STAR PROPERTIES OF OSHKOSH, LLC
NON STANDARD RENTAL PROVISION
______1. Lessee agrees that rent is due according to rent schedule on the rent Payment Addendum. The Lessor doesn’t agree to pick up the rent. A late charge of 5% will apply to rent received or postmarked after the specified due date and $5.00 per day thereafter. THIS POLICY WILL BE STRICTLY ENFORCED!
______2. Rent may be paid with a personal check, however once a check doesn’t clear or bounces, you will no longer be allowed to pay your rent with a personal check. Rent then must be paid with a cashier’s check or cash (if rent is paid in cash a receipt will be given upon request). A $50.00 bounced check fee will be assessed on all returned checks that do not clear.
______3. Lessee agrees that if Lessee doesn’t voluntarily pay extra fees (i.e. late charge, returned check fees, etc) owed to Lessor as set forth in the lease and Non Standard Rental Provision, Lessor reserves the right to deduct these fees from the security deposit and turn over the amount due in excess of the security deposit for collection by an attorney or agency. Lessee may be responsible for any cost incurred by Lessor as a result of placing a delinquent account with an attorney or agency for collection.
______4. Lessee is responsible to notify Lessor within 48 hours of water leaks and toilets that run constantly. If Lessee fails to notify Lessor, then Lessee will be charged for additional usage on all water bills.
______5A. Cleaning: The Lessee is encouraged to report any problems with the cleanliness of the unit or damages within 7 days of the lease start date. When the tenancy is ended the Lessees will leave the premise in a clean condition. This includes appliances, cupboards, baseboards, bathrooms, all floors and walls. The apartment should be ready for the next tenants. If this is not adequately done the premise will be cleaned and billed at a rate of $35.00 per hour, or the current rate from service master or the cleaning service that is hired. The charges will be deducted from the security deposit and any additional amounts billed to the Lessees for immediate payment.
______5B. Carpets: The Lessee is responsible for having the carpets professionally cleaned (must provide landlord with a receipt from the professional carpet cleaner. Rug doctors, ect. are not acceptable) Lessee must use one of the following: Service Master 233-6699 or Stanley Steamer 231-2242 or any professional service.
______6. Lessee agrees that Lessor assumes no liability for Lessee’s personal belongings or inconvenience due to fire, water, storms, flooding or any other catastrophe. We strongly recommend Lessee to carry renter insurance.
______7. Lessee agrees that NO PETS ARE ALLOWED ON THE PREMISES PERMANENTLY OR TEMPORARILY. Even a “visitor” is in violation of this stipulation. Under no circumstances may pets be acquired after occupancy. If an unauthorized pet is found on the premise, ALL Lessees will automatically forfeit their security deposit.
______8. Lessee agrees to follow recycling guidelines established by the City of Oshkosh. If trash and recyclables are not taken out weekly we hold the right to take it out for you and haul it away and you will be charged a minimum fee of $50.00 per occurrence. It will be the tenant’s responsibility to pay any trash fees charged by the City of Oshkosh.
______9. Parking areas provided for operable licensed tenant vehicles only. These areas may not be used for storage of other vehicles, boats, or car parts. Parking is for tenant vehicles only and vehicles cannot be parked on any part of the lawn. Any offending vehicles will be ticketed and towed at the expense of the owner (per city code $225.00 fine).
______10. See attached smoke alarm sheet. All required smoke detectors are properly installed in each unit for the protection of the occupants. It is a violation of Wisconsin State law and this lease to remove the batteries or tamper with the smoke detectors. Please notify Lessor immediately if you suspect any failure or problem with the smoke detectors.
______11. Lessee agrees that any furniture placed on porches or balconies must be appropriate outdoor furniture. No “indoor” furniture is allowed outside (per city code $225.0 fine).
______12. Lessee agrees that if the lease is broken, Lessee will be responsible for all terms of the lease, including all rent & utilities, lawn care and shoveling for the remainder of the lease, or until a new tenant is found by Lessee. Lessee agrees to pay a $400.00 break lease fee and to pay for any advertising. Lease cannot be broken until a new person is found to take over the lease and is approved by the current tenants on the lease. It is the responsibility of the Lessee to find another tenant to take over their lease, not Star Properties.
______13. Lessee agrees to be responsible for all plugged sinks, drains and toilets unless reported within 7 days of start of occupancy. Do not flush tampons, condoms, paper towels, or any other foreign objects down your toilet, as this will cause them to plug up.Tenants will be billed for Roto Rooter or Plumber if plugged sewers and toilets are found to be from their negligence.
______14. In order to ensure the return of the entire security deposit at the end of the lease term, ALL RENT and UTILITY BILLS must be paid in full. ALL KEYS MUST BE RETURNED OR $25.00 PER KEY THAT IS MISSING WILL BE CHARGED AND WILL BE WITHHELD FROM YOUR SECURITY DEPOSIT. A SELF-ADDRESSED LEGAL SIZE STAMPED ENVELOPE WITH ONE FORWARDING ADDRESS MUST BE LEFT ON THE COUNTERNEXT TO YOUR KEYS UPON VACATING THE PREMISES. STAR PROPERTIES WILL RETURN ONE CHECK WITH ALL TENANTS NAMESON THE LEASE PLACED ON THE CHECK, THIS WILL ALLOW LEASEES TO LETIGATE AND ASSIGN PROPER DAMAGES TO PROPER TENANTS.
______15. Lessee agrees not to use security deposit for last month’s rent.
______16. Lessee agrees to vacate premises by noon on the last day of the lease.
______17. Joint and severally liable: The rent may be collected from each Lessee in the unit for your convenience, however it is understood that all Lessees are jointly and severally liable for the full amount of any payments due under this lease and any other obligations contained in the lease or attachments. ALL RENT PAYMENTS MUST HAVE RENTAL ADDRESS ON THE CHECK.
______18. Sublease: Lessees may be allowed to sublet. The Lessee, not the sub lessee, will make rent payments. It is the responsibility of the Lessee to collect from the sub lessee. All subleases will pay a $250.00 security deposit to Star Properties if added to the lease, to cover any damages.
______19. Entertaining: Lessees may be allowed to entertain up to 12 or less in their unit, any other number must have written approval from Lessor. They acknowledge their responsibility and liability for their guests and the actions of their guests. UNDER NO CIRCUMSTANCES ARE BEER KEGS AND/OR ALCOHOL PARITES ALLOWED ON THE PREMISE. If this policy is violated there will be a $300.00 fee per occurrence.
______20. Laws: Lessee agrees to abide by all federal, state and local laws, ordinances and codes. If violations occur, which are the responsibility of or caused by the actions of their guests, the Lessees agree to compensate the Lessor fully for any costs or fines incurred.
______21. Walks: The Lessee will maintain and shovel all walks. The Lessee is responsible for removing snow and ice on the steps and in front of their doors and keep them clean of snow and ice. This is to be done within 24 hours of snowfall. If not Lessor will hire this out and bill Lessee or the City of Oshkosh may remove the snow or ice and bill the property owner and we will then bill you with an additional $50.00 per hour with a minimum of $50.00.
______22. Any damages or fines created in common area will be split equally between units.
______23. If tenant locks him/herself outside of their unit or bedroom it is their responsibility, not the Lessor, to have the door unlocked by a roommate or locksmith. As a courtesy, if we have someone available, we will unlock doors between 9am and 5pm Monday-Friday’s.If Star Properties has to unlock a lock outside of these courtesy hours a $25.00 fee is due.
______24. To protect the safety and liability of Lessee and Lessor under no circumstances will alcohol be allowed in the basement. Also prohibited are make shift bars, refrigerators, string lights, and covering of the windows. Basements are for tenants personal property and laundry use only. If this rule is violated there will be a $100.00 fee per occurrence.
______25. Lessee will not hang any type of banner, poster or sign on the outside of the house, porch or basement. Furthermore, Lessee will not hang any type of banner, flags, lights or posters advertising alcohol anywhere on the property. If this policy is violated there will be a minimum charge of $50.00 for us to come in and remove these items.
_____25A. It is the responsibility of the Lessee for locksmith bill if any keys are broken off in the lock.
_____26. Any unit not vacated by noon on the last day of the lease will be charged $100.00 per day until all tenants property is removed from the premises. Lessee agrees that if the Lessee doesn’t voluntarily pay extra fees owed to Lessor. Lessor reserves the right to deduct these fees from the security deposit.
______27. All security deposits are due within 10 days of date of lease signing.
______28. Lessees agree to pay $75.00 per month per air condition unit. If tenant doesn’t notify Lessor of air conditioner units and still uses one, Lessor will assume units were in place from May through September and bill tenants. Tenants agrees to remove all units by October 15th or a bill will be assessed of $75.00 per unit.
______29. Tenants are responsible for all broken windows and screens during lease term, including vandalism to house or windows.
______30. Replace your light bulbs, Landlord does not supply window treatments, shades, curtains, curtain rods, shower curtains or rods, or light bulbs.
______31. All work performed on behave of Landlord due to tenant waste or neglect will be billed as follows: Electrical (market Rate), Plumbing (Market Rate), Carpentry / Drywall (Market Rate), all others $35.00 per hour.
______32. There is no smoking allowed in any Units, Houses, or Basements owned by Star Properties.
