  1. Commission Meeting was called to order at 8:00 AMfollowed by the Pledge of Allegiance.
  1. Adopting of the agenda

Motion by Lintz and seconded by Lampert to approve the agenda with the change under Highway of modification of cattle guard cleaning contract with the Forest Service instead of culvert cleaning. Motion carried, unanimous.

Commissioner Hartman declared a conflict of interest on the vacation of a 31’ public easement on the south side of Sunset Lane.

1. Motion by Lintz, seconded by Hartman to approve the Preliminary Soil and Groundwater Contamination Assessment. Motion carried, unanimous.

2.Motion by Hartman, seconded by Lampert to authorize the Chairman to sign the SLA Quarterly Activity Report – FY 2017. Motion carried, unanimous.

3.Motion by Lampert, seconded by Sorenson to authorize the LEPC Chairman to sign the LEPC Grant Application. Motion carried, unanimous.

  1. Planning Department

1.Motion by Lampert, seconded by Lintz to approve the vacation of a 31’ public easement on the south side of Sunset Lane. Motion carried, Hartman abstained.

  1. Maintenance
  1. Motion by Hartman, seconded by Sorenson to approve the surplus of a 2001 Dodge Ram 2500 4 x 4 pickup, 2000 GMC 4 x 4 pickup and a 2000 Chevy Astro van to be sold at auction. Motion carried, unanimous.
  1. Sheriff

1.Motion by Lampert, seconded by Lintz to table the Battle Mountain Humane Society Contract until a revised contract is received. Motion carried, unanimous.

  1. Airport

1.Motion by Lampert, seconded by Hartman to authorize the expenditure of $8000 for a ramp project at the airport. Motion carried.

2.Motion by Sorenson, seconded by Lampert to authorize expenditure not to exceed $8000 for the grading and asphalt project in front of the airport hangar. Motion carried, unanimous.

  1. Highway

1. Motion by Sorenson, seconded by Lintz to approve the purchase of two 2018 Ford F250 ¾ ton 4 x 4 pickups to be used by the Highway Department and to authorize the surplus of two 2003 Dodge pickups to be sold at auction. Motion carried, unanimous.

2.Motion by Lampert, seconded by Hartman to approve the modification of a cattle guard cleaning contract with the Forest Service. Motion carried, unanimous.

3.Motion by Lintz, seconded by Lampert to table the Application to Occupy Right of Way on Riverside Road for Southern Hills Water to the next regularly scheduled commission meeting. Motion carried, unanimous.

4.A public hearing was held seeking public comment on the 5 year bridge and road improvement plan, public present were Patty Caster, Teri Morgan, Dawn McLaughlin, Rex Harris, Doris Ann Mertz and Marty Mechaley. Gary Woodford, Highway Superintendent and Ross Eberle from Brosz Engineering, presented the plan for Custer County roads detailing when, where and the cost of the bridge and road improvements. There were no comments from the public. Motion by Hartman, seconded by Lampert to authorize the submission and certification for the annual update. Motion carried, unanimous.

  1. Executive Session
  1. Motion by Lampert, seconded by Lintz to go into Executive Session for the following purposes:

Discussion with Wade Huntinton with the South Dakota Department of Health, SDCL 1-25-2(4); Human Resource for wage review and negotiation, SDCL 1-25-2(4); review of resolution establishing annual salaries of certain elected officials with legal counsel, SDCL 1-25-2(1); and personnel, SDCL 1-25-2(1). Motion carried, unanimous. Executive Session started at 8:50AM and was suspended at 9:30 AM. Motion by Hartman, seconded by Lampert to go back into Executive Session for the above matters starting at 10:08 AM and ended at 11:30 AM. Motion carried, Unanimous.

  1. Motion by Hartman, seconded by Lintz to adopt the new proposed starting wage scale for hourly employees. Motion carried, unanimous.
  1. Auditor

1.Motion by Lampert, seconded by Lintz to approve Resolution 2017-06 adopting the 2018 County Budget. Motion carried, unanimous.

3.Meeting reports – Lintz reported that he had attended the Fair Board meeting October 10, 2017 and all is well. Sorenson stated he will attend a conservation meeting on October 13, 2017.
