STATEMENT OF PLAINTIFF’S CLAIM

1. The Plaintiff, John Smith, resides in the Town of Melville, Saskatchewan.

2. The Defendant, Crazy Deals Car Repair, is a company incorporated in Saskatchewan with a registered office in Melville, Saskatchewan and carries on business in Saskatchewan.

3. On January 9th, 2007, the Plaintiff took his 2002 Buick Regal LX, to the Defendant for a tune up and tire rotation. The cost was estimated at $225.00.

4.  The Plaintiff returned to pick up the car the next day. The Defendant presented a bill for $2,500.00 which included replacing the radiator and the brakes.

5.  The Plaintiff alleges that he did not authorize the replacement of the radiator and brakes. Further, he was not advised or consulted regarding any problems with these parts. The Plaintiff maintains that these repairs were unnecessary.

6.  The Plaintiff paid the entire bill because the Defendant refused to return the car until repairs were paid for. The Plaintiff has demanded that the Defendant refund the cost of the unnecessary repairs which total $2,275.00, but the Defendant has refused and/or neglected to pay the same.

7.  THE PLAINTIFF, THEREFORE, CLAIMS:

a)  judgment in the sum of $2,275.00;

b)  interest pursuant to The Pre-Judgment Interest Act; and

c)  the filing costs of these proceedings being $23.00

d)  such further costs as this Honourable Court may deem just.
