MORNING SESSION: – Meeting was called to order at 9:05 a.m.

PRESENT: Supervisors Dianne Jacob, Chairwoman; Pam Slater-Price, Vice Chairwoman; Greg Cox; Ron Roberts; Bill Horn; also Thomas J. Pastuszka, Clerk.

Invocation was led by Chuck Price. Chuck is a former pastor who serves as a Chaplain with the San Diego and El Cajon Police Departments.

Pledge of Allegiance was led by Kyleigh Sullivan an Eighth grader and the Associated Student Body President from Emerald Middle School in El Cajon.

1. / SUBJECT: / SHERIFF – ACCEPTANCE OF GRANT AWARDS FROM THE CALIFORNIA EMERGENCY MANAGEMENT AGENCY; THE CALIFORNIA OFFICE OF TRAFFIC SAFETY; AND THE U. S. DEPARTMENT OF JUSTICE (DISTRICTS: ALL)
OVERVIEW:
This request is to authorize the acceptance of grant funds totaling $931,658. The grants are from the California Emergency Management Agency (Cal EMA) ($881,658) to further narcotic investigations involving methamphetamine; the California Office of Traffic Safety (OTS) through the City of Chula Vista Police Department (CVPD) ($20,000) to provide funding for overtime to enforce illegal street racing and car modification laws; and, the California Department of Justice Bureau of Investigation and Intelligence (DOJ BII) ($30,000) to further investigations involving sex crimes and sexual motivated crimes.
FISCAL IMPACT:
Funds for this request are included in the Sheriff’s Fiscal Year 2008-10 Operational Plan and Fiscal Year 2009-11 CAO Proposed Operational Plan. If approved, this request will result in costs and revenue of $414,500 in Fiscal Year 2008-09 and costs and revenue of $517,158 in Fiscal Year 2009-10. The funding source is unanticipated grant revenue from Cal EMA; California OTS through the CVPD; and, the U. S. Department of Justice through the DOJ BII. There will be no net change in the General Fund and no additional staff years.

RECOMMENDATION:
SHERIFF
1.  Waive Board Policy B-29, Fees, Grants, Revenue Contracts – Department Responsibility for Cost Recovery, which requires full cost recovery for grants.
2.  Authorize the acceptance of grant funds totaling $881,658 from Cal EMA for the period beginning July 1, 2008 through June 30, 2010.
3.  Authorize the amendment of the Cal EMA California Multi-Jurisdictional Methamphetamine Enforcement Team (Cal-MMET) grant period beginning July 1, 2008 through June 30, 2009 to include July 1, 2009 through June 30, 2010.
4.  Authorize the Sheriff to execute expenditure contracts for the Cal-MMET grant to reimburse overtime expenses, not to exceed $138,401 incurred collectively by participating local law enforcement agencies (Carlsbad, Chula Vista, El Cajon, Escondido, La Mesa, National City, Oceanside, and San Diego Police Departments) performing grant activities during the period July 1, 2008 through June 30, 2009 ($115,725) and July 1, 2009 through June 30, 2010 ($22,676).
5.  Authorize the acceptance of grant funds totaling $20,000 from the California Office of Traffic Safety through the CVPD for the period beginning October 1, 2008 through September 30, 2010.
6.  Authorize the acceptance of grant funds totaling $30,000 from the California Department of Justice Bureau of Investigation and Intelligence for the period beginning September 1, 2008 through August 31, 2010.
7.  Authorize the Sheriff to execute all required Cal EMA, California OTS through the CVPD, and U. S. Department of Justice through the DOJ BII grant documents, including any annual extensions, amendments, and/or revisions thereof that do not materially impact or alter the services or funding level.

2. / SUBJECT: / SHERIFF - ACCEPTANCE OF UNANTICIPATED REVENUE FROM THE CALIFORNIA DEPARTMENT OF JUSTICE (DISTRICTS: ALL)
OVERVIEW:
This request is to ratify the application for and authorize the acceptance of $22,100 in unanticipated revenue from the California Department of Justice (DOJ). These funds are to be used for travel expenses incurred by Sheriff’s staff attending the California Criminalistics Institute (CCI) DNA Academy and Firearms and Toolmarks Examiner Academy held on various dates between January 2009 and February 2010.
FISCAL IMPACT:
Funds for this request are included in the Fiscal Year 2008-10 Adopted Operational Plan. The funding source is unanticipated revenue from the California Department of Justice. If approved, this request will result in current year costs of $17,500 and revenue of $15,700 and Fiscal Year 2009-10 costs of $7,200 and revenue of $6,400. There will be a net general fund cost of $1,800 in Fiscal Year 2008-09 and $800 in Fiscal Year 2009-10.

3. / SUBJECT: / SHERIFF - ACCEPTANCE OF DONATION FROM THE HONORARY DEPUTY SHERIFF’S ASSOCIATION (DISTRICTS: ALL)
OVERVIEW:
County of San Diego Administrative Code Section 66 and Board of Supervisors’ Policy A-112, Acceptance of Gifts and Donations, permits the acceptance of gifts by the administrative head of each department in the County, subject to ratification by the Board of Supervisors. This is a request to ratify the acceptance of a $48,000 donation from the Honorary Deputy Sheriff’s Association. The donation will be used to reimburse the expense incurred in May 2009 for sending four Deputy Sheriffs to the Bell Training Academy in Fort Worth, Texas.
FISCAL IMPACT:
Funds for this request are included in the Fiscal Year 2008-09 Operational Plan. The funding source is a donation from the Honorary Deputy Sheriff’s Association. If approved, this request will result in $48,000 current year costs and revenue. This request will require the addition of zero staff years.

2.  Authorize the Chair of the Board of Supervisors to sign a letter of appreciation on behalf of the Board of Supervisors and the County of San Diego to the Honorary Deputy Sheriff’s Association.

OVERVIEW:
This is a request to approve an agreement with the California Department of Correction and Rehabilitation, Division of Juvenile Justice (CDCR-DJJ) for juvenile diagnostic services ordered by Juvenile Court, for an amount not to exceed $150,000 for Fiscal Year 2008-09, and authorize the Chief Probation Officer in future years to execute the agreement and subsequent agreements, extensions, contracts, contract renewals or contract amendments that do not materially impact or alter either the program or funding level.
FISCAL IMPACT:
Funds for this request are included in the Fiscal Year 2008-09 Operational Plan for the Probation Department and in the CAO Proposed Operational Plan for Fiscal Years 2009-11. This request will result in costs to the Probation Department of up to $150,000 for Fiscal Year 2008-09 and up to $150,000 annually thereafter. The funding source is general purpose revenues. This request will result in no increase in staff years.

1.  Authorize the Chief Probation Officer to execute an agreement with the CDCR-DJJ for juvenile diagnostic services, for an amount not to exceed $150,000, for FY 2008-2009 and authorize the Chief Probation Officer to execute subsequent agreements, extensions, contracts, contract renewals or contract amendments that do not materially impact or alter either the program or funding level.
2.  Adopt a resolution titled: A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN DIEGO FOR CALIFORNIA DEPARTMENT OF CORRECTIONS AND REHABILITATION, DEPARTMENT OF JUVENILE JUSTICE, JUVENILE DIAGNOSTIC SERVICES.
