Contract for Animal Care Services

CONTRACT FOR ANIMAL CARE SERVICES

This Agreement is made by and between Kandy Thomas, doing business as Kandy’s Kritter Kare & Consulting, and referred to as such elsewhere in the Agreement, and

______referred to as “Owner.”

EXPLANATORY STATEMENT

Owner has one or more domestic animals for which care is needed from time to time. Kandy Thomas and/or employees are in the business of providing such services in the homes of animal owners, various other places, and in her own home. The parties wish to establish general and specific terms to govern the rendition of such services as and when needed by Owner and to agree on the rights, responsibilities, and limits of liability.

TERMS

In Consideration of the points set forth above and their mutual promises to each other, the parties hereby acknowledge and agree with each other as follows:

Kandy Thomas and/or employees will, upon instruction from Owner and further agreement with respect to frequency and duration of visits, special instructions and compensation, provide anima care services at owner home or agreed location to by the parties of this agreement.
The Owner’s instructions referred to above and the terms of compensation to be paid for the services in questions (“the additional terms”) shall be set forth in separate writings from time to time as services are needed and such additional terms are agreed to by the parties. Said “additional terms” shall be part of this contract and are incorporated herein.
Kandy Thomas and/or employees shall comply with the terms and conditions incorporated herein and additional terms agreed to by the parties in writing. So long as Kandy Thomas and/or employees do so, she or they will not be responsible for any injury, illness or death of any of the Owner’s animals that may occur while the animals are in her or their care. Additionally, Kandy Thomas and/or employees shall not be liable for any damage to Owner’s premises. Owner shall release Kandy Thomas and/or employees of any and all liability in connection with the services provided within this agreement and the Owner’s physical premises.
Owner hereby represents and warrants to Kandy Thomas and/or employees that no animals to be cared for pursuant to this agreement have any history of vicious or violent behavior. Owner agrees to compensate Kandy Thomas and/or employees for any damages suffered due to breach of this warranty, and to indemnify her and/or employees for any liability that may arise on their part due to vicious or violent behavior of the animals whether or not such history exists.
Kandy Thomas and/or employees shall not be liable if an animal escaped from the Owner’s premises unless the animal is in a cage environment. In the event a caged animal does escape, the terms of liability as expressed in paragraph 3 shall apply.
Owner shall be responsible for any bills or repayment of such incurred by Kandy Thomas and/or employees caused by an emergency situation in the Owner’s absence. Permission is also given to Kandy Thomas and/or employees to obtain emergency veterinary care in the Owner’s absence.
Although it is contemplated that additional terms will be needed for the parties transaction with each other, this nevertheless constitutes their entire understanding concerning the matters addressed. Any additional terms and any modifications, to be effective, must be set forth in writing, agreed to by both parties, and appended to this Agreement.
Owner agrees to pay in full for all services when rendered. Payments that are not received within 30 days are subject to a 1.85% monthly finance charge.
The Owners state that they have read this Agreement in its entirety and fully understand its terms and conditions.
