RIGHT-OF-WAY USER PERMITS

INSTRUCTIONS

PLEASE READ:

1.  A permit to use or occupy highway right-of-way must be obtained before any construction takes place within the right-of-way.

2.  Applications for public road or street approaches shall bear the signature of the property owner, the lessee, the company, or the corporate official responsible for the construction and maintenance of the installation placed on the highway rights-of-way. The application form may be filed for the applicant by his contractor. However, the signature of the contractor on the application form is not an acceptable signature.

3.  A permit cannot be issued to a property owner, development company, contractor, etc. for sewer and/or utility services. Applications for these installations must be made by the local controlling utility.

4.  Permit applications for residential or commercial driveways must be accompanied by a property plat.

5.  Please place a stake at the proposed driveway location along the property near the roadway.

6.  The application for permit shall be made to the District Deputy Director (c/o Permits Department). The application shall be accompanied by 4 sets of detailed plans showing all the proposed construction and possible effect of traffic movements and drainage, both on and off the highway. It shall include the following items:

a.  Dimensional information relative to the exact location of the property along the highway, north point and scale of drawing.

b.  Property lines and dimensions thereof.

c.  Width of through pavement, and if a divided highway, width of median and location of the existing median crossovers.

d.  Distance between edge of pavement and right of way line.

e.  Width of proposed and existing drive(s) and radii involved.

f.  Dimensions and type of construction of proposed islands between approaches.

g.  Location and dimensions of proposed buildings and parking areas.

h.  Location and description of existing and proposed drainage structures within highway right-of-way.

i.  Location and type of all landscape items.

j.  Profile of driveway. (Drive must slope away from road on uncurbed sections).

k.  Pipe inverts.

l.  Pavement composition of driveway.

7.  A copy of the permit and plan(s) must be in the contractor’s possession on the job while work is being performed within the State’s right-of-way.

Design Regulations

a.  Commercial drives shall be designed and installed as detailed in the “Driveway Access Manual” prepared by the Ohio Department of Transportation, Bureau of Location and Design.

b.  Approach or drive profile adjoining pavement shall conform to shoulder contour and be so constructed that no surface water will be drained onto the State highway pavement.

c.  Pipe for drives and/or roadside ditch enclosures shall be laid to line and grade of adjacent roadside ditch, quality and diameter of pipe being specified by the District Deputy Director at time application for permit is approved. No pipe diameter will be specified less than 12 inches.

d.  To assure proper installation, a permit inspector shall inspect the installation of all pipe and catch basins authorized by permit.

e.  The property owner shall notify the Permit office at least 24 hours prior to such installation at 513-933-6577.

f.  All supports for mail boxes shall be of “breakaway” type. Satisfactory supports shall be as follows:

1.  Maximum 4” x 4” timber.

2.  Maximum 2-1/2” diameter standard wall pipe.

3.  Any material with equal breakaway characteristics of above.

The owner of the land shall keep in repair all approaches or driveways from the public road.

All material, labor and equipment necessary for the construction and proper maintenance of approaches, driveways, and enclosures of roadside ditches shall be furnished by the property owner at his/her expense.
