The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amendtheConservation, Forests and Lands (Infringement Notice) Regulations 2013—

(a)to prescribe further offences against a relevant law for which an infringement notice may be served; and

(b)to prescribe infringement penalties for thoseprescribed infringement offences.

2Authorising provision

These Regulations are made under section 99 of the Conservation, Forests and LandsAct 1987.

3Commencement

These Regulations come into operation on 1September 2017.

4Principal Regulations

In these Regulations, the Conservation, Forests and Lands (Infringement Notice) Regulations 2013[1]are called the Principal Regulations.

5Amendment of Schedule 5

(1)After item 3 of Schedule 5 to the Principal Regulationsinsert—

"3A / An offence against section 45(2) of the National Parks Act 1975 / 2 penalty units
3B / An offence against section 45(3) of the National Parks Act 1975 / 2 penalty units
3C / An offence against section 45(4) of the National Parks Act 1975 / 1 penalty unit
3D / An offence against section 45(7) of the National Parks Act 1975 / 4 penalty units
3E / An offence against section 45A(2) of the National Parks Act 1975 / 4 penalty units".

(2)After item 4 of Schedule 5 to the Principal Regulationsinsert—

"4A / An offence against section 45A(5) of the National Parks Act 1975 / In the case of a natural person, 4penalty units.
In the case ofabody corporate, 8penalty units
4B / An offence against section 45A(6A) of the National Parks Act 1975 / In the case of a natural person, 4penalty units.
In the case ofabody corporate, 8penalty units".

Penalty Units

These Regulations provide for penalties by reference to penalty units within the meaning of section 110 of the Sentencing Act 1991. The amount of the penalty is to be calculated, in accordance with section 7 of theMonetary Units Act 2004, by multiplying the number of penalty units applicable by the value of a penalty unit.

The value of a penalty unit for the financial year commencing 1 July 2017 is $158.57.

The amount of the calculated penalty may be rounded to the nearest dollar.

The value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a penalty unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
