Bohicket Captain’s Lounge Rental Room Rules

and Procedures for Private Use agreement

  1. Only Bohicket Yacht Club Council of Co-Owners members may reserve the Captain’s Lounge at the Member rate. The Responsible Party as listed on the Rental Application, reserving the room must be present at the function at all times. Anyone holding functions without reservations and the appropriate application, use agreement, and deposit will be fined a non-refundable fee of $150.00 and be considered trespassing. This fine will be added to the member’s account and subject to late fees and legal collection procedures, if necessary. The Declarant reserves the right to reserve all amenities for public/private use.
  1. The following fees are subject to change. Fees are in place to offset wear and tear, pay for the utilities used, and pay for cleaning services.

Non-member Rental Fee: $500.00

Kitchen Facility Use Fee: $25.00

Cleaning Fee: $75.00

  1. The Captain’s Lounge must be reserved through the management company (Bohicket Marina).
  1. The Captain’s Lounge may not be used for commercial use.
  1. The Responsible Party as listed on the Rental Application assumes any and all responsibility for any costs or correct and/or repair any damage done to the furnishings or property on the Captain’s Lounge premises in relation to the usage of the Captain’s Lounge. This includes prohibiting use of thumbtacks, nails, staples, glue, etc. to attach anything to the walls, doors, furniture, trim, etc. Furnishings are not to be taken outside. If damage occurs through this type of use, repairs will be made and the cost deducted from the required security deposit. A security deposit will be required, as follows: If additional cost rises above $150.00 deposit. There will be an additional charge assessed to your account.
  • Captain’s Lounge Rental -- $150.00 REFUNDABLE DEPOSIT. We accept cash, check, or credit card for deposit and rental fees.
  1. The Responsible Party as listed on the Rental Application,reserving the facilities must be present at all times during their function as the person responsible for all minors in attendance. Children under the age of 16 in the Captain’s Lounge must be accompanied by an adult. No alcohol will be served to minors at any function, under any circumstances.
  1. Smoking is not permitted in the Captain’s Lounge.
  1. The selling of alcohol is prohibited.
  1. If alcohol is going be present during the private function, the resident reserving the Amenity Rental Room is required to fill out and sign ALCOHOL DISCLAIMER.
  2. Private functions can be held during the hours of 8:30 AM to 1:00 AM
  1. There will be no loud or amplified music at the facility out of consideration for the neighboring residents.
  1. Reservations are taken on a first come first serve basis. No function will be placed on the calendar until application has been approved, use agreement signed, and deposit submitted.
  1. Commercial or political advertisements may not be posted or circulated at the Captain’s Lounge.
  1. No business of any kind shall be solicited or conducted on the Captain’s Lounge premises without the prior authorization of the Bohicket Yacht Club Council of Co-Owners Board of Directors.
  1. Roller Blades/Skates, skateboards, and similar devices may not be brought into or used on the Captain’s Lounge property.
  1. Occupancy limits for all facets of the facilities will be those specified by the Johns Island Fire Department.
  1. The Captain’s Lounge doors must be secure when function is over and cleanup is completed. All damage or theft will be assessed for failure to secure amenity windows and doors.
  1. Cleaning fee will be established for each event based on the number of anticipated guests. Property owner/tenant will be required to straighten up after the event. Cleanup MUST take place immediately following the function. All trash must be taken offsite from the Captain’s Lounge. Refund of deposit will depend upon result of inspection of the facility after cleanup.
  1. No pets are allowed on the Captain’s Lounge premises, only with the exception of medically prescribed companion animals.
  1. Cancellation must be given within three (3) days of the event to receive a full refund.
  1. By signing below, the Responsible Party as listed on the Rental Application, has read and understands the rules and procedures set forth by the Bohicket Yacht Club Council of Co-Owners Board of Directors.
  1. You are required to make yourself and guests familiar with all safety equipment and emergency exits.
  1. IN CASE OF AN EMERGENCY CALL 911!

In consideration of Bohicket Yacht Club Council of Co-Owners,(BYCCC) and Bohicket Investors, LLC (“BI”) consent to the use of the Captain’s Lounge located within Bohicket Marina & Market by Bohicket Marina & Marketmembers for private occasions, the legal sufficiency of which the undersigned owner expressly acknowledges, the undersigned owner hereby indemnifies and holds BYCCC and BI harmless from any and all claims, actions, causes of actions, liabilities, obligations, costs, expenses, damages, injuries, or legal proceedings of any kind related in any to BYCCC and BI consent of the responsible party and responsible party’s guests use of the Captain’s Lounge. This indemnification and hold harmless shall not apply to BYCCC and BI gross negligence or unlawful acts regarding the Bohicket Captain’s Lounge. BYCCC and BI shall exercise only ordinary care regarding the private use of the Bohicket Captain’s Lounge by the responsible party, BYCCC and BI shall not have a duty whatsoever to exercise any extraordinary care in the responsible party’s private use. By signing below, the undersigned responsible party acknowledges that the responsible party and its guests use the Bohicket Captain’s Lounge at their own risk.
