ACCOMPANYING STATEMENT

Background

Under section 10 of the Remuneration Tribunal Act 1995, the Remuneration Tribunal (Tribunal) is required to inquire into, and determine, the salary,allowances and other entitlements for the ACT Civil and Administrative Tribunal (ACAT) non-Presidential Members other than Assessors.

In conducting this review during April 2013 for the Full-time Non-Presidential Member the Tribunal considered information provided by the incumbent, Ms Mary-Therese Daniels, through written submission and appearance before the Tribunal. The General President and Appeals President of ACAT also provided information. The Tribunal decided to seek a work value assessment of the position and information from the Justice and Community Safety Directorate (JACS) about the intended responsibilities of the rolebefore determining any changes to remuneration for the position.

Considerations and Decision

At its meetings in November 2013, the Tribunal considered information provided by the incumbent through her previous submission and appearance before the Tribunal, the work value assessment, and information provided by representatives of JACS who appeared before the Tribunal. The Tribunal noted that the position was only created in April 2012 and that it is intended to focus largely on administration, with a part time non-presidential member able to be engaged to handle hearings.

The Tribunal considered that since the creation of the position in April 2012, the intended responsibilities of the role had not changed significantly. Accordingly, the Tribunal decided that salary for the position will increase by 2 percent, effective from 1 July 2013.

1Commencement

1.1This instrument commences on 1 July 2013.

2Remuneration

2.1The base salary for the ACAT Full-time Non-Presidential Member is $124,371 per annum.

2.2If a person appointed to this office is also appointed to another office, which is not a second job under the Public Sector Management Act 1994, the person must only receive salary for the office that has the highest remuneration.

3Amendment of previous determination

3.1Determination 4 of 2013isamended by replacing the salary amount in Column 2 of ‘$121,932 per annum’ for the Full-time Non-Presidential Member ACAT with the amount ‘$124,371 per annum’.
