On page 2, after line 18, by inserting the following:
"SECTION 2. A NEW SECTION OF KRS CHAPTER 12 IS CREATED TO READ AS FOLLOWS:
As used in Sections 2 and 3 of this Act, "disabilities" means physical, mental, or alcohol or other drug impairments or disorders that substantially limit one or more of the major life activities of individuals.
(1)The General Assembly finds that many persons with disabilities and their families receive some level of support and services that are funded or administered by state agencies and that there are a number of state agencies, statewide commissions, and executive branch initiatives that have responsibility for the development and implementation of programs, services, and supports for persons with disabilities.
(2)The General Assembly recognizes that there are common needs and issues facing all persons with disabilities, and there are unique needs and issues facing persons with specific disabilities.
(3)The General Assembly finds that there is a need to share information and to coordinate efforts among state government entities that have responsibility for the development and implementation of programs, services, and supports for persons with disabilities.
SECTION 3. A NEW SECTION OF KRS CHAPTER 12 IS CREATED TO READ AS FOLLOWS:
To ensure an appropriate and coordinated response from state government entities that have responsibility for programs, services, and supports for persons with disabilities, the secretary of the Governor's Executive Cabinet shall:
(1)Receive reports, recommendations, statements, and other written findings that relate to services to or programs for persons with disabilities from:
(a)All agencies of the Governor's Executive and General Cabinets that have responsibility for programs, services, or supports for persons with disabilities;
(b)Legislative or executive task forces, work groups, advisory councils, commissions, or similar entities that address issues facing persons with disabilities;
(c)The Kentucky Commission on Services and Supports for Individuals with Mental Illness, Alcohol and Other Drug Disorders, and Dual Diagnoses;
(d)The Kentucky Commission on Services and Supports for Individuals with Mental Retardation and Other Developmental Disabilities; and
(e)Other entities identified and so requested by the Governor.
(2)Report semi-annually in April and October to the Interim Joint Committee on Appropriations and Revenue and to the Interim Joint Committee on Health and Welfare of the Kentucky General Assembly. The report required by this subsection shall include but not be limited to the following:
(a)A listing of all entities that submit reports, findings, or recommendations as required by subsection (1) of this section;
(b)The common needs, issues, and recommendations contained in the reports required by subsection (1) of this section and executive branch plans or efforts to address common needs, issues, and recommendations;
(c)Identification of any duplication of administrative duties or efforts among state government entities and executive branch plans or efforts to eliminate duplication;
(d)Identification of funds and funding available for current programs, services, or supports and an estimate of annual funding needs; and
(e)Recommendations for public policy relating to the common needs, issues, and recommendations identified in paragraph (b) of this subsection for consideration by the General Assembly.".
