Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

1. CONTEST DESCRIPTION: The Decade of Kissimmee Memories Contest (“Contest") is a creative submission contest wherein eligible entrants will be invited to submit an essay describing “What would you do with a decade of Kissimmee vacations?” (the “Initial Submission”) and to submit the Initial Submission for consideration. Initial Submissions will be reviewed by a panel of judges during the First Judging Phase and the top twenty-five (25) Initial Submissions (as determined by the judging criteria) will be selected as potential Semi-Finalists. Each confirmed Semi-Finalist will receive a video camera and a selection of Sponsor selected merchandise (the “Memory Maker Starter Kit”) and will be asked to create a video reiterating their Initial Submission according to instructions provided by Sponsor (the “Video Submission”). The Semi-Finalist’s Video Submissions will be judged by a panel of judges to select five (5) Finalists. The five (5) Finalist videos will then be posted online for public voting and the Finalist video which receives the most votes will be determined the Grand Prize winner. The confirmed Finalists will also be invited to travel to Kissimmee, FL as Sponsor’s guests from June 8, 2013 to June 11, 2013, as described below.

The sponsor of this Contest is OsceolaCounty, a political subdivision of the State of Florida (“Sponsor”), 215 Celebration Place, Suite 200, Kissimmee, FL34747. The administrator of this Contest is Creative Zing Promotion Group ("Administrator"), The Plaza South Tower, 189 S. Orange Ave., Suite 1130A, Orlando, Florida32801.

The Contest will flow as follows:

  • ENTRY PHASE: The Entry Phase begins on February 1, 2013 at 12:00:01 p.m. Eastern Time (“ET”) and ends on February 28, 2013 at 11:59:59 a.m. ET.
  • FIRST JUDGING PERIOD:Concurrent with and following the Entry Phase, the eligible Initial Submissionswill be evaluated by the judging panel and scored according to established criteria to select the Semi-Finalists.
  • POTENTIAL SEMI-FINALIST NOTIFICATION & VERIFICATION: On or about April 1, 2013 the potential Semi-Finalists will be contacted to verify eligibility, confirm further participation, and obtain releases.
  • SEMI-FINALIST VIDEOS DUE: May 7, 2013 at 3:00 p.m. ET
  • SEMI-FINALIST VIDEO JUDGING/VIDEO JUDGING PHASE: On or about May 10, 2013 the Semi-Finalist Videos will be evaluated by the judging panel and scored according to established criteria to select the Finalists.
  • FINALIST NOTIFICATION: On or about May 17, 2013 the Finalists will be notified.
  • PUBLIC VOTING PERIOD: The Public Voting Period takes place from May 20, 2013 at 12:00:01 p.m. ET and ends on June 10, 2013 at11:59 a.m. ET.
  • FINALIST TRIP: The Finalists will be invited to travel to Kissimmee, FL as Sponsor’s guests from June 8, 2013 through June 11, 2013 to participate in several activities selected by Sponsor showcasing what Kissimmee, FL has to offer.
  • WINNER ANNOUNCEMENT: On or about June 11, 2013 the Grand Prize winner will be announced.

2. ELIGIBILITY: Contest is open only to legal U.S. residents residing in the forty-eight (48) contiguous United States or District of Columbia who are twenty-one (21) years of age or older at time of entry. Employees, officers and directors of Sponsor, Administrator, Westgate Resorts, and each of their respective parents, subsidiaries, and affiliated companies, advertising, promotion, or production agencies, and web masters/suppliers (collectively, the “Contest Entities”) and the immediate family members and individuals residing in their same household, (whether or not related) are not eligible to participate. For purposes of the Contest, "Household Members" shall mean those people who share the same residence at least three months a year and "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. Void in Alaska, Hawaii and where prohibited by law. This Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Contest Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein, and any violation of these Official Rules and/or the eligibility requirements herein shall result in entrant's disqualification and forfeiture of any further participation in the Contest or any prize awarded.

3. HOW TO ENTER: To enter the Contest, visit (the “Website”) and completely fill out the entry form (the "Entry Form") with the information requested and complete your Initial Submission answering the question, What would you do with a decade of Kissimmee vacations? Limit one (1) Initial Submission per person/household. If more than one (1) Initial Entry per household is submitted, only the Initial Submission that is received and processed first will be eligible. ALL ENTRY FORMS AND Initial Submissions (COLLECTIVELY REFERRED TO AS THE "ENTRY" OR "ENTRIES") MUST BE RECEIVED BY THE END OF THE ENTRY PHASE FOR CONSIDERATION IN THE CONTEST. No correspondence about Entries will be entered into, nor will Entries be acknowledged or returned. Sponsor will not acknowledge why an Entry has been disqualified. Sponsor is not responsible for late or incomplete entries.

All Initial Submissions must comply with the ENTRY REQUIREMENTS specified below. Any Initial Submission that does not comply with the ENTRY REQUIREMENTS will not be eligible for consideration in the Contest.

Entry Requirements:

-Initial Submissions must be a minimum of 2,500 characters and may not exceed a maximum of 7,500 characters

-Initial Submissions must be in English

-Initial Submission must be original and created solely by the entrant; may not have been entered into any other contest; may not have won previous awards; may not have been published previously; may not contain defamatory or libelous statements; and may not contain unsafe behavior or situations, profanity, obscenity, nudity, pornographic images or explicit sexual themes, graphic violence, defamatory or libelous statements or material considered illegal or that is not suitable for public viewing, as determined by Sponsor in its sole discretion.

-Initial Submissions must NOT include materials that violate or infringe another person's rights, including, but not limited to, privacy, publicity or intellectual property rights, such as copyright infringement or include third party trademarks, logos, insignia, location signage, photographs, artwork, or sculpture;

-Initial Submissions must comply with the Website’s Terms of Use

Initial Submissions which violate any of theserequirements, may be deemed ineligible to receive the prize and the Initial Submission may be void at the Contest Entities’ sole discretion. Contest Entities reserve the right to disqualify in their sole and absolute discretion any Initial Submission deemed inappropriate or that does not comply with the Website’s Terms of Use. Incomplete or unintelligible Entries will be disqualified. Contest Entities reserve the right to determine in their sole discretion which Entries have satisfied the entry requirements. ELIGIBLE ENTRANTS MUST SUBMIT IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED. There will be no notification of receipt of Contest-related materials. Assurance of delivery of Entries will be the sole responsibility of the Entrant.

4. REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION: Each person who enters this Contest represents and warrants as follows: (i) the Initial Submission is the entrant’s own original, previously unpublished, and previously unproduced work; (ii) the Initial Submission does not contain any computer virus and is otherwise uncorrupted; (iii) as of the date of submission, the Initial Submission is not the subject of any actual or threatened litigation or claim; (iv) the Initial Submission does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; and (v) the Initial Submission does not and will not violate any applicable laws, and is not and will not be defamatory or libelous. Each entrant hereby agrees to indemnify and hold the Contest Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

5. GRANT OF RIGHTS: Each entrant into the Contest hereby irrevocably grants to Sponsor, its designees, affiliates, successors and assigns, the non-exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display the Submission in any media now known or hereafter devised including, but not limited to all forms of electronic media, print media and all forms of internet and wireless protocol in perpetuity and throughout the universe for advertising, marketing, publicity and promotional purposes in connection with the Contest and other promotions. Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter the Submission for any purpose which Sponsor deems necessary or desirable, and each entrant irrevocably waives any and all so-called moral rights they may have therein.

6. PUBLICITY RELEASE: By participating in the Contest, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant in or winner of the Contest, each entrant irrevocably grants the Sponsor and its successors, assigns and licensees, the right to use such entrant’s name, likeness, biographical information and Initial Submission in any and all media for any purpose, including without limitation, advertising and/or promotional purposes as well as in, on or in connection with the Website or the Contest or other promotions, and hereby releases the Sponsor from any liability with respect thereto.

7. SEMI-FINALIST SELECTION AND NOTIFICATION: All eligible Initial Submissions will be judged by representatives of Sponsor to determine twenty-five (25) Finalists, based on the following criteria:

  • Relevance to Kissimmee destination – 50%
  • Does the Initial Submission mention Kissimmee? Does it take into account the things to do and see in the Kissimmee area? Does the Initial Submission revolve around Kissimmee or use it as the focus of the story?
  • Creativity & Uniqueness – 40%
  • Does the Initial Submission contain original and/or imaginative ideas? Was the story relayed in a way that was original? Were there twists or other interesting techniques used in the telling of the story?
  • Quality of written submission – 10%
  • Does the Initial Submission contain fluent sentences and good grammar? Logical organization/structure? Interesting and important ideas?

The judging of Initial Submissions will be conducted under the supervision of Sponsor whose decisions are final and binding in all respects relating to Semi-Finalist selection. In the event of a tie, the tied potential Semi-Finalists will be re-judged by an additional judge who will serve as a tie-breaker using the same criteria as outlined herein or more than the stated number of Semi-Finalists will be selected to proceed in the Contest. Each of the twenty-five (25) potential Semi-Finalists, as determined by the judging criteria indicated above, will be notified by telephone, email and/or overnight mail on or about April 1, 2013 and will be required to respond (as directed) to the notification attempt within three (3) days (or a shorter time if required by exigencies). The failure to respond timely to the notification may result in forfeiture of participation in the Contest and, in such case, Sponsor may select an alternate Semi-Finalist according to the aforementioned judging criteria. Potential Semi-Finalists will be required to execute and return an affidavit of eligibility, a liability release and, unless prohibited by law, a publicity release and other related documents required by the Sponsor (the “Semi-Finalist Documents”), within a reasonable amount of time, as determined by the Sponsor in its sole discretion. Potential Semi-Finalists will NOT receive a video camera and Memory Maker Starter Kit and can NOT proceed to the Video Judging Phase until all such properly executed and notarized Finalist Documents are returned. Sponsor reserves the right to select fewer than twenty-five (25) Semi- Finalists should fewer than twenty-five (25) eligible Initial Submissions be received or for any other reason at the sole discretion of Sponsor.

8. FINALIST SELECTION/NOTIFICATION: Each confirmed Finalist will be sent a video camera, a Memory Maker Starter Kit and instructions for the Video Submission. The Video Submissions must be received by May 7, 2013 at 3:00 p.m. ET. The Video Submissions will be judged by representatives of Sponsor to determine five (5) Finalists, based on the following criteria:

  • Relevance to Kissimmee destination – 50%
  • Does the Video Submission mention Kissimmee? Does it take into account the things to do and see in the Kissimmee area? Does the Video Submission revolve around Kissimmee or use it as the focus of the story?
  • Creativity & Uniqueness – 40%
  • Does the Video Submission contain original and/or imaginative ideas? Was the story relayed in a way that was original? Were there twists or other interesting techniques used in the depicting the story?
  • On-screen presence – 10%
  • How well does the presenter conduct themselves on-screen? Do they exude confidence? Do they have "presence"? Are they a good narrator?

The judging of the Video Submissions will be conducted under the supervision of Sponsor whose decisions are final and binding in all respects relating to Finalist selection. In the event of a tie, the tied entrants will be re-judged by an additional judge who will serve as a tie-breaker using the same criteria as outlined herein. The Finalists will be notified by telephone, e-mail, and/or mail using the contact information provided on or about May 17, 2013. Sponsor shall have no liability for any Finalist notification that is lost, intercepted or not received by a potential winner for any reason. If any potential Finalist does not respond within the time required by Sponsor, or if any Finalist notification is returned as unclaimed or undeliverable to any potential Finalist, such potential Finalist will forfeit his or her opportunity to proceed in the Contest and an alternate Finalist may be selected. Sponsor reserves the right to select fewer than five (5) Finalists should fewer than five (5) eligible Video Submissions be received or for any other reason at the sole discretion of Sponsor.

9. PUBLIC VOTING PERIOD AND WINNER SELECTION/NOTIFICATION:During the Public Voting Period, the Finalist’s Video Submissions (each, a “Finalist Video” and collectively, the “Finalist Videos”) will be made available for viewing on (the “Facebook Page”). To vote on a Finalist Video, go to the Facebook Page, select the “Like” tab, access the “Contest Application” and follow the on-screen instructions to register and vote for your favorite Finalist Video. If you already “Like” the Facebook Page you do not need to repeat this step. At the conclusion of the Public Voting Period the Finalist Video that receives the most votes will be deemed the potential Grand Prize winner, subject to verification of eligibility. Limit one (1) vote per person per day during the Public Voting Period. Any suspected or deliberate attempt to manipulate, or otherwise fraudulently tamper with the voting process, may result in disqualification of the voter and/or Finalist Video, at the Sponsor’s sole discretion. Fraudulent tampering includes but is not limited to: (i) use of proxy voting, (ii) registering for multiple Facebook accounts and/or using multiple e-mail addresses to establish accounts, (iii) offering any type of inducement or compensation (monetarily or otherwise) to any third party, in exchange for a vote in any manner, or (iv) votes generated by a macro, script, bot or other fraudulent means in an attempt to manipulate the outcome of the Public Voting Period.

At the conclusion of the Public Voting Period, the potential Grand Prize winner will be notified in person, by telephone and/or email using contact information provided at the time of entry and may have to complete any required “Prize Claim Documents” as directed by Sponsor. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If any potential winner does not respond within the time required by Sponsor, or if the winner notification is returned as unclaimed or undeliverable to any potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason, such potential winner will be disqualified and the prize may be awarded to the next highest scoring Submission.

10. PRIZES: One (1) Grand Prize: The Grand Prize consists of ten (10) trips for the winner and up to five (5) guests each to Kissimmee, FL (each a “Trip” and collectively, the “Trips”). Each Trip includes round-trip, economy class air transportation for the winner and up to five (5) guests from the major airport nearest winner’s home, six (6) nights’ accommodations; and a seven (7) day car rental. The Grand Prize also includes $25,000 cash which may be used to help offset the tax burden of the Grand Prize. The approximate retail value (“ARV”) of the Grand Prize is $87,940.
