The response will not include Zoning or Planning Certificates which can only be obtained from the Department of Environment, Land, Water and Planning (DELWP).
Submission of the following information, whilst not mandatory, will greatly assist Council to provide you with a complete and comprehensive response:
A scaled and dimensioned Site Plan showing existing buildings, significant trees/native vegetation, noting which are proposed to be retained, demolished or removed.One set of plans of the proposed development (if applicable)
A full and recent copy of the relevant certificates of title, including copies of any covenants and/or S173 agreements (see following paragraphs) that may be registered on the title.
Many sites in the Shire are subject to legal agreements created through the Planning and Environment Act 1987 or former Town and Country Planning Act 1961. Agreements can control for example, siting of buildings, retention of trees and other vegetation, erection of fences, and colour and external materials permitted in the construction of buildings.
In determining whether a relevant planning permit has been obtained the relevant building surveyor is advised to take all reasonable steps to establish whether a planning permit is required and determine the existence or otherwise of any Planning Scheme requirements, Section 173 Agreements or building envelope requirements on a plan of subdivision which may have an impact on the construction of the building or building work.
