Americans with Disabilities Act. All faculty and staff of Jefferson Davis Community College should make themselves aware of the ADA and work to assure compliance with its regulations. If you are asked to provide accommodations for a person who is covered by the ADA, please contact the Dean of Student Affairs. All requests for accommodations must be presented to the college in written form.

ADA Compliance and Section 504 of the Rehabilitation Act of 1973. Jefferson Davis Community College complies with Section 504 of the Rehabilitation Act of 1973 as amended and does not discriminate on the basis of qualified disability in admission of, access to, or treatment or employment in, its programs or activities. The Americans with Disabilities Act (ADA) provides federal and civil protection to people who are disabled.

Compliance with the Americans with Disabilities Act is a priority of Jefferson Davis Community College. To ensure institutional compliance, the administration has:

1. appointed one individual to oversee compliance with the Americans with Disabilities Act;

2. required comprehensive self-evaluation of all programs and activities of the institution, including employment;

3. provided a committee to assist the Dean of Student Affairs in his or her functions, in preparation of the self-evaluation, and in implementation of a plan of compliance;

4. provided funding for the activities of the Dean of Student Affairs and for reasonable accommodations of auxiliary aids and services;

5. prepared, published, and distributed policy statements and procedures; and,

6. initiated additional activities deemed necessary by the administration to comply with the Americans with Disabilities Act, unless these pose an undue burden or would result in a fundamental alteration of programs of the institution.

Further, the administration solicits the involvement of the community and individuals with disabilities in conducting the self-evaluation and in setting priorities for compliance.

ADA Grievance Procedure. Jefferson Davis Community College has adopted an internal grievance procedure providing for prompt and equitable resolution of complaints alleging any action prohibited by the U.S. Department of Justice regulations implementing Title II of the Americans with Disabilities Act. Title II states, in part, that "no otherwise qualified disabled individual shall, solely by reason of such disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination" in programs or activities sponsored by a public entity.

Complaints should be addressed to: Dean of Student Affairs, Jefferson Davis Community College, Post Office Box 958, Brewton, Alabama 36427, (251) 867-4832.

1. A complaint must be filed in writing. It must contain the name and address of the person filing it and must briefly describe the alleged violation of the regulations.

2. A complaint must be filed within ten (10) business days after contacting the Dean of Student Affairs of the alleged violation. (Processing of allegations of discrimination which occurred before the grievance procedure was in place will be considered on a case-by-case basis.)

3. An investigation, as may be appropriate, shall follow a filing of a complaint. The investigation shall be conducted by the Dean of Student Affairs. These rules contemplate informal but thorough investigations affording all interested persons and their representatives, if any, an opportunity to submit evidence relevant to a complaint.

4. A written determination as to the validity of the complaint and a description of the resolution, if any, shall be issued by the Dean of Student Affairs and a copy forwarded to the complainant no later than ten (10) business days after the completion of the investigation, via certified mail.

5. The complainant can request a reconsideration of the case in instances where he or she is dissatisfied with the resolution. The request for reconsideration must be made to the President of the College within ten (10) business days after receipt of the findings.

6. The right of a person to a prompt and equitable resolution of the complaint filed thereunder shall not be impaired by the person's pursuit of other remedies such as the filing of an ADA complaint with the responsible federal department or agency. Use of this grievance procedure is not a prerequisite to the pursuit of other remedies.

7. These rules shall be construed to protect the substantive rights of interested persons, to meet appropriate due process standards and to assure that Jefferson Davis Community College complies with the Americans with Disabilities Act in implementing regulations.

8. The Dean of Student Affairs shall maintain the files and records of the college relating to the complaints filed.
