Chemical Spraying Announcement

Dear PPCMA Members:

Looks like our 4th of July holiday week will see yet another round of airborne chemical spraying in the Orchard by the Anthonys. PPOA made the following web blast on July 3rd, which corrected a previous web blast made on July 2nd:

Between Thursday, July 5, 2007 and next Tuesday, July 10, 2007 the Anthony's will begin aerial spraying of the Orchard. Depending on winds and weather conditions, they may have to postpone, and the dates will be announced as available.

This process is done to help prevent insect infestation and a fungicide for Pecan Scab will be sprayed, this prevents the damaging effects to both the pecan nut and the foliage. Fertilizer will also be sprayed on the trees. Material Safety Data Sheets (MSDS) are available at the General Managers office for your review.

PPCMA immediately went to the Clubhouse, but MSDS sheets were not made available until mid afternoon. Unlike the PPOA blast, PPCMA wants you to made fully aware of what chemicals are being sprayed over the peninsula, without having to go up to the Clubhouse to find out. Here are details and MSDS web links for the chemicals to be sprayed this time, according to what we were told this afternoon by Carla Hastings, the GM's assistant.

Product Name: LI 700

Chemical name: Blend of Methylacetic Acid, processed Lecithin and
surfactant.

This is a dark brown liquid with a pungent odor.

Warnings: Avoid skin and eye contact and inhalation.

"If on skin or in eyes: Treat as corrosive."

"Avoid inhalation"

Product Name: Quilt Fungicide

chemical name: Methyl (E)-2-{2-[6-(2-cyanophenoxy)pyrimidin-4-yloxy]
phenyl}-3-methoxyacrylate

This product has a sweet musty odor.

This chemical does have a Syngenta Hazard Category rating of B,S (a
rating which does carry an Occupational Exposure Limit).

Warnings: Causes mild eye and skin irritation. Harmful if swallowed.

"NOTE TO DOCTORS: There is no specific antidote if this product is
ingested."

"Highly toxic to fish and invertebrates."

Product Name: Super Tel ZN

Chemical name: Inorganic Salt (Zinc Sulfate Monohydrate)

Warnings: Avoid contact with eyes and/or skin. May cause respiratory
tract, skin, and eye irritation, possibly severe."

“If sufficient quantities are inhaled, pulmonary edema may develop, often with a latent period of 5 - 72 hours."

PPCMA is of the opinion that, in an abundance of caution based on the advisories from chemical manufacturers, it would be advisable to remain indoors, if possible, during and immediately after the spraying takes place. Avoid the potential for direct exposure to the chemicals. AVOID WALKING ALONG THE IMMEDIATE ADJOINING ORCHARD AREA DURING SPRAYING. That includes yourself and your animals. Exercise outdoors is not advised during this period. This is simply our own opinion, which reflects the actions we plan to take ourselves. Please read over the material for yourself.

Also, here are the terms of the LENMO II Agreement as it pertains to aerial spraying:

I. Aerial Spraying. The Anthony Group agrees that in connection with its continued farming of the pecan orchards, it will limit its use of aerial spraying as much as reasonably possible. The Anthony Group will use aerial spraying only when weather conditions prevent ground entrance into the pecan orchards or when the window of spray application is so small that substantial crop damage could result without aerial spraying. The Anthony Group agrees not to use chemicals labeled DANGER for aerial spraying, but can use such chemicals for ground spraying. The Anthony Group will cease aerial spraying west of Monticello Drive by the end of 2002.The Anthony Group shall cease all aerial spraying after 200 New Lots have been sold east of Monticello Drive. The Anthony Group agrees to provide at least 48 hours prior notice to the Association of its intention to use aerial spraying. The Anthony Group acknowledges that the Association has no control over or liability for the application of any chemical on Anthony Group land, and hereby agrees to indemnify and hold the Association harmless from any private or governmental action or claim related to the use of any such chemicals by the Anthony Group.

Please note that per the LENMO II Agreement, no aerial spraying shall occur west of Monticello. If you should happen to witness any chemical release or overspray by the spray plane west of Monticello, PPCMA recommends you try to obtain photographs and/or videos that clearly document the time and location of the occurrence. During the last spraying, one member provided photos that were deemed inconclusive by members of the PPOA LENMO Committee, and not pursued. Also, the FAA has designated Pecan Plantation a "congested area." PPCMA therefore recommends that you document any instances of low flying spray planes over homes.
