mpumi on any matter relating to the tender Proposal.
Respondents found to be in collusion with one another will be automatically disqualified and restricted from doing business with Transnet in the future.
Disputes regarding the bidding process must be settled by the Procurement Ombudsman.
Prequalification criteria for Preferential Procurement
Respondents are to note that they are eligible to participate in this NEC/RFP should they meet one or more of the prequalification criteria for preferential procurement stipulated in paragraphs F.3.11.3below.
Exempted Micro Enterprises & Qualifying Small Enterprises
Transnet has set a prequalification criterion that only Exempted Micro Enterprises (EMEs) and Qualifying Small Enterprises (QSEs) may participate in this NEC/RFP process. A bid that fails to meet this pre-qualifying criterion will be regarded as an unacceptable bid.
Minimum B-BBEE level
Transnet has set a minimum B-BBEE threshold for participation in this RFP process. The minimum B-BBEE threshold in this instance is a B-BBEE Level 1. A bid that fails to meet this pre-qualifying criterion will be regarded as an unacceptable bid.
B-BBEE Improvement Plan
Transnet encourages its Suppliers to constantly strive to improve their B-BBEE rating. Whereas Respondents will be allocated points in terms of a preference point system based on its B-BBEE scorecard to be assessed as detailed in paragraph above, in addition to such scoring, Transnet also requests that Respondents submit a B-BBEE improvement plan. Respondents are therefore requested to indicate the extent to which they will maintain or improve their B-BBEE status over the contract period.

The score for quality is to be calculated using the following formula:

PRE-QUALIFICATION AND EVALUATION METHODOLOGY AND CRITERIA:
STAGE ONE: Test for Administrative Responsiveness
STAGE TWO: Test for Substantive Responsiveness to NEC/RFP
The test for substantive responsiveness to this RFP will include the following:

The evaluation will be in two stage and the following procedures will be applied:
STAGE 1: EVALUATION FOR FUNCTIONALITY/QUALITY
Tenders will be evaluated for functionality/quality to determine the tenderer’s capability and state of readiness to undertake a project of this nature and magnitude. Only those tenders that score a minimum of 60 (60%) total evaluation points for quality (under the evaluation criteria shown in the table below for Stage 1 evaluation) and will go through to Stage 2 evaluation for Price and Preference points. However, the points scored by tenderers for quality will not be added to the Stage 2 evaluation points.
A tenderer’s failure to submit the requisite documentation and/or information as prescribed hereunder as well as in the relevant forms of the tender document to enable the evaluation of his tender will result in no points being awarded to the tenderer under the affected evaluation criteria.
Tenders that do not meet the minimum total evaluation score of 60 (60%) points for functionality will not be evaluated any further and will be disqualified.
STAGE 2: EVALUATION FOR PRICE AND PREFERENCE (80/20)
This stage will be evaluated based on the PPPFA of the PMFA 2001.
Preference points will be awarded in accordance with B-BBEE Status Level of Contributor as stipulated in the revised Preferential Procurement Regulations of 2011 that have been issued in terms of section 5 of the Preferential Procurement Policy Framework Act (PPPFA) of 2000
Upon request by the Employer, the Tenderer undertakes to provide adequate documentation to fully justify his points claim. Failure to provide any justification shall result in the tender being rejected. The Employer may evaluate the justification documentation independently and shall in such cases, in his evaluation of the tender, determine, at his sole discretion, the quality points applicable. The BBBEE certificate must be issued or verified by SANAS (SA National Accreditation System) accredited agency.
The Quality breakdown is as follows:

5 points for minimum of 5 years relevant experience and professional registration
2.5 points for minimum of 3 years relevant experience and professional registration
0 points for failure to meet/provide necessary qualifications and experience required. / 20
Consultant experience with respect to specific aspects of the project/comparable projects: Signed reference letters from clients required:
3 or more references = 40 points
2 references = 20 points
1 references = 10 points
0 reference = 0 points / 40
Total Points / 100
Scores of 60 % (Poor), 70 % (Satisfactory), 90 % (Good) or 100 % (Very Good) will be allocated to each of the criteria and sub-criteria based on the indicators contained in these schedules. The scores of each of the evaluators will then be averaged, weighted and then totaled to obtain the final score for quality.
F.3.11The minimum number of evaluation points for quality is 60% of 100% max. Points for quality in order for the tender to be considered as being responsive in terms of quality and for it to be considered for further evaluation.
F.3.13.1Tender offers will only be accepted if:
The tenderer has in his or her possession an original valid Tax Clearance Certificate issued by the South African Revenue Services or has made arrangements to meet outstanding tax obligations.
The tenderer is not in arrears for more than 3 months with municipal rates and taxes and municipal service charges;
The tenderer or any of its directors is not listed on the Register of Tender Defaulters in terms of the Prevention and Combating of Corrupt Activities Act of 2004 as a person prohibited from doing business with the public sector.
