EXPLANATORY STATEMENT

Defence Determination 2006/73

This Determination amends Defence Determination 2005/15, Conditions of Service (the Principal Determination), made under section 58B of the Defence Act 1903 (the Act). Chapter 15 of the Principal Determination deals with overseas living allowance for members of the ADF on long-term posting overseas.

The purpose of this Determination is to implement revised post indexes that apply to the overseas locations where ADF members serve. The post index is worked out from local prices surveyed in March and September each year by the data service provider.

Clause 1 of this Determination sets out the manner in which this Determination may be cited.

Clause 2 of this Determination provides that the Determination commences on 28 December 2006, which is the start of the second pay period following the day the Determination is signed. This means that the new rate of overseas living allowance, determined as a result of the post index changes implementing the September price review, will be effective as soon as administratively practicable after publication of the review outcomes.

Clause 3 specifies that the amendment is made to the Principal Determination, as amended.

Clause 4 explains the purpose of this Determination, to implement the results of a price review and thus amend the post indexes in Part 2 of Chapter 15 of the Principal Determination. The post indexes are used to calculate the amount of overseas living allowance a member of the ADF is to be paid during a long-term posting overseas.

This Determination implements a series of variations that have been calculated for the purposes of clause 15.2.8 of the Principal Determination, using the price review data collected in September 2006.

Clause 5 substitutes a new Annex 15.2.A into the Principal Determination.

The new Annex 15.2.A incorporates adjustments made following the September price review. The incorporation of review data enables the post index to more accurately reflect the cost of living at the corresponding posting location and also takes into account movements in the exchange rate. This process results in a closer relationship between members’ allowances and the actual economic conditions at their posting location.

The post indexes have changed as follows:

  • An increase will apply to Austria, Belgium, Cook Islands, East Timor, France, Germany, Israel, Italy, Japan, Jordan, Kiribati, Lebanon, Marshall Islands,Netherlands, New Zealand, Papua New Guinea, Samoa, Solomon Islands, Spain, Sweden, Tonga, Tuvalu, United Kingdom, United States of America and Vanuatu.
  • A decrease will apply toCanada, Korea, Micronesia andPalau.

No changes will apply to Bahrain, Cambodia, China, Egypt, Fiji, India, Indonesia, Iraq, Kuwait, Malaysia, Pakistan, Philippines, Saudi Arabia, Singapore, Syria, Thailand, United Arab Emirates and Vietnam. Review data for Alaska has not been received and so the post index for that location remains unchanged.
