At their meeting on 21 March 2007 the Planning Committee of the regulatory Committee on behalf of the County Council resolved, for the purposes of Regulations 3 of the Town and Country Planning General Regulations 1992 to grant planning permission for the development referred to above and a copy of the Decision Notice is attached.

Therefore, in accordance with Regulation 3 would you please accept this letter in conjunction with the plans shown as formal notification of the development for the purpose of your Register of Planning Applications and Decisions.

In pursuance of their powers under the above mentioned Act, Order and Regulations, the Council as the local planning authority hereby GRANT PLANNING PERMISSION for Single storey side extension on west side to form Special Educational Needs Suite with associated fence and landscape. Relocation of Electricity sub-station and provision of meter cupboard.HeathfieldCommunity College, Cade Street, Heathfield. (Within land edged red on applicants plan no. 377918/A/001 Rev P2) in accordance with your application validated by the Director of Transport & Environment of East Sussex County Council on 26/1/2007 and the plans and particulars submitted in connection therewith and listed below and subject also to due compliance with the condition(s) specified here under:-

1.The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990.

2.The development shall be implemented in accordance with the submitted Waste Minimisation Statement, dated 9 January 2007.

Reason: To minimise the amount of construction waste to be removed from site for final disposal in accordance with Policy W10 of the East Sussex and Brighton and Hove Structure Plan 1991-2011 and Policy WLP11 of the East Sussex and Brighton and Hove Waste Local Plan 2006.

3.The materials to be used in the construction of the external surfaces of the extension shall match those used in the existing, adjoining building.

Reason: To ensure the appropriate appearance of the development in the area in accordance with Policies S1 and EN1 of the East Sussex and Brighton & Hove Structure Plan 1991-2011.

4.Prior to the commencement of the development details of covered cycle parking facilities for 10 bicycles shall be submitted to and approved by the Director of Transport and Environment. The approved details shall be fully implemented prior to the completion of the development and thereafter retained.

Reason: To comply with Policy TR5 of the East Sussex and Brighton & Hove Structure Plan 1991-2011.

5.Construction of the extension hereby permitted shall not take place other than between the hours of 0730 and 1800 on Mondays to Fridays and between 0800 and 1300 on Saturdays and not at any time on Sundays, Bank and Public Holidays.

Reason: To safeguard the amenities of the occupiers of properties in the vicinity of the site in accordance with Policy EN27 (2) of the Wealden District Local Plan 1998.

6.The passageway between the north-western elevation of the extension hereby permitted and the north-western boundary of the application site shall be secured at all times by a locked gate and used only for official maintenance purposes.

Reason: To safeguard the amenities of the occupiers of properties in the vicinity of the site in accordance with Policy EN27 (2) of the Wealden Local Plan 1998.

7.All existing trees that are likely to be affected by the construction activities shall be protected throughout the development in accordance with BS 5837 – “Trees in relation to construction”, and retained during construction.

Reason: In the interests of the visual amenity of the locality in accordance with Policies S1 and EN1 of the East Sussex and Brighton & Hove Structure Plan 1991-2011.

1.The applicant is reminded of his responsibility to comply with the relevant health & safety legislation when removing the asbestos bicycle shed from site.

Reasons for approval

The proposal is for a small-scale extension and associated works. It is appropriate in terms of its siting and design and will have no adverse effect on the High Weald AONB. Attached conditions will ensure there is no adverse effect on residential amenity and construction waste is minimised and managed appropriately. The proposal therefore complies with Policies S10, TR5, EN2, EN3 and W10 of the East Sussex and Brighton & Hove Structure Plan 1991-2011, with Policies GD2, EN6 and EN27 of the Wealden Local Plan 1998, with Policies GD2, NE5, BE1 and BE2 of the Non-Statutory Wealden Local Plan (Interim Guide for Development Control) 2005 and with Policy WLP11 of the East Sussex and Brighton & Hove Waste Local Plan 2006.
