1.6Applicablelegislationandotherindustrialinstruments

1.6.1TheprovisionsofthisAwardshallbereadinconjunctionwithapplicablelegislationsuchastheCorrectiveServicesAct2000andRegulations,PublicServiceAct1996andRegulationsandDirectivesissuedunderthePublicServiceAct1996.

1.6.2TheprovisionsoftheAwardshallbereadinconjunctionwithrelevantcertifiedagreementstotheextentofanyinconsistencybetweenthisAwardandacertifiedagreementthecertifiedagreementwilltakeprecedence.

1.6.3TotheextentofanyinconsistencybetweenthebodyofthisAwardandSchedule2(MatterspertainingtotheWoodfordCorrectionalCentre),Schedule2shallprevail.

1.7Definitions

1.7.1"Act" meanstheIndustrialRelationsAct1999asamendedandreplacedfromtimetotime.

1.7.2"AfternoonShift" meansanyshiftcommencingonorafter12noonandfinishingafter6.00p.m.andatorbeforemidnight.

1.7.3"BrokenDuty" meansworkperformedinmorethanonecontinuousperiodonanyonedayequivalenttothetotalordinarydailyworkinghours.

1.7.4"CasualEmployee" meansanEmployeewhoisengagedonanirregularbasistocoverunscheduledabsencesorimmediateunforeseeablecircumstancesthatrequireadditionalstaffing.

1.7.5"ClassificationLevel" shallcompriseanumberofPaypointsthroughwhichEmployeeswillbeeligibletoprogress,asidentifiedinSchedule1.

1.7.6"Commission" meanstheQueenslandIndustrialRelationsCommission.

1.7.7"ContinuousShiftWork" meansworkdonebyseparaterelaysofEmployeeswherethehoursofworkareregularlyrotatedinaccordancewithashiftrostercoveringa24hourperdayoperationovera7dayweek.

1.7.8"DayShift" meansanyshiftotherthananAfternoonShiftorNightShift.

1.7.9"DayWork" meansworkperformedotherthanuponashiftworkbasis.

1.7.10"Department" meansDepartmentofCorrectiveServicesconstitutedbytheCorrectiveServicesAct2000.

1.7.11"Employee" meansanEmployeeremuneratedunderSchedule1ofthisAward.

1.7.12"GenericLevelStatement" meansabroad,concisestatementoftheduties,skillsandresponsibilitiesindicativeofagivenClassificationLevel.

1.7.13"Increment" meansforallEmployeesanincreaseinsalaryfromonePaypointtothenexthighestPaypoint.

1.7.14"NightShift" meansanyshiftcommencingonorafter6.00p.m.andfinishingaftermidnight.

1.7.15"Non-ContinuousShiftWork" meansworkregularlyrotatedinaccordancewitharosterwhichprescribes2ormoreshifts(day,afternoonornight)perday,butdoesnotcovera24hourperdayoperationovera7dayweek.

1.7.16"Part-timeEmployee" meansanEmployeewhoisengagedonaregularbasiswithordinaryhoursoflessthan38hoursperweek.

1.7.17"Paypoint" meansthespecificrateofremunerationpayabletoEmployeeswithinaClassificationLevel.

1.7.18"TemporaryEmployee"meansanEmployeewhomaybeengagedeitheronafull-timeorpart-timebasisforthepurposeofmeetingtemporarycircumstances.

1.7.19"Union/QPSU" meansTheQueenslandPublicSectorUnionofEmployees.

PART2 - flexibility

2.1Enterpriseflexibility

2.1.1Aspartofaprocessofimprovementinproductivityandefficiency,discussionshouldtakeplaceatanenterprisetoprovidemoreflexibleworkingarrangements,improvementinthequalityofworkinglife,enhancementofskills,trainingandjobsatisfactionandtoencourageconsultativemechanismsacrosstheworkplace.

2.1.2Theconsultativeprocessesestablishedinanenterpriseinaccordancewithclause2.1mayprovideanappropriatemechanismforconsiderationofmattersrelevanttoclause2.1.1. Uniondelegatesattheplaceofworkmaybeinvolvedinsuchdiscussions.

2.1.3AnyproposedgenuineagreementreachedbetweentheDepartmentandEmployee/sintheDepartmentiscontingentupontheagreementbeingsubmittedtotheCommissioninaccordancewithChapter6oftheActandistohavenoforceoreffectuntilapprovalisgiven.

2.2Procedurestoimplementfacilitativeawardprovisions

2.2.1WhereverfacilitativeprovisionsappearinthisAwardwhichallowfordeterminationoftheconditionsofemploymentbyagreementbetweentheDirector-GeneralandtheQPSUortheDirector-GeneralandthemajorityofEmployeesaffected,thefollowingproceduresshallapply:

(a)FacilitativeawardprovisionscanbenegotiatedbetweenmanagementandEmployeeswhoaredirectlyaffectedbysuchproposalsorbetweenmanagementandtheQPSUdependingupontheparticularAwardprovisions.

(b)EmployeesmayberepresentedbytheirlocalQPSUdelegate/sandshallhavetherighttoberepresentedbytheirlocalQPSUofficial/s.

(c)Facilitativeawardprovisionscanonlybeimplementedbyagreement.

(d)Indeterminingtheoutcomefromfacilitativeprovisions,neitherpartyshouldunreasonablywithholdagreement.

(e)Agreementisdefinedasobtainingconsentofgreaterthan50%ofEmployeesdirectlyaffectedoroftheQPSUdependingupontheparticularAwardprovisions.

(f)WhereaprovisionreferstoagreementbythemajorityofEmployeesaffected,allEmployeesdirectlyaffectedshallbeconsultedasagroup. ShouldtheconsultationprocessidentifyEmployeeswithspecificconcernswhichrelatetoeitherequityoroccupationalhealthandsafetyissuessuchconcernsmaybecateredforonanindividualbasissubjecttooperationalrequirements.

(g)Anyagreementreachedmustbedocumented,andshallincorporateareviewperiod.

(h)WheretheagreementrelatestoeithertheworkingofordinaryhoursonotherthanaMondaytoFridaybasis,theintroductionofshiftworkorchangetotheshiftrostertherelevantUnion/saretobenotifiedinwritingatleastoneweekinadvanceofagreementbeingsought.

PART3 - communication,consultationanddisputeresolution

3.1Preventionandsettlementofdisputes

3.1.1TheobjectivesofthisprocedurearetheavoidanceandresolutionofanydisputesovermatterscoveredbythisAward,bymeasuresbasedontheprovisionofinformationandexplanation,consultation,co-operationandnegotiation.

3.1.2Subjecttolegislation,whilethedisputeprocedureisbeingfollowed,normalworkistocontinueexceptinthecaseofagenuinesafetyissue. Thestatusquoexistingbeforetheemergenceofadisputeistocontinuewhilsttheprocedureisbeingfollowed. Nopartyshallbeprejudicedastothefinalsettlementbythecontinuationofwork.

3.1.3ThereisarequirementformanagementtoproviderelevantinformationandexplanationandconsultwiththeappropriateEmployeerepresentatives.

3.1.4IntheeventofanydisagreementbetweenthepartiesastotheinterpretationorimplementationofthisAward,thefollowingproceduresshallapply:

(a)ThematteristobediscussedbytheEmployee'sQPSUrepresentativeand/ortheEmployee/sconcerned(whereappropriate)andtheGeneralManager/Managerinthefirstinstance. Thediscussionshouldtakeplacewithin24hoursandtheprocedureshouldnotextendbeyond7days.

(b)Ifthematterisnotresolvedunderclause3.1.4(a),itshallbereferredbytheQPSUrepresentativeand/ortheEmployee/stotheExecutiveDirector/Directorwhoshallarrangeaconferenceofthepartiestodiscussthematter. Thisprocessshouldnotextendbeyond7days.

(c)IfthematterremainsunresolveditmaybereferredtotheDirector-Generalornomineefordiscussionandappropriateaction. Thisprocessshouldnotexceed14days.

(d)IfthematterisnotresolvedthenitmaybereferredbyeitherpartytotheCommissionforconciliation.

3.1.5NothingcontainedinthisprocedureshallpreventtheQPSUortheQueenslandGovernmentfrominterveninginrespectofmattersindispute,shouldsuchactionbeconsideredconducivetoachievingresolution.

3.2Employeegrievanceprocedures

3.2.1GrievancesinrelationtotheindividualinterestsofanEmployee,willbemanagedaccordingtotherelevantDirectivemadeundertheprovisionsofsection34ofthePublicServiceAct1996existingatthedateofthisAwardandanyamendmentsthereto.

pART4 - employerandEmployees' duties,employmentrelationshipandrelatedarrangements

4.1Contractofemployment

4.1.1EveryEmployeecoveredbythisAwardshall,uponappointment,beadvisedoftheiremploymentstatus. Thisstatusshalleitherbe:

(a)Full-time(asdefined

(b)Part-time(asdefined)

(c)Temporary(asdefined)

(d)Casual(asdefined)

4.2Full-timeemployment

4.2.1Afull-timeEmployeewillbeengagedeitheronapermanentortemporarybasisforanaverageof38hoursperweekinaccordancewithclause6.1.

4.3Part-timeemployment

4.3.1APart-timeEmployeewillbeengagedeitheronapermanentortemporarybasiswithordinaryhoursoflessthan38hoursperweek.

4.3.2Part-timeemploymentshallbeavailabletoallEmployees,subjecttooperationalrequirementsandDepartmentalapproval.

4.3.3ThefollowingconditionsshallbeapplicabletoapprovedPart-timework:

(a)TheworkcycleofaPart-timeEmployeeshallbedeterminedbytheDepartmentinconsultationwiththeEmployee. TheDepartmentshallberequiredtoconsideroperationalrequirementsandthespecificneedsoftheEmployeeindeterminingtherelevantworkcycle.

(b)ThespreadofordinaryhoursforaPart-timeEmployeeshallbethesameasthoseprescribedforaFull-timeEmployeeunderthisAward.

(c)Theagreednumberofordinaryhoursperworkcycleortheagreedpatternofworkmaybeamendedbymutualagreement. Anyagreedalterationtothenumberofordinaryhoursworkedorthepatternofworkwillberecordedinwriting.

(d)WheremutualagreementisreachedonamendmentofthepatternofworkortheagreedordinaryhoursworkedbythePart-timeEmployee,andwheresuchhoursareinadditiontothenumberofhoursspecifiedtobeworkedintheworkcycle,aPart-timeEmployeeshallbeentitledtopaymentattheordinaryhourlyrate. Theadditionalhourssoworkedshallbetakenintoaccountintheproratacalculationofallentitlements.

(e)WherechangestothehoursofworkorpatternofworkcannotbemutuallyagreedandtheDepartmentdirectsthePart-timeEmployeetoworkadditionalhoursorchangestheagreedpatternofwork,theEmployeeshallbeeligibleforpaymentofovertimeinaccordancewithclause6.8.

(f)ThehourlyrateofpayforaPart-timeEmployeeshallbethesameasthatforaFull-timeEmployeeappointedto,ordirectedtoassumeduty,atthesameClassificationLevel.

(g)ThepublicholidayprovisionsoftheAwardshallapply,providedthatpaymentshallonlybemadeforhoursactuallyworked:

ProvidedfurtherthataPart-timeEmployeewhousuallyworksonadayoftheweekonwhichapublicholidayfalls,andwhoisnotrequiredtoworkonthatday,shallbepaidfortheordinaryhourswhichtheEmployeewouldnormallyhaveworkedifthatdayhadnotbeenapublicholiday.

(h)SalaryIncrementsshallbepayabletoPart-timeEmployeesinaccordancewithclause5.7.

(i)APart-timeEmployeeshallbeentitledtoanyapplicableallowancesonaproratabasis,providedthatthefollowingallowancesshallapplyinfull:

(i)Travellingallowance;

(ii)On-callallowance;

(iii)Mealallowance;

(iv)DogHandler'sallowance;

(v)Localityallowance.

4.3.4APart-timeEmployeemaybeappointedtomorethanonepositionprovidedthatthemaximumnumberofordinaryhoursforwhichtheyareemployedbytheDepartmentshallbelessthan38perweek.

4.3.5Subjecttoclause4.3,allprovisionsofthisAwardapplicabletoFull-timeEmployeesshallapplytoPart-timeEmployeesonaproratabasis.

4.3.6WhereanEmployeeandtheemployeragree,part-timeemploymentmaybeconvertedtofulltimeandvice-versaonapermanentbasisorforaspecifiedperiodoftime. IfsuchanEmployeetransfersfromFulltimetoPart-time(orvice-versa),allaccruedawardandlegislativeentitlementsshallbemaintained. Followingtransfertopart-timeemployment,accrualwilloccurinaccordancewiththeprovisionsrelevanttopart-timeemployment.

4.4temporaryemployment

4.4.1ATemporaryEmployeemaybeengagedeitheronafull-timeorpart-timebasisonlyforthepurposeofmeetingtemporarycircumstances.

4.4.2AllTemporaryEmployeesaretobeprovidedwithanappointmentletter,within2weeksofthecommencementofwork,identifyingtheanticipateddurationoftheengagement,thespecifiedtask,detailsofthedutiestobeundertakenduringthecourseoftheengagementandthecircumstancesinwhichtheengagementcanbeterminatedbyeitherparty.

4.4.3ATemporaryEmployeeshallbeengagedforaperiodof12monthsorlessinanyoneengagement.

4.5Casualemployment

4.5.1AnEmployeemaybeemployedonacasualbasisinanyclassificationofthisAwardprovidedthat:

(a)ACasualEmployeewillbepaidonanhourlybasis. CasualEmployeesshallnotworkmorethan64hoursinany14dayperiod.

(b)Eachengagementwillstandalone,withaminimumpaymentof2hoursinrespecttoeachengagement.

(c)TheordinarytimehourlyrateforaCasualEmployeeshallbetheappropriateweeklyratefortheclassofworkperformeddividedby38plusacasualloadingof23%forallordinarytimeworked.

(d)Whereapplicable,aCasualEmployeeshallbeentitledtotheprovisionsofovertime,weekendpenaltyratesandpaymentforworkperformedonpublicholidays.

(e)ACasualEmployeeshallbeentitledtopaymentofanyapplicableallowance,(excludinglocalityallowance),basedprorataonthenumberofhoursworkedinrelationtotheordinaryhoursoftheawardclassification.

(f)Notwithstandingtheregularityofweeks,daysorhourspreviouslyworked,aCasualEmployeeistohavetheright,withoutprejudice,torefuseworkofferedbytheDepartmentandtheDepartmenttherightnottoofferwork.

(g)SubjecttotherelevantprovisionsoftheActandexceptinaccordancewithclause4.5,aCasualEmployeeshallnotbeentitledtoanyotherAwardprovision.

(h)CasualEmployeesareentitledtoIncrementsinaccordancewithclause5.7ofthisAward.

4.6Conditionsofappointmentonprobationaryservice

4.6.1TheconditionsofappointmentofEmployeesonprobationaryservicecoveredbythisAward,shallbethoseprescribedinsection73ofthePublicServiceAct1996andsections5to7ofthePublicServiceRegulation1997existingatthedateofthisAwardandanyamendmentsthereto.

4.7Recognitionofpreviousservice

4.7.1TheconditionsprescribedintherelevantDirectivemadeundertheprovisionsofsection34ofthePublicServiceAct1996existingatthedateofthisAwardandanyamendmentstheretoapplytoEmployeescoveredbythisAward.

4.7.2ProvidedthatEmployeeswhohavebeenemployedinatemporarycapacityandaresubsequentlyappointedonprobation,shallhavesuchtemporaryservicecountedtowardtheirprobationaryperiodifsuchservicewasperformedwithinthe6monthsprecedingtheappointmentasaprobationer.

4.8Performanceofhigherduties

4.8.1ExtraremunerationfortheperformanceofhigherdutiesshallbepayableinaccordancewiththerelevantDirectivemadeundertheprovisionsofsection34ofthePublicServiceAct1996existingatthedateofthisAwardandanyamendmentsthereto.

4.8.2Withrespecttostaffrosteredtowork12hourshifts,theminimumqualifyingperiodtoreceiveahigherdutiesallowanceshallbemorethan2consecutive12hourshiftswheretherelevantpercentageofworkperformedis100%.

4.9Incidentalandperipheraltasks

4.9.1TheDepartmentmaydirectanEmployeetocarryoutsuchdutiesasarereasonablywithinthelimitsoftheEmployee'sskillandcompetenceandtraining,providedthatsuchdutiesarenotdesignedtopromotede-skilling.

4.9.2TheDepartmentmaydirectanEmployeetocarryoutsuchdutiesandusesuchtoolsandequipmentasmayberequired:

ProvidedthattheEmployeehasbeenproperlytrainedintheuseofsuchtoolsandequipment(whererelevant).

4.9.3AdirectionissuedbytheDepartmentpursuanttoclauses4.9.1and4.9.2shallbeconsistentwiththeDepartment'sresponsibilitiestoprovideasafeandhealthyworkingenvironment.

4.10Terminationofemployment

4.10.1Statementofemployment

(a)TheDepartmentshall,intheeventofterminationofemployment,provideuponrequesttotheEmployeewhohasbeenterminatedawrittenstatementspecifyingtheperiodofemploymentandtheclassificationortypeofworkperformedbytheEmployee.

4.10.2Terminationbyemployer

(a)TheemployermaydismissanEmployeeonlyiftheEmployeehasbeengiventhefollowingnotice:

(b)Inadditiontothenoticeinclause4.10.2(a),Employees45yearsoldoroverandwhohavecompletedatleast2years' continuousservicewiththeemployershallbeentitledtoanadditionalweek'snotice.

(c)Paymentinlieuofnoticeshallbemadeiftheappropriatenoticeisnotgivenprovidedthatemploymentmaybeterminatedbypartoftheperiodofnoticespecifiedandpartpaymentinlieuthereof.

(d)IncalculatinganypaymentinlieuofnoticetheminimumcompensationpayabletoanEmployeewillbeatleastthetotaloftheamountstheemployerwouldhavebeenliabletopaytheEmployeeiftheEmployee'semploymenthadcontinueduntiltheendoftherequirednoticeperiod. Thetotalmustbeworkedoutonthebasisof:

(i)theordinaryworkinghourstobeworkedbytheEmployee;and

(ii)theamountspayabletotheEmployeeforthehoursincludingforexampleallowances,loadingsandpenalties;and

(iii)anyotheramountspayableundertheEmployee'semploymentcontract.

(e)Theperiodofnoticeinthisclauseshallnotapplyinthecaseofdismissalformisconductorothergroundsthatjustifyinstantdismissal,orinthecaseofaCasualEmployee,oranEmployeeengagedbythehourorday,oranEmployeeengagedforaspecificperiodortasks.

4.10.3NoticeofterminationbyEmployee

(a)AnEmployeeshallgiveaminimumof2weeksnoticetotheDepartmentontheterminationofservice.

(b)TheDepartmentmaywaivetherequirementtoprovide2weeks' noticeoranypartthereof.

(c)Failuretogivetherequirednoticeentitles:

(i)TheDepartmenttoconsiderwithholdingpaymentofequivalentvalueiftheEmployeefailstoworktherequirednoticeperiod.

(ii)TheEmployeetopayforanyperiodofnoticetheDepartmentdoesnotwishtheEmployeetoserve.

4.10.4Annualleaveshallnotbeusedtoprovidethenoticeperiodsinclause4.10otherthanbymutualagreementbetweentheDepartmentandtheEmployee. Agreementwillnotbeunreasonablywithheld.

4.10.5Timeoffduringnoticeperiod

Duringtheperiodofnoticeofterminationgivenbytheemployer,anEmployeeshallbealloweduptooneday'stimeoffwithoutlossofpayforthepurposeofseekingotheremployment. ThistimeoffshallbetakenattimesthatareconvenienttotheEmployeeafterconsultationwiththeemployer.

4.11Introductionofchanges

4.11.1Employer'sdutytonotify

(a)Wheretheemployerdecidestointroducechangesinproduction,program,organisation,structureortechnology,thatarelikelytohavesignificanteffectsonEmployees,theemployershallnotifytheEmployeeswhomaybeaffectedbytheproposedchangesand,whererelevant,theirunionorunions.

(b)"Significanteffects" includesterminationofemployment,majorchangesinthecomposition,operationorsizeoftheemployer'sworkforceorintheskillsrequired;theeliminationordiminutionofjobopportunitiesorjobtenure;thealterationofhoursofwork;theneedforretrainingortransferofEmployeestootherworkorlocationsandtherestructuringofjobs:

ProvidedthatwheretheAwardmakesprovisionforalterationofanyofthemattersreferredtohereinanalterationshallbedeemednottohavesignificanteffect.

4.11.2Employer'sdutytoconsultoverchange

(a)TheemployershallconsulttheEmployeesaffectedand,whererelevant,theirunionorunionsabouttheintroductionofthechanges,theeffectsthechangesarelikelytohaveonEmployees(includingthenumberandcategoriesofEmployeeslikelytobedismissed,andthetimewhen,ortheperiodoverwhich,theemployerintendstocarryoutthedismissals),andthewaystoavoidorminimisetheeffectsofthechanges(e.g.byfindingalternateemployment).

(b)Theconsultationmustoccurassoonaspracticableaftermakingthedecisionreferredtoinclause4.11.1.

(c)ForthepurposeofsuchconsultationtheemployershallprovideinwritingtotheEmployeesconcernedand,whererelevant,theirunionorunions,allrelevantinformationaboutthechangesincludingthenatureofthechangesproposed,theexpectedeffectsofthechangesonEmployees,andanyothermatterslikelytoaffectEmployees:

Providedthatanemployershallnotberequiredtodiscloseconfidentialinformation,thedisclosureofwhichwouldbeadversetotheemployer'sinterests.

4.12Redundancy

4.12.1Consultationbeforeterminations

(a)WheretheemployerdecidesthattheemployernolongerwishesthejobtheEmployeehasbeendoingtobedonebyanyone,andthisisnotduetotheordinaryandcustomaryturnoveroflabour,andthatdecisionmayleadtoterminationofemployment,theemployershallconsulttheEmployeedirectlyaffectedandwhererelevant,theirunionorunions.

(b)Theconsultationshalltakeplaceassoonasitispracticableaftertheemployerhasmadeadecision,whichwillinvoketheprovisionsofclause4.12.1(a)andshallcoverthereasonsfortheproposedterminations,measurestoavoidorminimisetheterminationsand/ortheiradverseaffectsontheEmployeesconcerned.

(c)Forthepurposeoftheconsultationtheemployershall,assoonaspracticable,provideinwritingtotheEmployeesconcernedand,whererelevant,theirunionorunions,allrelevantinformationabouttheproposedterminationsincludingthereasonsfortheproposedterminations,thenumberandcategoriesofEmployeeslikelytobeaffected,thenumberofworkersnormallyemployedandtheperiodoverwhichtheterminationsarelikelytobecarriedout:

Providedthatanemployershallnotberequiredtodiscloseconfidentialinformation,thedisclosureofwhichwouldbeadversetotheemployer'sinterests.

4.12.2Transfertolowerpaidduties

(a)WhereanEmployeeistransferredtolowerpaiddutiesforreasonssetoutclause4.12.1theEmployeeshallbeentitledtothesameperiodofnoticeoftransferastheEmployeewouldhavebeenentitledtoiftheEmployee'semploymenthadbeenterminatedunderclause4.10.

(b)Theemployermay,attheemployer'soption,makepaymentinlieuthereofofanamountequaltothedifferencebetweentheformeramountstheemployerwouldhavebeenliabletopayandthenewloweramounttheemployerisliabletopaytheEmployeeforthenumberofweeksofnoticestillowing.

(c)Theamountsmustbeworkedoutonthebasisof:

(i)theordinaryworkinghourstobeworkedbytheEmployee;and

(ii)theamountspayabletotheEmployeeforthehoursincludingforexample,allowances,loadingsandpenalties;and

(iii)anyotheramountspayableundertheEmployee'semploymentcontract.

4.12.3Transmissionofbusiness

(a)Whereabusinessis,whetherbeforeorafterthedateofinsertionofthisclauseintheAwardtransmittedfromtheemployer(transmittor)toanotheremployer(transmittee),andanEmployeewhoatthetimeofsuchtransmissionwasanEmployeeofthetransmittorofthebusiness,becomesanEmployeeofthetransmittee:

(i)thecontinuityoftheemploymentoftheEmployeeshallbedeemednottohavebeenbrokenbyreasonofsuchtransmission;and

(ii)theperiodofemploymentwhichtheEmployeehashadwiththetransmittororanypriortransmittorshallbedeemedtobeserviceoftheEmployeewiththetransmittee.

(b)Inclause4.12.3, "business" includestrade,process,businessoroccupationandincludesapartorsubsidiary(whichmeansacorporationthatwouldbetakentobeasubsidiaryundertheCorporationsLaw,whetherornottheCorporationsLawappliesintheparticularcase)ofanysuchbusinessand "transmission" includestransfer,conveyance,assignmentorsuccessionwhetherbyagreementorbyoperationoflawand "transmitted" hasacorrespondingmeaning.

4.12.4Timeoffduringnoticeperiod

(a)WhereadecisionhasbeenmadetoterminateanEmployeeinthecircumstancesoutlinedinclause4.12.1,theEmployeeshallbealloweduptooneday'stimeoffwithoutlossofpayduringeachweekofnoticeforthepurposeofseekingotheremployment.

(b)IftheEmployeehasbeenallowedpaidleaveformorethanonedayduringthenoticeperiodforthepurposeofseekingotheremployment,theEmployeeshall,attherequestoftheemployer,berequiredtoproduceproofofattendanceataninterviewortheEmployeeshallnotreceivepaymentforthetimeabsent. Forthispurposeastatutorydeclarationwillbesufficient.

4.12.5NoticetoCentrelink

WhereadecisionhasbeenmadetoterminateEmployeesinthecircumstancesoutlinedinclause4.12.1,theemployershallnotifyCentrelinkassoonaspossiblegivingallrelevantinformationabouttheproposedterminations,includingawrittenstatementofthereasonsfortheterminations,thenumberandcategoriesoftheEmployeeslikelytobeaffected,thenumberofworkersnormallyemployedandtheperiodoverwhichtheterminationsareintendedtobecarriedout.

4.12.6Severancepay

(a)Inadditiontotheperiodofnoticeprescribedforordinaryterminationinclause4.10.2(a),andsubjecttofurtherorderoftheCommission,anEmployeewhoseemploymentisterminatedforreasonssetoutinclause4.12.1(a),shallbeentitledtothefollowingamountsofseverancepay:

4.12.7Superannuationbenefits

TheemployermaymakeanapplicationtotheCommissionforrelieffromtheobligationtomakeseverancepaymentsincircumstanceswhere:

(a)theemployerhascontributedtoasuperannuationschemewhichprovidesaparticularbenefittoanEmployeeinaredundancysituation;and

(b)theparticularbenefittotheEmployeeisoverandaboveanybenefittheEmployeemightobtainfromanylegislativeschemeprovidingforsuperannuationbenefits(currentlythefederalSuperannuationGuaranteelevy)oranawardbasedsuperannuationscheme.

4.12.8Employeeleavingduringnotice

AnEmployeewhoseemploymentisterminatedforreasonssetoutinclause4.12.1(a),mayterminatesuchemploymentduringtheperiodofnotice,and,ifso,shallbeentitledtothesamebenefitsandpaymentsunderthisclausehadsuchEmployeeremainedwiththeemployeruntiltheexpiryofsuchnotice:

ProvidedthatinsuchcircumstancestheEmployeeshallnotbeentitledtopaymentinlieuofnotice.

4.12.9Alternativeemployment

Theemployer,inaparticularcase,maymakeapplicationtotheCommissiontohavethegeneralseverancepayprescriptionamendediftheemployerobtainsacceptablealternativeemploymentforanEmployee.

4.12.10Employeeswithlessthanoneyear'sservice

Clause4.12(Redundancy)shallnotapplytoEmployeeswithlessthanoneyear'scontinuousserviceandthegeneralobligationonemployersshouldbenomorethantogiverelevantEmployeesanindicationoftheimpendingredundancyatthefirstreasonableopportunity,andtotakesuchstepsasmaybereasonabletofacilitatetheobtainingbytheEmployeesofsuitablealternativeemployment.

4.12.11Employeesexempted

Clause4.12shallnotapply:

(a)whereemploymentisterminatedasaconsequenceofmisconductonthepartoftheEmployee;or

(b)toEmployeesengagedforaspecificperiodortask(s);or

(c)toCasualEmployees

4.12.12Employersexempted

(a)SubjecttoanorderoftheCommission,inaparticularredundancycase,clause4.12shallnotapplytoanemployerincludingacompanyorcompaniesthatemployEmployeesworkingatotaloffewerthan550hoursonaverageperweek,excludingovertime,MondaytoSunday.The550hoursshallbeaveragedovertheprevious12months.

(b)A "company" shallbedefinedas:

(i)acompanyandtheentitiesitcontrols;or

(ii)acompanyanditsrelatedcompanyorrelatedcompanies;or

(iii)acompanywherethecompanyorcompanieshasacommonDirectororcommonDirectorsorcommonshareholderswithanothercompanyorcompanies

4.12.13Exemptionwheretransmissionofbusiness

(a)Theprovisionsofclause4.12.6arenotapplicablewhereabusinessisbeforeorafterthedateoftheinsertionofthisclauseintotheAward,transmittedfromtheemployer(transmittor)toanotheremployer(transmittee),inanyofthefollowingcircumstances:

(i)wheretheEmployeeacceptsemploymentwiththetransmitteewhichrecognisestheperiodofcontinuousservicewhichtheEmployeehadwiththetransmittor,andanypriortransmittor,tobecontinuousserviceoftheEmployeewiththetransmittee;or

(ii)wheretheEmployeerejectsanofferofemploymentwiththetransmittee:

(A)inwhichthetermsandconditionsaresubstantiallysimilarandnolessfavourable,consideredonanoverallbasis,thanthetermsandconditionsapplicabletotheEmployeeatthetimeofceasingemploymentwiththetransmittor;and

(B)whichrecognisestheperiodofcontinuousservicewhichtheEmployeehadwiththetransmittorandanypriortransmittortobecontinuousserviceoftheEmployeewiththetransmittee.

(b)TheCommissionmayamendclause4.12.13(a)(ii)ifitissatisfiedthatitwouldoperateunfairlyinaparticularcase,orintheinstanceofcontrivedarrangements.

4.12.14Incapacitytopay

TheemployerinaparticularredundancycasemaymakeapplicationtotheCommissiontohavethegeneralseverancepayprescriptionamendedonthebasisoftheemployer'sincapacitytopay.

4.12.15EmployeesofQueenslandGovernmentDepartmentsandAgencies

Theprovisionsofclause4.12willnotapplytoEmployeesofQueenslandgovernmentdepartmentsandagenciestotheextentthattheprovisionsoftheredundancyarrangementsarecontainedinaDirectiveissuedbythePublicServiceCommissionerortheMinisterforIndustrialRelationspursuanttosection34ofthePublicServiceAct1996,wheretheDirectiveprovidesforentitlementsthataresuperiortoclause4.12.

4.13Anti-discrimination

4.13.1ItistheintentionofthepartiestothisAwardtopreventandeliminatediscrimination(asdefinedbytheAnti-DiscriminationAct1991andtheIndustrialRelationsAct1999asamendedfromtimetotime)whichincludes:

(a)Discriminationonthebasisofsex,maritalstatus,familyresponsibilities,pregnancy,parentalstatus,age,race,impairment,religion,politicalbelieforactivity,tradeunionactivity,lawfulsexualactivityandassociationwith,orinrelationto,apersonidentifiedonthebasisoftheaboveattributes.

(b)sexualharassment;and

(c)racialandreligiousvilification.

4.13.2Accordinglyinfulfillingtheirobligationsunderthedisputesavoidanceandgrievancesettlingclauses,thepartiestotheAwardmusttakereasonablestepstoensurethatneithertheAwardprovisionsnortheiroperationaredirectlyorindirectlydiscriminatoryintheireffects.

4.13.3UndertheAnti-DiscriminationAct1991itisunlawfultovictimiseanEmployeebecausetheEmployeehasmadeormaymakeorhasbeeninvolvedinacomplaintofunlawfuldiscriminationorharassment.

4.13.4Nothinginclause4.13istobetakentoaffect:

(a)anydifferenttreatment(ortreatmenthavingdifferentoutcomes)whichisspecificallyexemptedundertheAnti-DiscriminationAct1991;

(b)anEmployee,Departmentorregisteredorganisation,pursuingmattersofdiscrimination,includingbyapplicationtotheHumanRightsandEqualOpportunityCommission/Anti-DiscriminationCommissionQueensland.

PART5 - WAGESANDWAGERELATEDMATTERS

5.1Queenslandminimumwage

5.1.1NoEmployeeshallbepaidlessthantheQueenslandMinimumWage.

5.1.2AmountofQueenslandadultminimumwage

(a)TheQueenslandMinimumWageforfull-timeadultEmployeesnotcoveredby5.1.4is$484.40perweek.

(b)AdultsemployedundertheSupportedWageAward - State2002shallcontinuetobeentitledtoreceivethewageratesdeterminedunderthataward: ProvidedthatsuchEmployeesshallnotbepaidlessthantheamountdeterminedbyapplyingthepercentageintheSupportedWageAward - State2002applicabletotheEmployeeconcernedtotheamountoftheminimumwagespecifiedinclause5.1.2(a).

(c)AdultsemployedasPart-timeorCasualEmployeesshallcontinuetoreceivethewageratesdeterminedunderthecasualandPart-timeclausesoftheAward:

(b)TheQueenslandMinimumWageforanEmployeetowhomajuniorwageratesclauseappliesisdeterminedbyapplyingthepercentageinthejuniorwagerateclauseapplicabletotheEmployeeconcernedtotherelevantamountinclause5.1.2.

5.1.4ApplicationofQueenslandminimumwagetospecialcategoriesofEmployees

(a)Clause5.1hasnoapplicationtoatraineeorapprenticewhoispartytoatrainingagreementregisteredundertheTrainingandEmploymentAct2000.

5.1.5ApplicationforQueenslandminimumwagetoawardratescalculation

(a)TheQueenslandMinimumWage:

IncreasesmadeunderpreviousStateWagePrinciplesorunderthecurrentStatementofPolicy,exceptingthoseresultingfromenterpriseagreements,arenottobeusedtooffsetarbitratedwageadjustments.

5.2Salaries

5.2.1SalariesshallbepaidfortnightlyandmayatthediscretionoftheDepartmentbepaidbyelectronicfundstransfer.

5.2.2Subjecttoclauses5.1and5.2.3thesalariespayabletoEmployeescoveredbythisAwardshallbeasprescribedinSchedule1ofthisAward.

5.2.3WORCProgram

NotwithstandinganythinginthisAward,thesalariesandconditionsofemploymentcontainedinthe "EmploymentConditionsApplicabletoCertainPositionswiththeDepartment'sWorkOutreachCampsProgram(WORCProgram)" shallapply.

5.3Genericlevelstatements

5.3.1GenericLevelStatementsforallClassificationLevelsshallbedevelopedtothedegreeofcomplexityandresponsibilityofofficersallocatedtoClassificationLevels.

5.4Workallocation

5.4.1AnEmployeehavingeitherbeenappointedorrelievinginanofficewithinaClassificationLevelmaybeallocatedandsubsequentlyreallocatedtoanyofficewithinthatparticularClassificationLevel:

ProvidedthatprogramsandcustodialstaffwithinaCorrectionalCentremayberequiredtofunctioninmultidisciplinaryteamsinvolvingprogramsandcustodialstaff. ProgramsstaffwillnotbedirectedtoperformthestaticsecuritydutiesofCustodialCorrectionalOfficers. ExistingCorrectionalOfficerswillnotbedirectedtoperformthedutiesofprogramsstaff:

5.7MovementwithinClassificationLevels

5.7.1IncrementalprogressionwithinClassificationLevelswilloccuronlywhentheconduct,diligenceandgeneralefficiencyofsuchEmployeehasbeencertifiedbytheDepartmenttohavebeenandtobesatisfactory.

5.7.2IfanyIncrementprescribedbythisAwardistemporarilywithheldfromanEmployeeorthereisarefusaltograntanIncrementtheEmployeemaymakeanappealtothePublicServiceCommissionerundertherelevantPublicServiceDirective.

5.7.3Exceptinthecaseofapromotion,ortransferandpromotionfromoneClassificationLeveltoanother,anincreaseisnottobemadetothesalaryofanyEmployeeuntil:

(a)inthecaseofafull-timeEmployeetheEmployeehasreceivedasalaryataparticularclassificationandPaypointforaperiodof12months.

(b)inthecaseofaPart-timeEmployee:

(i)theEmployeehasreceivedasalaryataparticularclassificationandPaypointforaperiodofatleast12months;and

(ii)theEmployeehasworked1,200ordinaryhoursinsuchclassification.

(c)inthecaseofaCasualEmployeewith12monthscontinuousservicewiththesameemployer:

(i)theEmployeehasreceivedasalaryataparticularclassificationandPaypointforaperiodofatleast12months;and

(ii)theEmployeehasworked1,200ordinaryhoursinsuchclassification.

(d)Forthepurposeofclause5.7.3,continuousserviceforaCasualEmployeeendsiftheemploymentisbrokenbymorethan3monthsbetweentheendofoneemploymentcontractandthestartofthenextemploymentcontract. Absencesfromworkonpublicholidaysdonotbreak,orcontributetoabreak,inthecontinuityofservice.

5.7.4Inadditiontoclause5.7.3,anEmployeeintheCorrectionsStream,otherthananEmployeeappointedasaTradeInstructororFarmOfficer,willberestrictedinmovementbeyondPaypoint2ofClassificationLevel1untiltheCertificateIIIinCorrectionalPracticeisobtained. MovementbeyondPaypoint4ofClassificationLevel1willberestrictedtoEmployeeswhopossessaCertificateIVinCorrectionalPractice. MovementbeyondPaypoint7ofClassificationLevel1willberestrictedtoEmployeeswhopossessaDiplomainCorrectionalAdministration.

5.8.3Doghandlersallowance

(a)WhereaDepartmentaldogiskennelledatthehomeofanEmployeeengagedtoperformthedutiesofadoghandlerandtheEmployeeisdeemedtoberesponsibleforthecareandmaintenanceofaDepartmentaldogduringhoursrosteredoffduty,thatEmployeeshallbepaidanallowanceof$200.80percalendarfortnight. Thisallowancemustbepaidduringallleave.

(b)Allfood,equipmentandassociatedcostsneededtoproperlycareforandmaintainthedogwillbepaidforbytheDepartment.

(c)Therateprescribedinclause5.8.3(a)hasadirectnexustothePoliceServiceAward - State2003andwillbeupdatedaccordingly.

5.8.4Oncallarrangements

(a)WhereanEmployeeisinstructedtobeavailableoncalloutsideordinaryorrosteredworkinghours,suchEmployeeshallbepaid,inadditiontotheirordinaryrateofpayanallowancebaseduponthehourlyrateoftheclassificationofCO1-7inaccordancewiththefollowingscale.

(i)WheretheEmployeeisoncallthroughoutthewholeofarostereddayofforapublicholiday - 95%ofthehourlyrateinrespectofsuchinstances;

(ii)WhereanEmployeeisoncallduringthenightonlyofarostereddayoff,anaccrueddayofforpublicholiday - 60%ofthehourlyratepernight;and

(iii)WhereanEmployeeisoncallonanyothernight - 47.5%ofthehourlyratepernight.

(b)Forthepurposeofcalculatingthehourlyrate,thedivisorshallbebasedupona38hourweekandcalculatedtothenearest5cents.

(c)Forthepurposeofclause5.8.4(a)(iii),a "night" shallbedeemedtoconsistofthosehoursfallingbetween5.00p.m.and8.00a.m.ormainlybetweensuchhours.

(d)MondaytoFriday - intheeventofanEmployeeoncallbeingrecalledtoperformduty,suchEmployeeshallbepaidforthetimeworkedattheprescribedovertimerate,suchtimetobecalculatedasfromhomeandbacktohomewithaminimumpaymentof2hours.

(e)Saturday,Sundayandpublicholidays - anEmployeeperformingovertimeworkonrecallonSaturday,Sundayorapublicholidaymaybepaidforsuchovertimeattheappropriateovertimeratewithaminimumof2hoursinclusiveoftravellingtime,inrespectofovertimeworkedonaSaturdayorSundayand4hoursinrespectofovertimeworkedonapublicholiday,orattheEmployee'soptionbegrantedtimeoffatamutuallyconvenienttime,equivalenttothenumberofhoursworked. Suchtimetobecalculatedasfromhomeandbacktohome:

(i)ProvidedthatanEmployeewhoworksovertimeonapublicholidayandwhoisgrantedequivalenttimeoffshallbepaidathalftheordinaryrateforthetimesoworkedwithaminimumof4hours:

(ii)ProvidedfurtherthataccruedtimeoffinlieushallbetakeninperiodsmutuallyagreedbetweentheDirector-GeneralandtheEmployee.

(f)IntheeventofanEmployeeoncallbeingrequestedbytheDirector-Generalortheauthoriseddelegate,toprovideadvice(withouttheneedtoreturntothefacility),theEmployeeshallbepaidattheprescribedovertimeratefortheactualtimeworkeduptoamaximumof2hoursonanyoneday.

(i)ProvidedthattheEmployeewillberesponsiblefortherecordingofsuchrequestswhichwillrequiresubsequentverificationbytheDirector-General.

(g)Anyovertimepayableshallbeinadditiontotheoncallallowance.

(h)WhereanEmployeeisrecalledtoperformworkduringanoffdutyperiodsuchEmployeeshallbeprovidedwithtransporttoandfromtheEmployee'shome,orberefundedthecostofsuchtransport.

(i)WherepracticabletheDirector-GeneralshallnotrequireanEmployeetobecontinuouslyavailableoncallforaperiodinexcessof6weeks:

(ii)Theprovisionsofclause6.10shallapplywhenanEmployeehasactuallyworkedinexcessof2hoursinclusiveoftravellingtimeononeormoreofsuchrecalls.

PART6 - HOURSOFWORK,BREAKS,OVERTIME,SHIFTWORK,WEEKENDWORK

6.1Hoursofwork

6.1.1Theordinaryhoursofworkforfull-timeEmployeesshallbeinclusiveofmealtimesandshallbe160hourspermonthwithinaworkcyclenotexceeding28consecutivedaystobeworkedinshiftsofbetween4and12hours. Unlessotherwiseagreed,thedurationofashiftshallbe8hours. ByagreementofthemajorityofEmployeesdirectlyaffected,shiftsmayconsistofperiodsofbetween4and12hours.

6.1.2AnyEmployeemayberequiredtoworksuchreasonabletimeinexcessofordinaryhoursastheDepartmentshallconsiderdesirable. Paymentforsuchworkshallbeinaccordancewithclause6.8.

6.1.3Notwithstandingtheprovisionsofclause6.1.2,anEmployeeshallnotperformmorethan16hoursofconsecutivedutyinclusiveofovertimeexceptinthecaseofemergencycircumstances.

6.2Rosters

6.2.1Subjecttotheprovisionsofclause6.1,shiftworkersordinaryhoursshallbeworkedinaccordancewitharosterestablishedbytheDepartmentinconsultationwiththeQPSU.

6.2.2New/flexibleshiftarrangementscanonlybeimplementedbyagreementofthemajorityofEmployeesdirectlyaffected,neitherpartyshouldunreasonablywithholdagreement. Agreementisdefinedasobtainingwrittenconsentofgreaterthan50%ofEmployeesdirectlyaffectedasdeterminedbyasecretballot. AnyagreementreachedmustbedocumentedandacopyoftheagreementshallbeforwardedtotheQPSU. SubjecttotheDisputeSettlementprocedureprescribedinthisAward,intheabsenceofagreementeitherpartymayhaverecoursetoarbitration.

6.2.3TheDepartmentalGuidelinesforRosteringandShiftWorkarenowincludedaspartoftheDepartmentofCorrectiveServices - CorrectionalEmployees' Determination2004.

6.2.4BrokenDutywillonlybeworkedfollowingmutualagreementbetweentheDepartmentandEmployee(s)andconsultationwiththeQPSU.

6.3Mealbreaks

6.3.1AllEmployees,shallbealloweda30minutemealbreakatanoperationallyconvenienttimetobecompletedbetweenthe3rdand6thhoursofduty.

6.3.2Whereashiftisof6hoursorlessamealbreakwillnotbeprovided.

6.3.3Whereashiftexceeds10hours,anadditionalmealbreakof30minutesshallbeallowedatanoperationallyconvenienttime.

6.3.4WherepracticableEmployeesshallbeprovidedwithamealrelief,providedthatwhereashiftexceeds10hoursindurationmealreliefshallbeprovidedforaminimumofonemealbreak.

6.3.5Thehoursofdutyofshiftworkerswillbeinclusiveofmealbreaksandwillbetakensoasnottointerferewithoperationalrequirements.

6.3.6Wherereliefisprovided,the30minutesshallincludewalkingtimeexceptinthecaseofCustodialCorrectionalOfficerswhoshallhaveanuninterruptedmealbreakofatleast30minutes.

6.3.7AllshiftworkEmployeesshallbeprovidedwithamealfreeofcharge.

6.3.8Mealsprovidedtostaffwillbecommontothoseprovidedtoinmates,offendersanddetainees.

6.4Shiftallowance

6.4.1ExceptforthoseEmployeeswhoreceiveanaggregatedshiftallowanceagreedbetweentheDepartmentandtheQPSU,Employeesworkingshiftscommencingonorafter12noonandfinishingafter6.00p.m.andatorbeforemidnightshallbepaidanallowanceof15%pershiftinadditiontotheirordinarysalary.

6.4.2ThisallowanceshallnotapplytoworkperformedbetweenmidnightFridayandmidnightSunday.

6.5Extrapaymentforweekendwork

6.5.1ExceptforthoseEmployeeswhoreceiveanaggregatedshiftallowanceagreedbetweentheDepartmentandtheQPSU,alltimeworkedbetweenmidnightonFridayandmidnightonSaturdaynotbeingovertimeshallbepaidforat1.5timestheordinaryrate. BetweenmidnightSaturdayandmidnightSundaypaymentshallbedoubletheordinaryrate.

6.6Restpauses

6.6.1Employeesshallbeentitledtoapause(s)totalling20minutesperdaytobetakenattheEmployeesdesignateddutystationattimestosuitoperationalrequirementsasdeterminedbytheDepartment.

6.7Restdays

6.7.1Employeesengagedinshiftworkshallbeallowed2wholeconsecutivedaysoffbetweenmidnightandmidnight,ineach7dayperiod.

6.7.2Anattemptshouldbemadetoaverageoutthenumberofweekendsworkedwiththenumberofweekendsnotworkedduringthecycleoftheroster.

6.8Overtime

6.8.1Subjecttoclause6.1,allauthorisedovertimeworkedbyEmployeesshallbepaidforattherateoftimeanda-halfforthefirst3hoursanddoubletimethereafter.

(a)Providedthat,allstaffinreceiptoftheaggregatedshiftallowanceorshiftworkerswhosehoursofworkareregularlyrotatedinaccordancewithashiftrostercovering2ormoreshiftsperday,shallbepaidforovertimeattherateofdoubletime:

(b)Providedfurtherthatforthepurposesofclause6.8timeworkedoutsiderosteredshiftarrangementsshallbepaidasovertime.

6.8.2OvertimeshallbepaidonanEmployee'sbaserate.

6.8.3AllovertimeworkedonaSundayshallbepaidforatdoubletheordinaryrate.

6.8.4Aminimumpaymentof3hoursworkshallapplytoallovertimeworkedonaSaturdayoraSunday.

6.8.5EmployeeswillberequiredtoworkovertimewhenevernecessaryintheopinionoftheDepartment.

6.8.624hours' noticeshallbegiven,wherepracticable,toanEmployeerequiredtoworkovertime.

6.8.7AnEmployeerecalledtoperformdutyaftercompletingordinarydutyshallbepaidatovertimerateswithaminimumpaymentof3hours.

6.8.8AnEmployeetemporarilyfillinganddischargingthefulldutiesofanofficeatahigherClassificationLevelforwhichovertimepaymentsareapplicableshallbepaidforauthorisedovertimeattheminimumrateapplicabletothathigherClassificationLevel.

6.8.9Notwithstandingclause6.8.8,EmployeesremuneratedinaccordancewithClassificationLevel3oftheCorrectionsStreamshallhaveovertimepaymentscalculatedatthemaximumrateofClassificationLevel2oftheCorrectionsStream.

6.9Transportcostsonre-call

6.9.1WhereanEmployeeisrecalledtoperformworkduringanoffdutyperiodsuchEmployeeshallbeprovidedwithtransporttoandfromtheEmployee'shome,orberefundedthecostofsuchtransport.

6.10Fatiguebreak

6.10.1AllEmployeesshallbeentitledtoa10hourbreakbetweentheendofanordinaryrosteredshiftandthebeginningofanotherordinaryrosteredshiftexceptinemergentcircumstanceswheretheminimumwillbe8hours.

6.10.2Wherethetimebetweenanordinaryrosteredshiftandthenextordinaryrosteredshiftislessthan10hoursthenextordinaryrosteredshiftwillbepaidatovertimerates.

6.10.3WhereanEmployeeworksbyrequestanovertimeshiftorpartshiftwhichresultsintherebeinglessthan10hoursfromtheendofthatovertimeshiftandthebeginningofthenextordinaryrosteredshift,thatnextordinaryrosteredshiftwillbepaidatordinaryrates.

6.10.4WhereanEmployeeisdirectedtoworkanovertimeshiftorpartshiftwhichresultsintherebeinglessthan10hoursfromtheendofthatovertimeshiftandthebeginningofthenextordinaryrosteredshift,thenextordinaryrosteredshiftshallbepaidatovertimeratesuntiltheEmployeeisreleasedfromdutyandthenshallbeentitledtobeabsentuntil10consecutivehoursdutyhasoccurredwithoutlossofpayforordinaryworkingtimeoccurredduringsuchabsence.

6.10.5Notwithstandingtheprovisionsinclauses6.10.1,6.10.2,6.10.3and6.10.4,inthecaseofanEmployeerosteredtoperform8hourshifts,8willbesubstitutedfor10hours.

6.11Escapeorescortduty

6.11.1Duringperiodsofescortorescapeduty,adequatesleepingtimeshallbeallowedwhichshallnotcountasworkingtime.

pART7 - leaveofabsenceandpublicholidays

7.1Leave

7.1.1ThefollowingprovisionsasprescribedinDirectivesmadeundertheprovisionsofsection34ofthePublicServiceAct1996existingatthedateofthisAwardoranyamendmentstheretoapplytoEmployeessubjecttothisAward.

7.2.1Inadditiontoclause7.1.1EmployeesengagedonContinuousShiftWorkwhohavecompleted12monthscontinuousserviceshallbeallowedadditionalannualleaveattherateofoneweekperyearinrespectoftheperiodduringwhichsuchshiftshavebeenworkedbytheEmployeeandprovidedfurtherthatnothingintheforegoingprovisionsofclause7.2shallentitleanyEmployeeintheNorthernandWesternpartoftheStatetoannualleaveinexcessof5weeks' leaveineachyear.

7.2.2Notwithstandingclause7.2.1,Employeesinreceiptoftheaggregatedshiftpenaltywillbeentitledtoaccrueannualleaveattherateof190hours(5weeks@38hours)perannum.

7.2.3Providedfurtherthatthetakingofannualleaveshallbesubjecttothefollowingprovisions:

(a)TheDepartmentanditsEmployeesmayagreewhenannualleaveistobetaken.

(b)IfanEmployeeandtheDepartmentcannotagreeastowhenannualleaveistobetaken,theDepartment:

(i)maydecidewhentheEmployeeistotakeleave;and

(ii)istoprovidetheEmployeewithnolessthan14dayswrittennoticeofthestartingdateoftheleave.

(c)AnEmployeeandtheDepartmentmayagreethattheEmployeetakealloranypartoftheEmployee'sannualleavebeforebecomingentitledtoit.

(d)IftheEmployeetakesannualleavebeforebecomingentitledtoit,theEmployeeisonlyentitledattheendofthecompletedyearofemployment,tothebalanceoftheleavethatwouldbedueattheendoftheyear.

7.2.4Loadingonannualleavepayments

(a)AloadingcalculatedasprescribedhereundershallbepaidtoEmployeesonannualleave:

(i)ContinuousShiftWorkers - Subjecttoclause7.2.4(a)(ii),therateofwageorsalarytobepaidtoaContinuousShiftWorkershallbetheratepayableforworkinordinarytimeandafurtheramountcalculatedattherateof27.5%ofthatrate.

(ii)AllEmployees - Subjecttotheprovisionsofclause7.2.4(a)(iii),innocaseshallthepaymenttoanEmployeebelessthanthesumofthefollowingamounts:

(A)TheEmployee'sordinarywagerateorsalaryasprescribedbytheAwardfortheperiodofsuchleave(excludingshiftpremiumsandweekendpenaltyrates);and

(B)Afurtheramountcalculatedattherateof17.5%oftheamountsreferredtoinclause7.2.4(a)(i).

(iii)Theprovisionsofclauses7.2.4(a)(ii)(A)and7.2.4(a)(ii)(B)shallnotapplytoanyperiodorperiodsofleaveexceeding:

(A)5weeksperannuminthecaseofEmployeesemployedonContinuousShiftWork;or

(B)4weeksperannuminanyothercase.

7.3Industrialrelationseducationleave

7.3.1Industrialrelationseducationleaveispaidtimeofftoacquireknowledgeandcompetenciesinindustrialrelations. SuchknowledgeandcompetenciescanallowEmployeestoeffectivelyparticipateinconsultativestructures,performarepresentativeroleandfurthertheeffectiveoperationofgrievanceanddisputesettlementprocedures.

7.3.2Employeesmaybegrantedupto5workingdays(ortheequivalenthours)paidtimeoff(non-cumulative)percalendaryeartoattendindustrialrelationseducationsessions,approvedbytheDirector-General(ordelegatedauthority)oftheDepartment.

7.3.3Additionalleave,overandabove5workingdaysnon-cumulative(ortheequivalenthours)inanyonecalendaryearmaybegrantedwhereapprovedstructuredEmployees' trainingcoursesinvolvemorethan5workingdays(ortheequivalent). SuchleavewillbesubjecttoconsultationbetweentheDirector-General(ordelegatedauthority)oftheDepartment,theQPSUandtheEmployee.

7.3.4UponrequestandsubjecttoapprovalbytheDirector-General(ordelegatedauthority)oftheDepartment,EmployeesmaybegrantedpaidtimeoffinspecialcircumstancestoattendManagementCommitteeMeetings,UnionConferences,andACTUCongress.

7.3.5Thegrantingofindustrialrelationseducationleaveoranyadditionalleaveshouldnotimpactadverselyonservicedelivery,workrequirementsortheeffectivenessandefficiencyoftheDepartment/workunitconcerned. Atthesametimesuchleaveshallnotbeunreasonablyrefused.

7.3.6AtthediscretionoftheDirector-GeneraloftheDepartment/publicsectorunitconcerned,publicsectorEmployeesmaybegrantedspecialleavewithoutpaytoundertakeworkwiththeQPSU

7.4Familyleave

7.4.1TheprovisionsoftheFamilyLeave(QueenslandPublicSector)Award - State2004applytoandaredeemedtoformpartofthisAward.

7.4.2Part-timeworkcanbeperformedbyagreementinthecircumstancesspecifiedintheFamilyLeave(QueenslandPublicSector)Award - State2004.

AllEmployeescoveredbythisAwardshallbeentitledtobepaidafullday'swageforLabourDay(thefirstMondayinMayorotherdayappointedundertheHolidaysAct1983,tobekeptinplaceofthatholiday),irrespectiveofthefactthatnoworkmaybeperformedonsuchday,andifanyEmployeeconcernedactuallyworksonLabourDay,suchEmployeeshallbepaidafullday'swageforthatdayandinaddition,apaymentforthetimeactuallyworkedbytheEmployeeatoneanda-halftimestheordinaryratesprescribedforsuchworkwithaminimumof4hours.

WorkperformedonLabourDayoutsidetheordinarystartingandfinishingtimesshallbepaidforatdoubletheovertimerateprescribedforanordinaryworkingday.

7.5.3Annualshow

AllworkdonebyEmployeesinadistrictspecifiedfromtimetotimebytheMinisterbynotificationpublishedintheIndustrialGazetteonthedayappointedundertheHolidaysAct1983,tobekeptasaholidayinrelationtotheannualagricultural,horticulturalorindustrialshowheldattheprincipalcityortown,asspecifiedinsuchnotification,ofsuchdistrict,shallbepaidforattherateofdoubletimeanda-halfwithaminimumof4hours.

7.5.4Doubletimeanda-half

Forthepurposesofclause7.5,wheretherateofwagesisaweeklyrate, "doubletimeanda-half" meansoneandone-halfday'swagesinadditiontotheprescribedweeklyrate,orprorataifthereismoreorlessthanaday.

7.5.5Timeoffinlieu

AnEmployeewhoperformsworkonanypublicholidayoranydayappointedundertheHolidaysAct1983,tobekeptinplaceofanysuchholiday,shallattheEmployee'soptionreceivetimeoffequivalenttothenumberofhoursworked,withaminimumofhalfaworkingdayinlieuofmonetarycompensation:

ProvidedthatsuchEmployee,whoisgrantedequivalenttimeoffintermsofclause7.5.5,shallbepaidathalftheordinaryrateforthetimesoworkedwithaminimumof4hours.

WhereanEmployeeisentitledtotimeoffinlieuforworkingonapublicholiday,suchtimeoff,attheoptionoftheEmployee,maybeaddedtoannualleaveortakenwithin28daysofthedayonwhichtheEmployeeworked:

Providedthatwhere,inpursuanceclause7.5.5,timeoffistobeaddedtotheannualleaveofanyEmployee,thetimeofftobeallowedshallnotexceed10workingdaysinanyoneyear,or20workingdaysinthecaseofanEmployeewhohaspermittedannualleavetoaccumulatefor2years

7.5.6Substitution

WheremutualagreementexistsbetweentheDepartmentandtheEmployeeconcernedandsubjecttostatutorylimitationsotherordinaryworkingdaysmaybesubstitutedforthepublicholidaysspecifiedinclause7.5:

Providedthat,whereanEmployeeissubsequentlyrequiredtoworkonsuchsubstitutedday,theEmployeeshallbepaidtherateapplicablefortheholidaythathasbeensubstituted.

7.5.7Continuousshiftwork

AnEmployeewhoisengageduponContinuousShiftWorkorwhoworksona2shiftperdaybasisover7dayseachweekisrosteredoffonanypublicholidayshallbepaidanadditionalday'swage,orbyagreementbetweentheDepartmentandtheEmployeeshallbegrantedaday'sholidayinlieuatatimetobemutuallyarrangedbetweentheDepartmentandtheEmployeeconcerned,oranextradayshallbeaddedtotheEmployee'sannualleave,foreachsuchdayonwhichtheEmployeeisrosteredoff:

Providedthatthe "additionaldays' wage", "days' holiday" or "extraday" addedtoannualleavereferredtoinclause7.5.7shallmeantheapplicableordinaryrosteredhours.

PART8 - TRANSFERS,TRAVELLINGANDWORKINGAWAYFROMUSUALPLACEOFWORK

8.1Excesstravellingtime

8.1.1ThegeneralconditionsapplicableforthecompensationofexcesstravellingtimeforaneligibleEmployeewhoisrequiredtotravelonofficialbusinessincluding:

(a)attendingapprovedseminarsandDepartmentalcourses;

(b)outsideordinaryhours;and

(c)awayfromnormalheadquarters.

areprescribedunderDirective7/00ExcessTravellingTime,asissuedandamendedbytheMinisterforIndustrialRelationsundersection34ofthePublicServiceAct1996.

PART9 - TRAININGANDRELATEDMATTERS

9.1Training,learninganddevelopment

9.1.1ThepartiestothisAwardrecognisethatinordertoincreaseefficiencyandproductivityagreatercommitmenttotraining,learninganddevelopment isrequired.

9.1.2Accordingly,thepartiescommitthemselvestodevelopingamorehighlyskilledandflexibleworkforceandprovidingEmployeeswithcareeropportunitiesthroughappropriatetrainingtoacquireadditionalskillsandknowledgeforperformanceoftheirduties.

9.1.3WithintheDepartmentaconsultativemechanismandproceduresinvolvingrepresentativesofmanagement,EmployeesandtheQPSUshallbeestablishedasdeterminedbytheDirector-Generalhavingregardtothesize,structureandneedsoftheDepartment.

9.1.4FollowingconsultationtheDirector-Generalshalldevelopatraining,learninganddevelopmentstrategyconsistentwith:

(a)thecurrentandfutureneedsoftheDepartment;

(b)thesize,structureandnatureoftheoperationsoftheDepartment;

(c)theneedtodevelopvocationalskillsrelevanttotheDepartmentthroughcoursesconductedwhereverpossiblebyaccreditededucationalinstitutionsandproviders.

9.1.5Training,learninganddevelopmentmaybebothon-the-joboroff-the-jobandeitherinternalorexternaltotheorganisation.

9.1.6Training,learninganddevelopmentprovidedshouldassistEmployeesinobtainingknowledgeandskillsrecognisedbytheAustralianNationalTrainingAuthority(ANTA).

9.1.7Allsuchtraining,learninganddevelopmentshouldbedirectedatenablingEmployeestoenhanceskillsrelevanttodutiestobeperformed. Employeeswillbeexpectedtoattendscheduledtraining,learninganddevelopmentactivities.

9.1.8EmployeeswillbeexpectedtoattendcompulsorytraininganddevelopmentactivitiesattheDepartment'scost.

9.1.9Clause9.1shalloperateasaninterimprovisionandshallbesubjecttoreviewafter12monthsoperation.

PART10 - occupationalhealthandsafetymatters,equipment,toolsandamenities

10.1Corporateuniform

10.1.1AcorporateuniformwillberequiredtobewornbyallEmployees. TheuniformwillbeprovidedandreplacedbytheDepartmentonareasonablewearandtearbasis.

10.1.2ThisincludesasuitablecorporateworkattireforcertainoccupationalcategoriessuchasTradeInstructorsandDogHandlers.

10.2Healthandsafety

ThepartiestothisAwardarecommittedtopromotingandsecuringthehealthandsafetyofEmployeesinaccordancewiththerelevantworkplacehealthandsafetylegislationandregulations.

PART11 - awardcomplianceandunionrelatedmatters

11.1Awardposting

AtruecopyofthisAwardandtheFamilyLeave(QueenslandPublicSector)Award - State2004shallbeexhibitedinaconspicuousandconvenientplaceinallrelevantworkplacesandshallbepostedontheDepartment'sintranetsitesoastobeeasilyaccessedbyEmployees.

11.2Unionencouragement

11.2.1ThepartiesrecognisetherightofindividualstojoinaUnionandwillencouragethatmembership. However,itisalsorecognisedthatUnionmembershipremainsatthediscretionofindividuals.

11.2.2AnapplicationforUnionmembershipandinformationontheQPSUwillbeprovidedtoallEmployeesatthepointofengagement.

11.2.3InformationontheQPSUwillbeincludedininductionmaterials.

11.2.4Unionrepresentative(s)willbeprovidedwiththeopportunitytodiscussUnionmembershipwithnewEmployees,providedthatoperationaldisruptionsareminimised.

11.2.5WhererequestedbytheQPSU,theDepartmentwillprovidepayrolldeductionfacilitiesforUnionsubscriptions.

11.3Rightofentry

Preamble

Clauses11.3.1and11.3.2replicatelegislativeprovisionscontainedwithintheAct. Inordertoensurethecurrencyofexistinglegalrequirementspartiesareadvisedtorefertosections366,372and373ofthatActasamendedfromtimetotime.

11.3.1Authorisedindustrialofficer

(a)An "Authorisedindustrialofficer" isanyUnionofficialholdingacurrentauthorityissuedbytheIndustrialRegistrar.

(b)RightofentryislimitedtoworkplaceswheretheworkperformedfallswithintheregisteredcoverageoftheUnion.

11.3.2Entryprocedure

(a)TheAuthorisedindustrialofficerisentitledtoentertheworkplaceduringnormalbusinesshoursaslongas:

(i)theAuthorisedindustrialofficeralertstheDepartmentorotherpersoninchargeoftheworkplacetotheirpresence;and

(ii)showstheirauthorisationuponrequest.

(b)Clause11.3.2(a)doesnotapplyiftheAuthorisedindustrialofficerestablishesthattheemployerorotherpersoninchargeisabsent.

(c)ApersonmustnotobstructorhinderanyAuthorisedindustrialofficerexercisingtheirrightofentry.

(d)IftheAuthorisedindustrialofficerintentionallydisregardsaconditionofclause11.3.2theAuthorisedindustrialofficermaybetreatedasatrespasser.

11.3.3Inspectionofrecords

(a)AnAuthorisedindustrialofficerisentitledtoinspectthetimeandwagesrecordrequiredtobekeptundersection366oftheAct.

(b)AnAuthorisedindustrialofficerisentitledtoinspectsuchtimeandwagesrecordsofanyformerorcurrentEmployeeexceptiftheEmployee:

(i)isineligibletobecomeamemberoftheUnion;or

(ii)hasmadeawrittenrequesttotheDepartmentthattheEmployeedoesnotwantthatEmployee'srecordinspected.

(c)TheAuthorisedindustrialofficermaymakeacopyoftherecord,butcannotrequireanyhelpfromtheDepartment.

(d)ApersonmustnotcoerceanEmployeeorprospectiveEmployeeintoconsenting,orrefusingtoconsent,totheinspectionoftheirrecordsbyanAuthorisedindustrialofficer.

11.3.4DiscussionswithEmployees

(a)AnAuthorisedindustrialofficerisentitledtodiscusswiththeDepartment,oramemberorEmployeeeligibletobecomeamemberoftheofficer'sUnion:

(i)mattersundertheActduringworkingornon-workingtime;and

(ii)anyothermatterwithamemberorEmployeeeligibletobecomeamemberoftheUnion,duringnon-workingtime.

11.3.5Conduct

(a)AnAuthorisedindustrialofficermustnotunreasonablyinterferewiththeperformanceofworkinexercisingarightofentry.

11.4Timeandwagesrecords

11.4.1TheDepartmentmustkeep,attheplaceofworkinQueensland,atimeandwagesrecordthatcontainsthefollowingparticularsforeachpayperiodforeachEmployee,includingapprenticesandtrainees:

(a)theEmployee'sawardclassification;

(b)theemployer'sfullname;

(c)thenameoftheawardunderwhichtheEmployeeisworking;

(d)thenumberofhoursworkedbytheEmployeeduringeachdayandweek,thetimesatwhichtheEmployeestartedandstoppedwork,anddetailsofworkbreaksincludingmealbreaks;

(e)weekly,dailyorhourlywagerate - detailsofthewagerateforeachweek,day,orhouratwhichtheEmployeeispaid;

(f)andnetwagespaidtotheEmployee;

(g)detailsofanydeductionsmadefromthewages;and

(h)contributionsmadebytheDepartmenttoasuperannuationfund.

11.4.2Thetimeandwagesrecordmustalsocontain:

(a)theEmployee'sfullnameandaddress;

(b)theEmployee'sdateofbirth;

(c)detailsofsickleavecreditedorapproved,andsickleavepaymentstotheEmployee;

(d)thedatewhentheEmployeebecameanEmployeeoftheDepartment;

(e)ifappropriate,thedatewhentheEmployeeceasedemploymentwiththeDepartment;

(f)ifaCasualEmployee'sentitlementtolongserviceleaveisworkedoutundersection47oftheAct - thetotalhours,otherthanovertime,workedbytheEmployeesincethestartoftheperiodtowhichtheentitlementrelates,workedouttoandincluding30Juneineachyear.

11.4.3TheDepartmentmustkeeptherecordfor6years.

11.4.4SuchrecordsshallbeopentoinspectionduringtheDepartment'sbusinesshoursby:

(a)aninspectoroftheDepartmentofIndustrialRelations,inaccordancewithsection371oftheAct;or

(b)anAuthorisedindustrialofficerinaccordancewithsections372and373oftheAct

11.4.5ReferencestotheActshallbetakentobereferencestothatActasamendedorreplacedfromtimetotime.

11.4.6ConsistentwithMinisterialDirective12/01Attendance - Recording,ReportingandPublicHolidays,theDirector-GeneralmayspecificallyexemptthoseEmployeeswhohavebeen,orwhoareaclassofofficefromasystemforrecordingstartingandfinishingtimes,mealbreaksandabsencesfromduty.

11.5UnionDelegates

11.5.1ThepartiesacknowledgetheconstructiveroledemocraticallyelectedUniondelegatesundertakeintheworkplaceinrelationtoUnionactivitiesthatsupportandassistmembers. Thatrolewillbeformallyrecognised,acceptedandsupported.

11.5.2PublicsectorEmployeeswillbegivenfullaccesstoUniondelegates/officialsduringworkinghourstodiscussanyemploymentmatterorseekUnionadvice,providedthatservicedeliveryisnotdisruptedandworkrequirementsarenotundulyaffected.

11.5.3Providedthatservicedeliveryandworkrequirementsarenotundulyaffected,delegateswillbeprovidedconvenientaccesstofacilitiesforthepurposeofundertakingUnionactivities. Suchfacilitiesinclude: telephones,computers,e-mail,photocopiers,facsimilemachines,storagefacilities,meetingroomsandnoticeboards. Itisexpectedthatmanagementanddelegateswilltakeareasonableapproachtotheresponsibleuseofsuchfacilitiesforinformationandcommunicationpurposes.

11.5.4SubjecttotherelevantEmployee'swrittenapprovalandanyconfidentialityprovisions,delegatesmayrequestaccesstodocumentsandpoliciesrelatedtoamember'semployment.

1.1CasualEmploymentattheWoodfordCorrectionalCentre

ForthepurposesofCasualemployment,a "CasualEmployee" meansanEmployeeotherthana "Part-timeEmployee" asdefinedherein,whoisengagedassuchandispaidonanhourlybasisandshallbeemployedfornotmorethan36hoursinaworkcyclenotexceeding7days.

2.1Workallocation

AnEmployeehavingeitherbeenappointedorrelievinginanofficewithinaClassificationLevelmaybeallocatedandsubsequentlyreallocatedtoanyofficewithinthatparticularClassificationLevel.

AllEmployeeswithinthePrisonerManagementStreamshallberequiredtofunctioninmulti-disciplinaryteamsprovidingatotalcorrectionalservicetoprisoners. InordertoprovideatotalcorrectionalserviceallEmployeeswithinthePrisonerManagementandSecurityStreamswillberequiredtogainfullCustodialCorrectionalOfficeraccreditation.

3.1PaypointAllocation

3.1.1.AllStreams

(a)Subjecttotheprovisionsofclause3.1movementbetweenLevelswithinStreamswillbebasedonappointmentonmerittoadvertisedvacancies.

(b)NoEmployeeshallbeentitledtoreceiveasalaryIncrement unlesstheirPerformance,PlanningandReviewreportissatisfactoryandinthecaseofaFull-timeEmployee,suchEmployeehasreceivedsuchsalaryforaperiodof12months.

3.1.2.PrisonerManagementStream

(a)AnEmployeeappointedtothePrisonerManagementStream,whosatisfiestherequirementforaDegree,shallbepaidnolessthanclassificationPM1-3fora3yearDegreeandclassificationPM1-4fora4yearDegree.

(b)InthecaseofaSeniorPsychologist,anEmployeeshallnotbepaidlessthanclassificationPM1-5.

(c)InthecaseofCorrectionalSupervisor,GeneralPsychologistandSocialWorker,paymentshallbenolessthanclassificationPM3-1.

(d)InthecaseofEducationOfficer,paymentshallbeclassificationPM3-3orclassificationPM3-4.

(e)SentenceManagementCo-ordinatorwillbepaidatclassificationPM4-1.

(f)InthecaseoftheActivitiesOfficer,AreaOfficerandAboriginalLiaisonOfficer,paymentshallbenolessthanclassificationPM2-1.

(g)InthecaseofTradeInstructor,paymentshallbenolessthanclassificationPM1-5andnohigherthanPM2-2.

(h)ACorrectionalOfficerinthePrisonerManagementStreamwillberestrictedinmovementbeyondclassificationPM1-1untiltheCertificateIIIinCorrectionsisobtained. MovementbeyondclassificationPM1-2willberestrictedtoEmployeeswhopossessaCertificateIVinCorrections. MovementbeyondclassificationPM1-5willberestrictedtoEmployeeswhopossessaDiplomainCorrectionalAdministration.

(i)Inaccordancewithclause3.1.2(a),graduatesappointedtothePrisonerManagementStreamwillprogressthroughthefollowingPaypoints,subjecttoanannualsatisfactoryPerformancePlanningandReviewprocess:

(k)ProvidedthattheabovecriteriaforprogressionshallnotentitleanEmployeestudyingforadegreetoadvancetoapaypointhigherthantheratepayabletoagraduate,forthesameyearsofserviceasprescribedinclause3.1.

3.1.3SecurityStream

(a)AnEmployeeappointedtotheSecurityStreamshallbepaidnolessthanClassificationS01-1.

(b)SecurityOfficersintheSecurityStreamwillberestrictedinmovementbeyondClassificationSO1-2untiltheCertificate111inCorrectionsisobtained. MovementbeyondClassificationSO1-4willberestrictedtoEmployeeswhopossessaCertificate1VinCorrections.

(c)DogHandlerswillbepaidatnolessthanClassificationSO1-5,andnohigherthanSO1-7.

4.1Hoursofwork

Theordinaryhoursofworkforshiftworkersshallbeinclusiveofmealtimesandshallbe520hourswithinaworkcyclenotexceeding91consecutivedaystobeworkedinshiftsofbetween4and12hours.

5.Mealbreaks

5.1.1AllEmployeesnotsubjecttobankedtimearrangementswhetherdayworkersorshiftworkersshallbealloweda30minutemealbreakbetweenthe3rdand6thhoursofdutywhereshiftlengthisfrom6-10hoursduration.

5.1.2AllEmployeessubjecttobankedtimearrangementsshallbeentitledtoalunchbreakofnotlessthan30minutesorinexcessof2hoursdurationtobetakenwheneverpossiblebetweenthe4thandthe6thhours.

5.1.3Whereashiftexceeds10hoursanadditionalmealbreakof30minutesshallbeallowednotlaterthanthe10thhourofduty.

5.1.4Thehoursofdutyofshiftworkerswillbeinclusiveofmealbreaksandwillbetakensoasnottointerferewithoperationalrequirements.

5.1.5TheManagermaydirectthatanEmployeeworkingshiftworknotberelievedforamealbreakandinthiscasetheEmployeewillremainattheworklocationforamealbreakof30minutes,providedthatwhereanEmployeeisentitledtotwo30minutebreaks,thatEmployeewillbeentitledtoatleastonerelievedmealbreak.

5.1.6Wherereliefisprovidedthe30minutesshallincludewalkingtime.

5.1.7AllshiftworkEmployeesshallbeprovidedwithamealfreeofcharge.

5.1.8Allothernon-shiftEmployeeswhoarerequiredtoconsumetheirmealatadesignatedworkstationshallbeprovidedwithamealfreeofcharge.

5.1.9MealsprovidedtoEmployeeswillbecommontothoseprovidedtoprisoners.

6.1Overtime

6.1.1Subjecttoclause5.1andthoseEmployeessubjecttobankedtimearrangementsallauthorisedovertimeworkedbyEmployeesshallbepaidforattherateoftimeanda-halfforthefirst3hoursanddoubletimethereafter.

Shiftworkerswhosehoursofworkareregularlyrotatedinaccordancewithashiftrostercovering2ormoreshiftsperdayshallbepaidforovertimeattherateofdoubletime.

Forthepurposesofthisclausetimeworkedoutsiderosteredshiftarrangementsshallbepaidasovertime.

6.1.2AllovertimeworkedonaSundayshallbepaidforatdoubletheordinaryrate.

6.1.3Aminimumpaymentof3hourswordshallapplytoallovertimeworkedonaSaturdayoraSunday.

6.1.4Employeeswillberequiredtoworkovertimewhenevernecessaryintheopinionoftheemployer,but24hoursnoticeshallbegivenwherepracticable,toanEmployeerequiredtoworkovertime.

6.1.5AnEmployeerecalledtoperformdutyaftercompletingordinarydutyshallbepaidatovertimerateswithaminimumpaymentof3hours.

6.1.6AnEmployeetemporarilyfilinganddischargingthefulldutiesofanofficeratahigherClassificationLevelforwhichovertimepaymentsareapplicableshallbepaidforauthorisedovertimeattheminimumrateapplicabletothathigherClassificationLevel.

6.1.7Notwithstandingtheabove:

(a)EmployeesremuneratedinaccordancewithClassificationLevel5oftheAdministrativeStreamshallhaveovertimepaymentscalculatedatthemaximumrateofClassificationLevel4oftheAdministrativeStream.

(b)AllEmployeesremuneratedaboveClassificationLevel5oftheAdministrativeStreamandClassificationLevel3ofthePrisonerManagementStreamarenotentitledtoovertimepaymentsbutshallbeentitledtotimeoffonatimefortimebasisinlieuofovertime.

7.1Loadingonannualleavepayments

AloadingcalculatedasprescribedhereundershallbepaidtoEmployeesonannualleave:

7.1.1ContinuousShiftWorkers - Subjecttoclause7.1.2,therateofwageorsalarytobepaidtoaContinuousShiftWorkershallbetheratepayableforworkinordinarytimeandafurtheramountcalculatedattherateof27.5%ofthatrate.

7.1.2Non-continuousShiftWorkers - Subjecttoclause7.2.2,therateofwageorsalarytobepaidtoaNon-continuousShiftWorkershallbetheratepayableforworkinordinarytimeandafurtheramountcalculatedattherateof23%ofthatrate.

7.1.3AllEmployees - Subjecttoclause7.1.3,innocaseshallthepaymenttoanEmployeebelessthanthesumofthefollowingamount:

(a)TheEmployee'sordinarywagerateorsalaryasprescribedbythisAwardfortheperiodofsuchleave(excludingshiftallowances);and

(b)Afurtheramountcalculatedattherateof17.5%oftheamountsreferredtoinclause7.1.3(a).

7.1.4Theprovisionsofclauses7.1.1and7.1.2shallnotapplytoanyperiodorperiodsofleaveexceeding:

(a)200hoursperannuminthecaseofEmployeesemployedonContinuousShiftWork;or

(b)160hoursperannuminanyothercase.

7.1.5Subjecttoclauses7.1.1and7.1.2alumpsumpaymentwillbepaidtoallEmployeesinthefirstpayperiodofDecembereachyear.
