CALL TO ORDER
Mr. McGavisk called the meeting to order at 9:42 a.m.
REVIEW OF MINUTES
A motion was made by Ms. Mills, seconded by Ms. Hamilton, to approve the March 6, 2008 minutes as presented. The motion passed with Mr. Truemper, Ms. Parisi, and Ms. Brannock abstaining.
UNFINISHED BUSINESS
Discussion Regarding Using Broker Pre-Licensing Course to Fulfill CE Requirements for Salespersons and Brokers
A discussion took place regarding the use of the Broker Pre-licensing course to satisfy CE requirements. The Committee decided that they will allow salespersons to use the Broker Pre-Licensing course to satisfy all 15 hours of required CE for the current licensing period, but going forward it would not be allowed. The purpose of the Broker Pre-licensing course is for obtaining a Broker’s license, not for use as continuing education. Brokers will still need to complete the normal CE requirements based on the pro-ration chart on the website, even if it is their first renewal.
Discussion Regarding Course Provider Qualifications
A brief discussion took place regarding the need for course providers to be certified by the State of Delaware Department of Education. At the last Real Estate Commission meeting the Commission’s DAG, Ms. Kelly, advised that she could find no reason for the Education Committee to change the way course provider applications were currently being processed. She did not find clear and concise evidence that all course providers are required to be certified by the Department of Education if they are only offering CE courses.

Review Request from Robin Sirkis Regarding Second Review of her Instructor Application
The Committee second reviewed Ms. Sirkis’ instructor application that was submitted in February. Ms. Parisi made a motion, seconded by Ms. Brannock, to approve the application based on collateral experience. Motion unanimously carried.
Review Letter from Jack Daggett Regarding Broker’s Licensing Course Being Used for CE
The Committee reviewed a letter from Jack Daggett. Mr. Daggett is requesting to be able to use the Broker’s Pre-Licensing course to satisfy all 15 hours of required CE. Ms. Hamilton made a motion, seconded by Mr. Truemper, to allow the Pre-Licensing course to be used to cover the 15 hours of required CE. As discussed earlier in this meeting, this will be allowed for this licensing period only.
Review Letter from Timothy Walker Regarding NCCBOR CE Course
The Committee reviewed a letter from Timothy Walker. Mr. Walker is requesting that he be granted CE credit for a course he attended that was offered by NCCBOR. Mr. Walker states he was in the classroom prior to instruction beginning, but then left the classroom to use the restroom and when he returned the door was closed. Mr. Walker was admitted after instruction began, and was told he would not receive credit for the course. Mr. Walker is disputing this because he states while he was speaking with the monitor about be allowed to go in, he heard the instructor being introduced. He feels that since he sat through the course, and has witnesses that he was there, he should have been given credit. Ms. Hamilton made a motion, seconded by Ms. Brannock, to deny the request to grant CE credit for the course. Motion unanimously carried. According to section 8.2 of the Education Guidelines, “Sponsors or providers of all continuing education courses shall be wholly and completely responsible for the conduct of their courses, including faithful and complete student attendance as well as facilities management. Faithful and complete attendance is attentive presence for at least fifty (50) minutes of each credit hour.”
Other Business Before the Committee (for discussion only)
Ms. Slaughter advised the Committee of decisions made by the Real Estate Commission at their last meeting regarding the CE audit. The Commission decided that fifteen percent of licensees will be selected for random audit. Audit letters will be sent out after July 1, 2008, and the licensees will have 20 days to provide their CE documentation. The Committee should be able to begin reviewing the documentation in August.

There being no further business, Ms. Carroll made a motion, seconded by Ms. Hamilton, to adjourn the meeting. Motion unanimously carried. The meeting adjourned at 10:52 a.m.
