SALEM COMMUNICATIONS, MAJOR USE PERMIT P99-028 FOR A RADIO BROADCAST FACILITY [KCBQ], LAKESIDE COMMUNITY PLANNING AREA (DISTRICT: 2)

OVERVIEW:

This is an appeal filed by the project applicant, Salem Communications, of the Planning Commission's February 28, 2003 denial of Major Use Permit P99-028. The Planning Commission denied the Major Use Permit based on the Commission’s determination that the use is not compatible with surrounding land uses.
The project proposes the construction and operation of AM radio broadcast facilities on a 44.06-acre site. The project consists of six 199-foot tall lattice towers, a ground radial system, an equipment building, and a graded access road. The project proposes to replace the existing KCBQ broadcast facilities that are located on leased land within the City of Santee. The proposed use is classified as a Major Impact Service and Utility in the County Zoning Ordinance and is permitted with the issuance of a Major Use Permit pursuant to Section 2705(b) of The Zoning Ordinance. The applicant is also requesting an exemption from the maximum height limit requirements pursuant to Section 4620(g) of The Zoning Ordinance.
The property is located off of Muth Valley Road, west of Buena Vida Road and south of the San Vicente Reservoir within the Lakeside Community Planning Area. The General Plan Land Use Designation is (17) Estate Residential and the zoning is A70 Limited Agricultural Use Regulations.

Deny Major Use Permit P99-028 because the project for an AM radio broadcast facility is not compatible with adjacent uses.

The Department concurs with the Planning Commission.

ACTION:

Chairman Cox and Vice Chairwoman Jacob stated for the record that they were familiar with the site. Directing the Chief Administrative Officer to aggressively work with the applicant to find a temporary and a permanent site in order to keep KCBQ on the air, ON MOTION of Supervisor Jacob, seconded by Supervisor Horn, the Board of Supervisors took action as recommended.

OVERVIEW:

This is a proposal by Starwood Development for a Specific Plan Amendment for Area II of the Santa Fe Valley Specific Plan and concurrent Rezone and Major Use Permit Modifications to implement the Specific Plan Amendment changes. The proposed changes are to:
·  Delete the Resort/Hotel designation and eliminate the Conference Center/Hotel;
·  Establish a Tennis Center designation and place it on a southerly portion of the previous Resort/Hotel site;
·  Relocate the Golf Course Clubhouse use from the southeast corner of the intersection of Del Dios Highway and Bing Crosby Boulevard to the northerly area of the previous Resort/Hotel site;
·  Re-designate the area of the previous Clubhouse site to allow certain Neighborhood Commercial uses and recreational uses, to develop within a five year period of time from the date that the Specific Plan Amendment is adopted, otherwise the area would be developed as Low-Medium Residential, with a maximum of three dwelling units;
·  Change the designation of a ten-acre site in the southern portion of Area II from High Density Residential to Medium-High Density Residential;
·  Change the designation of a portion of the Resort/Hotel site to High Density Residential; and
·  Reallocate dwelling units within residential locations without changing the established residential designations in Area II.
No additional dwelling units are proposed.
The site is in the Estate Development Area (EDA) Regional Category and the (21) Specific Plan Land Use Designation of the San Dieguito Community Plan. The proposed changes are to Area II of the Santa Fe Valley Specific Plan, which was adopted by the Board of Supervisors on December 13, 1995. Area II is located south of Del Dios Boulevard, generally east of the San Dieguito River and north of Artesian Road.

  1. It is hereby found that the Board of Supervisors has reviewed and considered the information contained in the Final Environmental Impact Report certified December 13, 1995, on file with the Department of Planning and Land Use as Environmental Review Number 95-08-007 prior to making its decision on the project.
The “California Environmental Quality Act Guidelines Sections 15162, 15163, and 15164 Findings for Determining the Appropriate Environmental Documentation for Use on a Subsequent Project with a Previously Adopted Environmental Impact Report” dated August 9, 2002, on file with the Department of Planning and Land Use as Environmental Review Number 95-08-007D is hereby adopted.
The “California Environmental Quality Act Guidelines Section 15091 Findings Regarding Significant Effects of the Project” dated October 20, 1995, on file with the Department of Planning and Land Use is hereby adopted.
  1. Adopt the attached Resolution (Attachment B) approving the amendment (SPA 01-002) to the Santa Fe Valley Specific Plan, which makes the appropriate findings and includes those requirements and conditions necessary to ensure that the project is implemented in a manner consistent with State law and the County General Plan.
  1. Adopt the attached Form of Ordinance (Attachment C).
AN ORDINANCE CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY
  1. Grant Major Use Permit Modifications P95-009W (Attachment D) and P95-010W2 (Attachment E) which make the appropriate findings and include those requirements and conditions necessary to ensure that the project is implemented in a manner consistent with The Zoning Ordinance and State law.

OVERVIEW:

The Traffic Advisory Committee (TAC) meets every six weeks to review proposed changes or additions to regulatory traffic controls. Eleven items were on the Committee's March 7, 2003, meeting agenda. The Committee recommends your action on eight items, as three items were continued prior to the meeting. Item 5-D was continued by the requester, Items 5-E and 5-F were continued at the request of the Rancho Santa Fe Association. All eight remaining items are recommended for action.

FISCAL IMPACT:

Funds for this proposal are budgeted in the Department of Public Works Road Fund.
RECOMMENDATION:
TRAFFIC ADVISORY COMMITTEE:
Consider and file report including the following recommendations:
District 2
2-A. Potrero Valley Road and Round Potrero Road, POTRERO-Establish a through highway.
2-B. Montemar Drive and Austin Drive, SPRING VALLEY-Do not establish additional regulatory controls. The Committee also recommends the Department of Public Works explore the feasibility of modifying the intersection closer to a 90-degree standard “Tee” alignment.
2-C1. Fourteenth Street, east side, from the south line of Main Street (SR-67) southerly 160 feet, RAMONA-Establish a parking prohibition.
2-C2. San Bernardino Avenue, west side, from a point 140 feet north of the north line of Apple Street northerly 20 feet, SPRING VALLEY-Establish a parking prohibition.
District 5
5-A. North Avenue and Laurashawn Lane, ESCONDIDO-Do not establish any regulatory controls.
5-B. North Avenue and Kaywood Drive, ESCONDIDO-Establish a stop control for southbound traffic on Kaywood Drive.
5-C. El Camino del Norte from Paseo Delicias/Del Dios Highway to Val Sereno Drive, RANCHO SANTA FE-Establish a 45 MPH speed limit. Direct the proposed 45 MPH speed limit be certified for radar enforcement. The Committee requests this matter be brought back for further review, one year after the 45 MPH speed limit is posted, to determine the feasibility of lowering the speed limit to 40 MPH at that time.

4. / SUBJECT: / ANNUAL REPORT OF THE COUNTY MAINTAINED ROAD SYSTEM (DISTRICT: ALL)

OVERVIEW:

Section 2121 of the California Streets and Highways Code requires the County to submit to the California Department of Transportation (Caltrans) any additions to, or exclusions from, its mileage of maintained County roads. The most recent update was certified by Caltrans on May 8, 2002.
This is a request to approve transmittal of the mileage changes made since that update.

FISCAL IMPACT:

Recommended action has no cost in current or subsequent years, and will require no additional staff years. Maintenance costs for County roads are completely funded using Gas Tax revenues.
RECOMMENDATION:

Adopt a Resolution entitled Resolution of the Board of Supervisors Transmitting the Annual Report of the County's Maintained Roads – 2003 to the State Department of Transportation.
