On February 25, 2005, the Department of Environmental Quality (DEQ) entered into an administrative consent order with Wacker. The consent order provides for Wacker: (1) to perform corrective action addressing all releases of hazardous waste, hazardous waste constituents, and hazardous substances from the facility in accordance with Part111 and Part 201, Environmental Remediation, of the NREPA; (2) to meet the goals established pursuant to the Government Performance and Results Act by September 30, 2007; and (3) to resolve Part 111 violations associated with the mismanagement of remediation wastes alleged in a Letter of Warning dated March 5, 2004. The consent order provides for Wacker to pay a $99,686 monetary fine, to reimburse the DEQ $110,000 for the costs of surveillance and past corrective action oversight, and to contribute $175,000 over five years to the Lenawee County Solid Waste Authority to collect household hazardous waste and electronic waste and disposal of it at licensed hazardous waste disposal facilities. The project also provides for educating the public on opportunities for waste reduction, reuse, and recycling opportunities.
