WIRELESS TELECOMMUNICATIONS BUREAU SEEKS COMMENT ON REQUEST FOR WAIVER TO USE OUT OF BAND SPECTRUM

Comments Due: February 4, 2000

On January 19, 2000, subsidiaries of Omnipoint Corporation (“Omnipoint”) listed below (collectively, the “Omnipoint Licensees”),[1] Omnipoint Communications Cap Operations, LLC and Voicestream Wireless Corporation filed a request for waiver of Section 24.229(b) of the Commission’s rules and the terms of the Omnipoint Licensees’ licenses to permit operation on a temporary basis on spectrum out of the bands designated for those licenses, in accordance with a temporary spectrum use arrangement described in their request for which the Omnipoint Licensees have been granted special temporary authority until January 31, 2000.[2] According to their request, Omnipoint seeks this waiver in order to provide uninterrupted GSM PCS service to customers and roamers in the Washington, DC-Baltimore, MD area while it transitions GSM users to spectrum licensed to the Omnipoint Licensees.

Interested parties must file comments on Omnipoint's request no later than February 4, 2000. All comments should reference the Omnipoint request and this Public Notice. An original and four copies of all pleadings must be filed with the Office of the Secretary, Federal Communications Commission, 445 12th Street S.W., Suite TW‑A325, Washington, D.C. 20554.
