MEMORANDUM

TO: Deputy Secretary

SUBJECT: Delegation of Authority

I. DELEGATION

Under the authority vested in me by section 412 of the Department of Education Organization Act, 20 U.S.C. §3472, and section 421A(a) of the General Education provisions Act (GEPA) , 20 U.S.C. §1231(a), I hereby delegate to you the authority, in accordance with section 431(g) of GEPA, 20 U.S.C. §1232(g), to:

(1) Notify the Congressional ~ommittees specified in section 431(g) of GEPA whenever the Department cannot comply with a schedule for promulgating final regulations that previously was submit.ted to those committees, and

(2) Submit a new schedule to those committees.

Unless otherwise noted in future delegations of authority, legislative amendments to the authority delegated herein are included within the scope of this delegation.

II. RESERVATIONS

None.

III. REDELEGATION

This authority may not be redelegated.

IV. CERTIFICATION AND EFFECTIVE DATE

This delegation is effective upon certification by the Department's Principal Delegation Control Officer and supersedes any previous delegation of this authority.
