CHAPTER 16-600. DeerControlRegulations
16-601. PurposeofChapter. Theregulationshereinaftersetforthinthischapterareintendedtohelpregulatetheexcessivepopulationofdeerwithinthecityboundaries. Itisrecognizedthatdeernaturallyinhabittheareabuttoomanydeerlivinginthecitycanbedangeroustotraffic,anuisancetohomeownersandtheirlandscapingandgardensandcanbeunhealthyandharmfultothedeerthemselves. Thecontroloftheurbandeerherdisaccomplishedthroughacombinationofavarietyofseparateactionsincludingbutnotlimitedto:1) adeertrappingandrelocatingorcullingprogram,2)allowingresidentsto protecttheirpropertyfromdeer byallowingreasonabledeerfencestobeconstructed ifresidentsdesiretodoso,and3)regulatingunauthorized feedingofdeerwithinthecitylimits.TheviolationofanyoftheprovisionsoftheordinancesinChapter16-600shallbeaninfraction.
16-602. Definitions:
(!)Deer-MuleDeer.AppliesalsotoWhite-Taileddeerifpresent.
(2)DeerFence-Afenceconstructedwithcertainfeaturesincludingitsmaterialandheight,andplacedinsuchlocationand heighttodiscouragedeerfrom crossingittogainaccesstoapieceofpropertyintendedtobeprotected. Adeerfenceneednot bemadeoutofdeerfencingmaterial,inwholeorinpart,tobe consideredadeerfence.
(3)DeerFencingMaterial-Fencingmaterialeitherspecificallydesignedforcontrollingandbal1'icadingdeerandotherpredatorsormorestandardfencingmaterialequallycapableofdoing so.Suchmaterialmaybeinstalledaseither astand-alonedeerfenceorthedeerfencing materialmay be addedtootherfencesand/orfencingmaterial.Thefollowingtypesofmaterialsareapprovedasdeerfencingmaterial:
(A)Plastic/Polyresin DeerFencinginearthorneutralcolors(green,black,orbrown)
(B)GalvanizedorStainlessSteelWireFencingmadeof14gaugewireorlarger.
(C)PVC-Coated SteelFencinginearthorneutralcolors(green,black,orbrown)madeof16
gaugewireorlarger.
(D)VinylFencing
Thefollowingfencingmaterialsarenon-exclusiveexamples ofmaterialsnot approvedasdeerfencingmaterial:
(A)ContractorSand/Snowfence(Usuallyorange)
(B) Galvanized SteelHardwareCloth
(C) Poultrynetting
16-603. DeerTrappingProgram. TheChiefofPolice mayauthorize,athisowndiscretion,andtheAnimalControlOfficershalladminister,aDeerTrappingProgramwithintheCity.
(1)ThetrappingofdeershallbeallowedintheCityonlyinaccordancewiththeDeerTrappingProgramestablishedbytheCityand anyotherrequiredregulationsandautho1izationsfromapplicableStateregulatoryagencies.
(2)TheDeerTrappingProgramshallbeadministeredbyaregulatingdocumenttobeapprovedbyresolutionoftheCityCouncilandshall include,asaminimum,thefollowing:
(A)Themannerbywhichthosetobehandlingthetrappeddeerareselectedandtrained;and
(B)Themannerby whichthe trappeddeeraretoberelocatedorculledandbywhom;and
(C)Themannerbywhichthenumberandsexofdeer toberelocatedorculledaretobedetermined;and
(D)Themannerby whichthe locationsforthetrapsaretobeselected(ie. complaint driven);and
(E)Themannerbywhichthe Citywillbeprotectedfromliability,lawsuitand/or otherharmdonebythisprogram,asmuchasreasonablypossible;and
(F)Themannerbywhichthisprogramwillbefinanced.
16-604. DeerControlFencingRegulations.
(I)DeerFencesAllowed.Fencesmaybeinstalledhigherthansixfeetonlyiftheirpurposeis designatedasadeerfenceandprovidedsuchfencescomplywiththerequirementsofthischapter.Anydeer fencethatissixfeet(6')ormorein height,shallrequireabuildingpermitanditsinstallationverifiedtobecorrectbyacityofficialauthorizedtodoso.Thefollowingtypesandcombinationsoffencing arepermittedasdeerfences:
(A)Anyfence orfencingmaterialif theheightofthefenceissixfeet(6') orless.
(B)Anyfenceoversixfeetinheightprovidedthatanyportionofthefenceabove thesixfoot heightiseither:
I.constructedwithDeerFencing Materialasdefinedinparagraph16-601(3),or
2.constructedofmaterialsimilartothebottompartofthefenceprovidedthat suchfencingmaterialcanbeshowntobeat leastasstrongas the anyof the fencing materiallistedinparagraph16-601(3)andconstructedtonotcauseasafetyhazardfora deer;and
3.ineithercaseconstructedsuchthatatleast50%ofthefaceofthefenceabovesixfeet(6') isopen.Inotherwords,"privacyfences"ortheprivacyportionsoffences areonlyallowedto aheightofsixfeet(6').
(C)Deerfencesuptoeightfeet(8')in totalheightmayonlybelocatedtotherearofthefrontsetbackline forthelot.Thefrontsetbacklineforthelot shallbethatlinethatisestablishedbythelandusezonefor thesubjectproperty.
(D)Deerfencesuptotenfeet(10')intotalheightmaybelocatedonresidentiallotsbyconditionalusepermit.
(2)Deer FenceConstruction. Deerfencingmaterialmustbe securelysupportedbypostsorattachedtoexistingfencingand shallbeinstalledinaccordancewiththemanufacturerspecifications.
Themeasurementoftheheightofthedeerfence shallbemeasuredfromthegroundandinclude theheightofanyfencetowhichitmaybeattached.Deerfencing materialmaynotbeattachedtotrees.
(3)DeerFenceMaintenance. Deerfencinganditsinstallationshallbemaintainedingoodconditionandsubjecttoperiodicinspectionbyadesignatedcityofficertoensurethatithasnot
deteriorated, comelooseorhasotherwisebecomeavisualnuisanceorhazardtopeopleor
animals.
16-605. UnauthorizedFeedingofDeer.Theattractingandfeedingofdeerwithin theCitylimits resultsin thedepositofrefuse,debris, fecalmatterandotheroffensivesubstancesandin theattractionofpredatorywildlife. Italsocreatestraffichazards,propertydamage,andnuisanceandannoyanceof otherpersons.Unlessotherwiseexpresslypermittedbylaw,no personshalldeposit,place,distributeor leaveany fruit,grain,hay, vegetable,salt,orotherfood,of anykindornature,withthe intenttoattractorfeeddeeronpublicorprivatelands.
1)Apropertyownershallimmediatelyremoveanymaterialsplacedontheirpropertybyothersinviolationofthissection.
2)Thereshallbearebuttablepresumption thattheplacement offruit,grain,hay,vegetable,minerals,salt,orotherfoodinaggregatevolumeofmorethanone-halfgallonataheightoflessthansixfeet(6')offtheground,orinanydropfeeder,automaticfeed,orsimilardeviceregardlessofheight,isforthepurposeoffeedingdeerinviolation ofthissection.
3)Exceptions:
a)Naturally growing plants, gardens, residue maintained as a mulch pile, haystacks, and bird feeders designed or placed to limit access to deer, are not prohibited under this section.
b)Theprovisionsof thisOrdinanceshallnot applytoanyresidentoragentofthe CityauthorizedtoimplementawildlifemanagementprogramandwhopossessesthenecessarypermitsfromtheStateofUtah,norshallitapplytoanypublicofficerorpublicemployeeintheperformanceofhisduties.TheprovisionsofthisOrdinanceshallnotapply tothefeedingofdomesticanimals.
c)TheChiefofPoliceortheAnimalControlOfficermayauthorizetemporaryfeedingforthepurposesofcountingthedeerpopulation,baitingdeertraps,orotherpublicpurposes.
d)Cityofficialsshallissueawrittenwarningforthefirst offenseunderthissection.Thereafter,offencesshallbesubjectto standardproceduresforordinanceviolators.Theviolationofthisordinanceshall bea Class B Misdemeanor.
