Preamble

WHEREAS by an Order in Council dated 9 June 1873[1] certain lands being the lands described in the Second Schedule to the Melbourne Cricket Ground Act 1933 were pursuant to the Land Act 1869 permanently reserved as site for a public park:

AND WHEREAS by a Crown grant dated 9 June 1873 and entered in the register book of the Office of Titles volume 600 folium 119902 the said lands and the buildings for the time being thereon were granted to the Board of Land and Works and the mayor aldermen councillors and citizens of the city of Melbourne upon trust to be at all times thereafter maintained and used as and for a public park and offices and conveniences connected therewith and for no other purpose whatsoever:

AND WHEREAS by the Melbourne Cricket Ground Act 1933 the said Order in Council and the said Crown grant so far as they related to the lands described in the Third and Fourth Schedules to that Act were revoked:

AND WHEREAS pursuant to the said Act the land described in the Fifth Schedule to that Act was by Order in Council of 20 February 1934[2] permanently reserved as a site for the Melbourne Cricket Ground and was by a Crown grant dated 4December 1933 and entered in the register book of the Office of Titles volume 5925 folium 1184828 granted to certain persons upon trust for the public to be maintained and used as and for a place for playing at cricket and for conveniences connected therewith and when not required for cricket for such other purposes not inconsistent with the foregoing as the trustees think fit and for no other purpose whatsoever:

AND WHEREAS certain adjustments to the boundaries of the hereinbefore recited lands were made by or pursuant to the Melbourne Cricket Ground Act 1951 and the Melbourne Cricket Ground Act 1962:

AND WHEREAS it is expedient to make further adjustments to the boundaries of the hereinbefore recited land:

AND WHEREAS it is also expedient to make new provision relating to the trustees of the Melbourne Cricket Ground:

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1Short title

s. 1

This Act may be cited as the Melbourne Cricket Ground Act 1983 and shall be read and construed as one with the Melbourne Cricket Ground Act 1933, the Melbourne Cricket Ground Act 1951,the Melbourne Cricket Ground (Guarantee) Act 1954, the Melbourne Cricket Ground (Trustees) Act 1957, the Melbourne Cricket Club (Guarantee) Act 1958, the Melbourne Cricket Ground Act 1962 and the Melbourne Cricket Ground (Guarantees) Act 1966, which Acts and this Act may be cited together as the Melbourne Cricket Ground Acts.

2Principal Act

s. 2

In this Act, the Melbourne Cricket Ground Act 1933 is referred to as the Principal Act.

3Commencement

This Act shall come into operation on the day on which it receives the Royal Assent.

4Additional land deemed part of site for Melbourne Cricket Ground

(1)So far only as relates to the land delineated and shown hatched on the plan in the Schedule—

(a)the Order in Council dated 9 June 1873 is revoked; and

(b)the Crown Grant entered in the Register Book of the Office of Titles in volume 600, folium 119902 is revoked, made void and annulled.

(2)The land delineated and shown hatched on the plan in the Schedule shall be deemed to be permanently reserved under section 4(1) of the Crown Land (Reserves) Act 1978 as a site for the Melbourne Cricket Ground and shall be included in and form part of the land reserved under the Order in Council dated 20 February 1934 and referred to in the Crown Grant entered in the Register Book of the Office of Titles in volume 5925 folium 1184828.

(3)The Registrar of Titles is authorized and directed to make such entries in the Register Book as are necessary to give effect to subsections (1) and (2).

5No compensation payable by Crown

No compensation shall be payable by the Crown in respect of any act, matter or thing done or arising out of this Act.

6Amendment of Principal Act

s. 6

After section 5 of the Principal Act there shall be inserted the following section:

"5ATrustees on and after commencement of Melbourne Cricket Ground Act 1983

(1)On and after the commencement of the Melbourne Cricket Ground Act 1983, there shall be 21 trustees consisting of—

(a)three trustees ex officio who shall be—

(i)the President for the time being of the Melbourne Cricket Club;

(ii)the President for the time being of the Victorian Football League; and

(iii)the President for the time being of the Victorian Cricket Association;

(b)one trustee who shall be the Minister for Conservation, Forests and Lands or his nominee;

(c)one trustee who shall be the Minister for Youth, Sport and Recreation or his nominee; and

(d)sixteen trustees appointed by the Governor in Council on the recommendation of the Minister for Conservation, Forests and Lands after consultation with the Minister for Youth, Sport and Recreation who shall include—

(i)a person who shall be nominated by the Victorian Cricket Association; and

(ii)a person who shall be nominated by the Victorian Football League.

(2)A person (other than the Secretary for Lands) who immediately prior to the commencement of the Melbourne Cricket Ground Act 1983 was a trustee shall, subject to section 6(1), continue to be a trustee on and after the commencement of the Melbourne Cricket Ground Act 1983.".

7Amendment of Principal Act

s. 7

In section 6(1) of the Principal Act—

(a)for the expression "(other than a trustee exofficio)" there shall be substituted the words "appointed by the Governor in Council";

(b)after the words "acting as a trustee" there shall be inserted the expression "or, in the case of a trustee appointed by the Governor in Council on or after the commencement of the Melbourne Cricket Ground Act 1983, reaches the age of 72 years"; and

(c)for the word "eighteen" there shall be substituted the expression "21".

8Amendment of Principal Act

After section 6 of the Principal Act there shall be inserted the following section:

"6AGround Policy Committee

(1)There shall be a Ground Policy Committee consisting of—

(a)a trustee who shall be appointed by the trustees, and who shall be chairman of the Ground Policy Committee;

(b)the President for the time being of the Melbourne Cricket Club;

(c)the President for the time being of the Victorian Football League;

(d)the President for the time being of the Victorian Cricket Association; and

(e)the trustee who is the nominee of the trustees.

(2)The Ground Policy Committee may from time to time make recommendations to the trustees with respect to the management and use of the ground.

(3)Any recommendation made pursuant to subsection (2) may be adopted (with or without modification) by the trustees as policy in accordance with which the ground shall be managed and used.

(4)The Ground Policy Committee may regulate its own proceedings.".

9Amendment of Principal Act

s. 9

In section 7 of the Principal Act—

(a)in subsection (2), for the expression "The trustees" there shall be substituted the expression "Subject to subsection (3), the trustees"; and

(b)after subsection (2), there shall be inserted the following subsection:

"(3)Where the trustees delegate to the committee of the Melbourne Cricket Club their powers relating to the management and use of the ground, the committee of the Melbourne Cricket Club shall be required to implement any recommendation from time to time made by the Ground Policy Committee pursuant to section 6A(2) and adopted (with or without modification) by the trustees as policy pursuant to section6A(3).".
