Disclosure of Criminal Record
Offences Which Must Always Be Disclosed
Attached is a document which shows in alphabetical order the list of offences which must always be disclosed irrespective of the following:
- When the offence took place
- Where the offence took place, ie any outside of the United Kingdom
- Whether or not the conviction resulted in a custodial sentence
For further details of the offences, including which acts of parliament they refer to can be found on this link
In addition to this, regardless of the offence
- Any conviction that results in a custodial sentence must be disclosed
- If you have received more than one conviction, even if no custodial sentence was received, then all the convictions must be disclosed.
Offences Where Disclosure is Time Limited
Providing the above criteria does not apply, these offences need only to be disclosed subject to the following time scales
Conviction Received at 18 Years of Age or Over / Less than 11 years have elapsed since the date of convictionConviction Received Under 18 Years of Age / Less than 5 years and 6 months have elapsed since the date of conviction
Cautions Received at 18 Years of Age or Over / Less than 6 years have elapsed since the date of issue
Cautions Received Under 18 Years of Age / Less than 2 years have elapsed since the date of issue
Please note that Cautions also include any reprimands or final warnings received from the police.
