Construction Oversight (A&E) Services IDIQ – G13PS00669:

Intent to Award Language:

The U.S. Geological Survey has a need for Architect-Engineer (A&E) Construction oversight services during the construction period for the project ”Replacement of the 1973 HVAC” which shall be implemented concurrently with construction contract #G13PC00032, which was issued on 07/03/2013. This award is being made using the National Park Service’s A&E IDIQ contract #1443C2000090100.

The USGS is aware of no other source that can provide the above services (see sole source justification below). Therefore, the USGS intends to make an award to HDR Engineering,unless USGS is contacted by any vendor who believes theycan provide the same service. Vendors are invited to contact the Contracting Officer, y the response due date indicated on this announcement with an affirmative answer.

The U.S. Geological Survey (USGS) considers employee signatures to be Personal Protected Information, and therefore all employee signatures have been redacted. By posting this document, the Contracting Officer attests all appropriate signatures have been obtained.

SOLE SOURCE JUSTIFICATION STATES THE FOLLOWING PART:

HDR Engineering, Inc. has provided all related Architect-Engineer services for the design period under NPS IDIQ contract #1443C2000090100, USGS Task Order G12PD00397 and is the designer-of-record. The requested construction oversight services were included in the award, but could not perform due to a (contracting) delay in the award of the construction portion of the requirement.

The original order G12PD00397 has expired; therefore, a new order needs to be established in order to complete the remaining unfinished work.

Due to their unique knowledge of the design and the available personnel to provide follow-on engineering support of construction oversight services, HDR is the only qualified firm to provide these services for this project. Use of another vendor for construction oversight services to provide resolution of design/conflict questionscould result in design modifications which could not be provided without having intimate knowledge of the original design intent and calculations, which were completed by HDR. Additionally, because the plans and specifications are signed and sealed by a registered professional engineer certifying that they were prepared by or under direct supervision of the individual with the seal, any modifications by another individual would release HDR Engineering, Inc. from all liability and place the liability for both the original design and any design changes on the second firm without benefit of preparing the original design.

It is not a standard industry practice for firms to assume full liability for designs/design changes that they did not originally prepare, so there is no expectation that any other firm would compete for this requirement. Should another firm be willing to accept this risk, the price to award this portion of work to another firm will be elevated, to account for both the assumption of risk and the additional time and manpower required to review the plans and modify or redesign, resulting in an unnecessary increase in cost to the Government.
