THE RURAL MUNICIPALITY OF KELSEY

BY-LAW NO. ______/10

BEING A BY-LAW OF THE RURAL MUNICIPALITY OF KELSEY TO ESTABLISH A PLANNING ADVISORY COMMITTEE TO ASSIST COUNCIL IN THE FORMULATION OF PLANNING MATTERS FOR THE LOCAL URBAN DISTRICT OF CRANBERRY PORTAGE.

WHEREAS Chapter M225, Division 3, Section 107 of the Municipal Act provides as follows:

107(1)A council committee, other than the committee of a local urban district, may be composed

(a) entirely of members of the council;

(b) of a combination of members and other persons; or

(c) entirely of persons who are not members of the council.

AND WHEREAS Chapter M225, Division 6, Section 124 of the Municipal Act provides as follows:

Definitions

124 (1)In this section,

“compensation” includes a fee, salary, wage or any other payment for labour or services, however determined;

“Expense” means an expense incurred by a member of a council or council committee in attending to municipal business, and includes automobile expenses or mileage, travel expenses, living expenses, registration and tuition fees, the cost materials for a meeting, conference or course, out –of-pocket expenditures and any other expense provided for in a by-law passed under subsection (2);

“Municipal business” means a duty or function that a member of council or council committee is required to carry out under this or any other Act or a by-law or resolution, and includes attending a meeting, conference or course of instruction that relates to municipal purposes.

AND WHEREAS Council may set compensation and expenses

124(2)A council may by by-law set the types, rates and conditions of payments to be made to or on behalf of members of the council and council committees, other than the committee of a local urban district,

(a)as compensation for attending to municipal business;

(b)for expenses incurred while attending to municipal business; and

(c)for any other purpose relating to municipal business that the council considers appropriate.

AND WHEREAS Member may accept payment

124(3)A member of a council or council committee may be paid and may accept an amount paid under a by-law passed under subsection (2).

AND WHEREAS it is deemed expedient and in the best interest of The Rural Municipality of Kelsey to establish a Planning Advisory Committee and to provide for the remuneration of the Planning Advisory Committee so established under Chapter M225 of the Municipal Act.

NOW THEREFORE BE IT AND IT IS HEREBY enacted as a by-law of The RuralMunicipality of Kelsey as follows:

  1. THAT there is hereby established a Cranberry Portage Planning Advisory Committee, as provided by Chapter M225 of the Municipal Act, to advise and assist the Council of the Rural Municipality of Kelsey in the formulation of planning matters.
  1. THAT the membership of the Cranberry Portage Planning Advisory Committee shall consist of the following: “A Committee of the Whole” of the Local Urban District of Cranberry Portage Committee and two citizens appointed by Council.
  1. THAT the duties and functions of the Cranberry Portage Planning Advisory Committee shall be to advise the Council of The Rural Municipality of Kelsey on all land use and development matters that pertain to the Local Urban District of Cranberry Portage.
  1. THAT subject to Section 124(2) of The Municipal Act, the two citizen members appointed by Council under clause 2 of this by-law, shall be paid Seventy-five Dollars ($75.00) for each meeting attended. Reimbursement is requested twice a year – June and December from The RuralMunicipality of Kelsey.
  1. THAT By-law No. 977/89 is hereby repealed in its entirety.
