WHEREAS,Section1ofArticleVoftheMichiganConstitutionof1963veststhe executivepowerintheGovernor;and

WHEREAS,Section2ofArticleVoftheMichiganConstitutionof1963 empowerstheGovernortomakechangesintheorganizationoftheExecutiveBranch

orintheassignmentoffunctionsamongitsunitsthattheGovernorconsidersnecessary forefficientadministration;and

WHEREAS,Section8ofArticleVoftheMichiganConstitutionof1963provides thateachprincipaldepartmentshallbeunderthesupervisionoftheGovernor,unless otherwiseprovidedbytheConstitution;and

WHEREAS,thereisacontinuedneedtoreorganizefunctionsamongstate departmentstoensureefficientadministration;and

NOW,THEREFORE,I,RichardD. Snyder,GovernorofthestateofMichigan,by virtueofthepowersandauthorityvestedintheGovernorbytheMichiganConstitution of1963andMichiganlaw,orderthefollowing:

I.BUREAUOFSERVICESFORBLINDPERSONS

A.TheBureauofServicesforBlindPersonsiscreatedasaTypeIIAgency withintheDepartmentofLicensingandRegulatoryAffairs. TheDepartmentof LicensingandRegulatoryAffairsshallserveasaDesignatedStateAgencyunderthe

II.COMMISSIONFORBLIND PERSONS

ATheCommissionforBlindPersons("Commission")iscreatedasan advisorycommissionwithin theDepartmentofLicensingandRegulatoryAffairs.

B.TheCommissionshallconsistofsevenmembersappointedby,and servingatthepleasureof,theGovernor.Fourofthemembersshallbeblindpersons.

C.TheCommissionmembersshallhaveaparticularinterestorexpertisein theconcernsoftheblind community.

D.The Governorshalldesignateamember oftheCommissiontoserve asits

Chairperson.TheChairpersonshallserve atthepleasureoftheGovernor.

E.TheDirectoroftheDepartmentofLicensingandRegulatoryAffairsshall performallbudgeting,procurement,and relatedmanagementfunctionsofthe Commission.

F.TheCommissionshalldothefollowing:

1.Studyandreview theneedsoftheblind communityinthisstate.

2.AdvisetheDepartmentofLicensingandRegulatoryAffairsconcerningthe coordinationandadministrationofstateprogramsservingtheblindcommunity.

3.Recommendchangesinstateprograms,statutes,andpoliciesthataffect theblindcommunitytotheDepartmentofLicensingandRegulatoryAffairs.

4.Secureappropriaterecognitionoftheaccomplishmentsand contributions of blindresidentsofthisstate.

5.Monitor,evaluate, investigate,andadvocateprogramsforthebetterment ofblindresidentsofthisstate.

6.AdvisetheGovernorandtheDirectoroftheDepartmentofLicensingand RegulatoryAffairs,ofthenature,magnitude,andprioritiesofthechallengesof blindpersonsinthisstate.

7.AdvisetheGovernorandtheDirectoroftheDepartmentofLicensingand

RegulatoryAffairson thisstate'spoliciesconcerningblindindividuals.

Ill.MICHIGANREHABILITATION SERVICES

MichiganRehabilitationServicesistransferredbyaTypeIItransfer fromthe DepartmentofLicensingandRegulatoryAffairstotheDepartmentofHumanServices. TheDepartmentofHumanServicesshallserve asaDesignatedStateAgencyunder theRehabilitationAct of1973,asamended,29 U.S.C.701etseq. Anyauthority, powers,duties,functions,records, personnel,property,unexpendedbalancesof appropriations,allocationsorother funds,includingthefunctionsof budgetingand procurement,ofMichiganRehabilitationServices,aretransferredfrom theDepartment ofLicensingandRegulatoryAffairstotheDepartmentofHumanServices.

IV.IMPLEMENTATIONOFTRANSFERS

A.Anyauthority,powers,duties,functions,records,personnel,property, unexpendedbalancesofappropriations,allocationsorotherfunds,includingthe functionsofbudgetingandprocurement,used,held,employed,available,ortobemade availabletotheDepartmentofLicensingandRegulatoryAffairsfortheactivities, powers,duties,functions,andresponsibilitiestransferredbythisOrderaretransferred

tothereceivingdepartment.

B.Thedirectorofthedepartmentreceivingthetransfer,afterconsultation withtheDirectoroftheDepartmentofLicensingandRegulatoryAffairs,shallprovide executivedirectionandsupervisionfortheimplementationofthetransfers. The assignedfunctionsshallbeadministeredunderthedirectionandsupervisionofthe directorof thereceivingdepartment.

C.ThedirectorsofthedepartmentsimpactedbythisOrdershallimmediately initiatecoordinationtofacilitatethetransfersandshalldevelopamemorandum of

recordidentifyinganypendingsettlements,issuesofcompliancewithapplicablefederal andstatelawsandregulations,orotherobligationstoberesolved.

D.ThedirectorsofthedepartmentsimpactedbythisOrdershalladminister thefunctionstransferredinsuchwaysastopromoteefficientadministrationandshall makeinternalorganizationalchangesasmaybeadministrativelynecessarytocomplete therealignmentofresponsibilities underthisOrder.

V.CREATIONOFMICHIGANCOUNCILFORREHABILITATIONSERVICES

A.TheMichiganCouncilforRehabilitationServices("Council")isestablished withintheDepartmentofHumanServices. TheCouncilshallserveasasinglestate rehabilitationcouncilpursuantto29USC721(a)(21)(B)fortheDepartmentofHuman Services,MichiganRehabilitationServicesandtheDepartmentofLicensingand RegulatoryAffairs,BureauofServicesforBlindPersons.'

B.TheCouncilshallincludethefollowingseventeen(17)votingmembers:

1.ThefollowingmembersshallbeappointedbytheGovernor,aftersoliciting recommendations fromrepresentatives oforganizationsrepresentingabroad rangeofindividualswithdisabilitiesandorganizationsinterestedinindividuals withdisabilities:

a. OneindividualrepresentingtheStatewideIndependentLivingCouncil establishedunderExecutiveOrder2007-49whomustbethe

· chairpersonorotherdesigneeoftheStatewideIndependentLiving

Council.

b. Oneindividualrepresentingaparenttrainingandinformationcenter establishedunderSection671oftheIndividualswithDisabilities EducationAct,PublicLaw91-30,asamended,20USC1471.

c. Oneindividualrepresentingtheclientassistanceprogramestablished underSection112oftheRehabilitationActof1973,PublicLaw93-

112,asamended,29USC732whomustbethedirectoroforother individualrecommended bytheclientassistanceprogram.

d. Oneindividualrepresentingqualifiedvocationalrehabilitation counselorswithknowledgeof,andexperiencewith,vocational rehabilitationprograms. Theindividualappointedunderthisparagraph shallnotbeanemployeeofMichiganRehabilitationServicesorthe BureauofServicesforBlindPersons.

e. Oneindividualrepresentingcommunityrehabilitationprogramservice providers.

f.Fourindividualsrepresentingbusiness,industry,.orlabor.

g. OneindividualrepresentingtheTalentInvestmentBoardcreatedby

ExecutiveOrder2011-13.

h. Atleasttwoindividualsrepresentingdisabilityadvocacygroups, includingacross-sectionofthefollowing:

i.Individualswithphysical,cognitive,sensory,andmental disabilities.

ii. Individualswithdisabilitieswhohavedifficultyinrepresenting themselvesorareunableduetotheirdisabilitiestorepresent themselves.

i.Oneindividualrepresentingcurrentorformerapplicantsfor,or

recipientsof,vocationalrehabilitationservices.

j.Oneindividualrepresentingthedirectorofaprojectcarriedoutunder Section121oftheRehabilitationActof1973,PublicLaw93-112,as amended,29USC741,providingvocationalrehabilitationservices grant.stothegoverningbodiesofanIndiantribeortoaconsortiumof tribalgoverningbodies.

2.TheSuperintendent ofPublicInstruction,orhisorherdesignee,from withintheDepartmentofEducation.

C.TheBureauDirectorof MichiganRehabilitationServicesandtheBureau DirectoroftheBureauofServicesforBlindPersonsshallserveasnon-votingexofficio membersoftheCouncil.

D.AmajorityofthemembersoftheCouncilshallbeindividualswith disabilitiesasdefinedin29USC705(20)(8) andshallnotbeemployedbytheMichigan RehabilitationServicesortheBureauofServicesforBlindPersons. Whenappointing membersof theCouncil,theGovernorshallconsider,tothegreatestextentpracticable, theextenttowhichminoritypopulations arerepresentedontheCouncil.

E.OfthemembersoftheCouncilinitiallyappointedbytheGovernorunder

SectionVI.B.,six(6)membersshallbeappointedfora termexpiringonDecember31,

2013,five(5)membersshallbeappointedforatermexpiringonDecember31,2014, andfive(5)membersshallbeappointedfora termexpiringonDecember31,2015. Aftertheinitialappointments,membersshallbeappointedforatermofthree(3)years.

F.AvacancyontheCounciloccurringotherthanbyexpirationofatermshall befilledbytheGovernorinthesamemannerastheoriginalappointmentforthe

balanceoftheunexpiredterm. Avacancyshallnotaffectthepoweroftheremaining memberstoexercisethedutiesoftheCouncil.

G.ExceptformembersappointedunderSectionV.B.1.c.orSectionV.B.1.j., amemberoftheCouncilshallnotservemorethantwoconsecutivefullterms.

VI.CHARGETOTHECOUNCIL

A.AfterconsultingwiththeTalentInvestmentBoard,theCouncilshalldoall ofthefollowing:

1.Review,analyze,andadviseMichiganRehabilitationServicesandthe BureauofServicesforBlindPersonsregardingtheperformanceofthe responsibilitiesofMichiganRehabilitationServicesandBureauofServicesfor BlindPersonsunderSections100to141oftheRehabilitationActof1973,Public Law93-112,asamended,29USC720to753a,particularlyresponsibilities relatingtoallofthefollowing:

a. Eligibility,includingorderofselection.

b. Theextent,scope,andeffectivenessofservicesprovided.

c. Functionsperformedbystateagenciesthataffectorthatpotentially affecttheabilityofindividualswithdisabilitiesinachievingemployment outcomesunderSections100to141oftheRehabilitationActof1973, PublicLaw93-112,asamended,29USC720to753a.

2.InpartnershipwithMichiganRehabilitationServicesandtheBureauof

ServicesforBlindPersons:

a. Develop,agreeto,andreviewthegoalsandprioritiesofthisstatein accordancewithSection101(a)(15)(C) oftheRehabilitationActof

1973,PublicLaw93-112,asamended,29USC721(a)(15)(C).

b. Evaluatetheeffectivenessofthevocationalrehabilitationprogramand submitreportsofprogresstothefederalgovernment inaccordance withSections101(a)(15)(E)and121oftheRehabilitationActof1973

VII.OPERATIONSOFTHECOUNCIL

A. TheCouncilshallselectfromamongitsvotingmembersaChairperson of theCouncil,subjecttothevetopoweroftheGovernor,andmayselectotherofficersas itdeemsnecessary.

B.TheCouncilmayadoptproceduresconsistentwithfederallaw,Michigan law,andthisOrdergoverningitsorganizationandoperations.

C.AmajorityofthevotingmembersoftheCouncilservingconstitutesa quorumforthetransactionoftheCouncil'sbusiness. TheCouncilshallactbya majorityvoteofthevotingmembersoftheCouncilserving.

D. TheCouncilshallmeetatleastfourtimesperyearinaplacethatthe CouncildeterminesnecessarytoconductCouncilbusinessandconductforumsor hearingsastheCouncildeterminesappropriate.

E.TheCouncilshallconductallbusinessatpublicmeetingsheldin compliancewiththeOpenMeetingsAct,1976PA267,MCL15.261to15.275. Public noticeofthetime,date,andplaceofeachmeetingshallbegiveninthemanner requiredbytheOpenMeetingsAct,1976PA267,MCL15.261to15.275.

F.TheCouncilshallcarryoutitsfunctionsasrequiredby29USC725(d)-(e)

and29USC725(g).

VIII.DISABILITYCONCERNSCOMMISSION

Alltheauthority,powers,duties, functions,records,personnel,property, unexpendedbalancesofappropriations,andallocationsorotherfunds, including thefunctions ofbudgetingandprocurement,oftheDisabilityConcerns Commission,createdbyExecutiveOrder2009-40,previouslytransferredby ExecutiveOrder 2011-4fromtheDepartmentofLicensingandRegulatoryAffairs

totheDepartmentofCivilRights byaTypeItransfer,arehereby transferredtothe

DepartmentofCivilRights byTypeIlltransfer.

IX.ABOLISHEDENTITIES

A.TheMichiganRehabilitationCouncil,createdbyExecutiveOrder2007-48, isabolished,andExecutiveOrder2007-48isrescinded.

B.TheCommission fortheBlind,createdbyMCL393.352,andthe

CommissionBoard,createdby1999AC,R391.1etseq.,areabolished.

C.ThepositionofDirectoroftheCommissionfortheBlindcreatedbyMCL

393.352(1)is abolished.

D.TheDisabilityConcernsCommission,createdbyExecutive Order

2009-40,isabolished.

X.MISCELLANEOUS

A.Allrules,orders,contracts,plans,andagreementsrelatingtothefunctions transferredtotheDepartmentofHumanServicesbythisOrder lawfullyadoptedpriorto theeffectivedate ofthisOrderbytheresponsiblestateagencyshallcontinue tobe effectiveuntilrevised, amended,orrescinded.

B.Any suit,action,or otherproceedinglawfullycommencedby,against,or beforeanyentitytransferredto theDepartmentofHumanServicesortheDepartmentof Licensingand RegulatoryAffairsbythisOrdershallnotabatebyreasonofthetaking effectofthisOrder.Any lawfullycommencedsuit,action,or otherproceedingmaybe maintainedby,against, orbeforetheappropriatesuccessorofanyentityaffectedby

thisOrder.

C.TheinvalidityofanyportionofthisOrdershall notaffectthevalidityofthe remainderoftheOrder,whichmaybe giveneffectwithoutanyinvalidportion. Any portionofthisOrderfoundinvalidbyacourtorotherentitywithproperjurisdictionshall beseverablefromtheremainingportionsofthisOrder.
