ORDINANCE NO. 2018-04

AN ORDINANCE establishing ownership of water treatment plant 2 and Galena Base sewage and sanitary waste systems

Whereas, the City of Galena owns and operates all water and wastewater utilities in the City of Galena; and

Whereas, the City of Galena took ownership of the Galena Air Force base in 2008, including all existing services; and

Whereas, The Water Treatment Plant 2 and the water distribution system on the Air Force base is wholly owned and operated by the City of Galena; and

Whereas, The Galena Air Base sanitary collection and disposal system on the air force base is wholly owned and operated by the City of Galena;

IT IS HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF GALENA:

Section 1. Classification. Sections 2 and 3 of this ordinance are code ordinances. Sections 1 and 4 are non-code.

Section 2. Amendment to 13.08.010. Section 13.08.010 of the Galena Municipal Code is hereby amended to read as follows: [Deleted language is struck; added language is underlined]

The department of public utilities shall establish, operate and maintain aall water treatment plantplants, and a water distribution and delivery systemsystems. No other water treatment plant and water distribution and delivery system may be operated within the city without the approval of the city council. The council consents to the water system located on the Galena Air Base.

Section 3. Amendment to 13.12.010. Section 13.12.010 of the Galena Municipal Code is hereby amended to read as follows: [Deleted language is struck; added language is underlined]

The department of public utilities shall establish, operate and maintain aall sanitary collection and disposal systemsystems. No other sanitary waste collection and disposal utility system may be operated within the city without the approval of the city council. The council consents to the water system located on the Galena Air Base.

Section 4. Effective Date. This ordinance shall be effective upon adoption by the Galena City Council.
