Council Meeting – July 3, 2014

Mayor Thomas L. Hardesty called the Regular Council Meeting to orderwith the following council members present:Mike Zoeller, Donna Eaton,Shane Suttor, and Frank Page. Absent: Bobby Andriot and Jon Swindler.

City Employees Present: Inez Harris, Frank Willoughby, Willard Tucker, and Tom Doyle.

City Attorney: Steven Gregory

Invocation: Rev. Robert Marshall, St. John United Methodist Church

All present pledged allegiance to the flag.

Minutes/Special Called Meeting June 26, 2014

Councilmember Eatonmoved to approve the minutes of the Special Called Meeting on June 26, 2014as read by council members prior to the meeting.Seconded by Councilmember Zoeller.

All voted “aye” and motion carried.

Ordinance No. 2014-07-03–Amending Chapter 51 of the Shelbyville Code of Ordinances Relating to Non-Domestic Animals– 2ndReading – Steven Gregory

Steven Gregory, City Attorney, read an ordinance of the City of Shelbyville dealing with minimum set back requirements for non-domestic animals kept on property that is zoned agricultural or that exists as agricultural under non-conforming use provisions of the city zoning regulations.

It was introduced for second reading by Councilmember Suttor. Seconded by Councilmember Page.

Upon roll call, the following council members voted “aye”: Page, Suttor, Eaton, and Zoeller. Absent: Councilmembers Andriot and Swindler.

Ordinance No. 2014-07-03(A) – Enacting Text Amendments to the Zoning Regulations for Shelby County – 2nd Reading – Steven Gregory

Steven Gregory, City Attorney, read an ordinance of the City of Shelbyville amending the text amendments as it relates to the production and storage of distilled spirits in the City of Shelbyville.

It was introduced for second reading by Councilmember Zoeller. Seconded by Councilmember Page.

Upon roll call, the following council members voted “aye”: Zoeller, Eaton, Suttor, and Page. Absent: Councilmembers Andriot and Swindler.

Accept the Declaration of Covenants, Conditions and Restrictions on Clifton Court – Steven Gregory

Councilmember Eaton moved to change the “conditional” approval on the Clifton Court plat to “approval”. It was seconded by Councilmember Suttor.

All voted “aye” and motion carried.

Department Reports

Tom Doyle, Manager, Shelbyville Municipal Water/Sewer Commission, reported in January 2000, Fiscal Court and the City Council entered into an Interlocal Agreement with the Sanitation District #1 to take over the customers in that district. Once the debt was paid off, the customers would see a reduction in their bills. I am happy to report that debt is paid and those customers will see a rate reduction beginning with the August 2014 billing.

Eilene Collins, Executive Director, Shelby Development Corporation, reported Shelbyville Horse Show Jubilee 2014 will start July 24th. There will be art shows for ages 5-18 years old. Thomas Hood will perform July 25th and Nobodyz Bizziness will perform July 26th. There will also be a custom car cruise on Main Street beginning at 5:00 p.m.

Willard Tucker, Fire Chief, reported the close out of the budget year was challenging due to equipment problems. However, they stayed within budget. The department has a scheduled ISO Inspection on July 9th. Bids for the new fire pumper truck are due on July 10th.

Mayor’s Report

Mayor Hardesty reported there will be a fireworks display at the park. It is being billed as “Shake the Lake”. The selection for Fire Chief is ongoing. There will be a retirement reception for Chief Tucker on July 17th at City Hall. We had a bid opening today for the command vehicle. We offer condolences to Jennifer Herrell in the loss of her mother-in-law.
