DEED CREATING LIFE ESTATE AND CONVEYING TITLE

This Indenture made this ____ Day of ______, 2013, by and between

ANTHONY J. CILWA, TRUSTEE of THE SUNSET REALTY TRUST(Hereinafter, “Grantor”) with a mailing address of P.O. Box ______, ______, South Carolina, and, ______single man, and ______, single woman, who were formerly married and whose marriage was dissolved by a Decree in Divorce entered on the ____ Day of ______, 20____ by the ______Court in ______County, State of South Carolina (Hereinafter, "Life Tenants"), with an address known and designated as______, and CHRISTOPHER CILWA, a Married Man, with an address known and designated as 119 Stanmore Drive, County of Anderson, State of South Carolina, 29621 (Hereinafter, “Remainderman/Grantee”)

WITNESSETH:

KNOW ALL MEN BY THESE PRESENTS: That the Grantor, for and in consideration of the sum of Ten and No/100 Dollars ($10.00), and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby grant, convey, bargain, sell, release and set over unto the Remainderman/Grantee, his heirs, Executors, Administrators, successors, and assigns, forever, all that certain lot, piece, or parcel of real property, with all the buildings and improvements thereon erected, located in Anderson County, South Carolina, and more particularly described on Schedule “A”, which is attached hereto, made a part hereof, and designated Exhibit “A”.

The Grantor expressly hereby creates a life estate for the benefit of the aforesaid Life Tenants for and during the duration of their respective natural lives and until the survivor of them shall also depart this life, and that during their Life Tenancies, they shall have the right to the exclusive possession , use, and control of the subject property, as well as the full and exclusive rights to all rents, revenues and profits generated by the subject property. Life Tenants acknowledge that the subject property is encumbered by a certain mortgage held by (Name of lender) and that monthly mortgage payments are due thereunder. Life Tenants further acknowledge that they shall be responsible for, and shall pay the aforesaid monthly mortgage payments and all taxes and insurance related to the subject real property during their tenancy.

It is the intent of the Grantor and all the parties hereto that upon the death, of the survivor of the Life Estate, fee simple absolute title to the subject property conveyed hereunder shall vest in said Remainderman/Grantee.

The Grantor does hereby fully warrant the title to said land and will defend the same against the lawful claims of all persons whomsoever.

IN WITNESS WHEREOF, the Grantor has executed this DEED creating a life estate for the duration of the natural life of ______and ______, until the survivor of them shall also depart this life, and thereafter vesting fee simple title in Christopher Cilwa, Remainderman/Grantee, on the day and year first above written.
