STREET TRADERS LICENCE

CONDITIONS FOR WHEELED BIN CLEANING

1.(a)The licence holder will at all times have with him the relevant badge issued by the licensing authority and shall wear the said badge conspicuously on his outer garment with the coloured side outermost so that the photograph and the whole writing thereon shall be distinctly legible. In addition the licence holder shall exhibit said badge on demand to any Constable or authorised Officer of the licensing authority and shall not lend or permit any person to use his licence or badge nor shall he wilfully damage said licence or badge.

(b)In the event of the suspension by the licensing authority, surrender or revocation of his licence, the street trader shall forthwith return his badge to the licensing authority.

2.A street trader shall not lend or allow any other person to use his licence or badge.

3.A street trader shall not in any way alter, erase or deface his/her licence or badge.

4.No person under the age of 18 years shall engage or be employed in street trading.

5.The street trader shall not employ or appoint for the purpose of street trading within the district any person who does not hold a street trader's licence.

6.The street trader, when using a vehicle, or moveable stall, shall

(a)not cause or allow the said vehicle, or moveable stall, to stand on or within a distance of 16metres from any pelican or pedestrian crossing;

(b)ensure that at all times the said vehicle, or moveable stall, can be speedily and easily removed;

(c)ensure that the said vehicle, or moveable stall, is in a safe, serviceable and clean condition.

7.The waste generated from the wheeled bin cleaning process shall be screened to separate and remove solid material and grease from liquid waste. Thereafter, any liquid waste must be discharged directly to a sewer or sewerage treatment works, subject to any conditions which may be imposed by Scottish Water. Any solid waste must be disposed of at a site which is licensed by the Scottish Environment Protection Agency for the disposal of such material.

8.Any chemicals and cleaning products involved or used in the cleaning process must be approved of in advance by the manufacturers of the wheeled bin and when any such chemicals and cleaning products are present in waste which will be discharged directly to a sewer or sewage treatment works, by Scottish Water. Such chemicals and cleaning products must be used in accordance with the product manufacturer's recommended dilution and other instructions.

9.No waste shall be discharged into a road gully or drain either directly or indirectly. Furthermore, any such discharges may be offences in terms of the Sewerage (Scotland) Act 1968 (as amended).

10.The occupier of premises where disposal of waste water is taking place will be required to apply for formal consent from Scottish Water under the Sewerage (Scotland) Act 1968 (as amended).

11.The licence holder shall comply with all conditions or guidance issued by Scottish Water or by Dundee City Council in respect of wheeled bin cleaning and associated waste water discharges to sewers.

12.The contractor is required to furnish to Dundee City Council's Head of Democratic and Legal Services the following documents:-:

(a)A certified copy of a valid and current Certificate of Registration issued by the Scottish Environment Protection Agency authorising the carrying of waste.

(b)Copies of any agreement with Scottish Water to dispose of waste and details of agreed locations for disposal of liquid waste.

(c)A valid and current policy of public liability insurance. The minimum level of public liability insurance required by Dundee City Council is £2,500,000.00.

13.The contractor is required to furnish to the Head of Democratic and Legal Services on application for renewal of the licence copies of all waste transfer notes used in connection with the disposal of waste for the previous twelve months.

14.The licence holder will comply with all legislation, statutory or otherwise, relevant to the service provided.

15.The licence holder shall indemnify Dundee City Council and all householders, tenants, businesses and the like affected by the licence holder's operations for any damage or destruction, howsoever caused to all property owned by Dundee City Council, householders, tenants, businesses and the like as a result of the licence holder's operations.

16.During any spells of cold weather any damp or wet patches on any ground, footway, footpath or roadway remaining after the completion of any wheeled bin cleaning operations shall be immediately treated in order to prevent the formation of ice.

17.The licence holder shall at all times comply with directions, instructions or requests made by officers of Dundee City Council in relation to the cleaning of wheeled bins or any practices carried on by the licence holder.

18.Wheeled bin cleaning operations carried out in residential areas shall be carried out by the licence holder as far as is practicably possible within the curtilage and boundaries of the customer's property or within the confines of his/her vehicle.

19.Every street trader shall collect and remove any paper, garbage or other refuse which may be produced or may accumulate in the course of trading and shall not place or deposit the same or allow the same to be placed or deposited or to fall on any footway, footpath or roadway or adjoining property.

20.The street trader shall comply with any order or instruction given by any Constable for the prevention of obstruction or annoyance to the public in connection with any emergency or disturbance or on any occasion when such constable in his discretion may consider it necessary in the public interest to give such order or instruction.

21.Dundee City Council may order suspension of his/her licence if in its opinion (a) the holder of the licence is no longer a fit and proper person to be the holder of such a licence, whether because of convictions for offences which have taken place since the grant/renewal of the licence, or other cause, (b) carrying on of the activity to which the licence relates is causing undue public nuisance or a threat to public order and safety or (c) the equipment being used in pursuit of the trade is deemed unfit for the purpose.

22.The licence holder shall maintain their vehicles and equipment in such a manner that it operates at its optimum performance at all times.

23.The licence holder shall ensure that all operators shall wear personal protective clothing whilst the equipment is in operation.

24.The licence holder shall ensure that no spray or emissions shall occur from any vehicle during cleaning operations.

25.The licence holder shall ensure that any spillages, liquid or solid, shall be removed prior to vacating the cleaning site.

26.The licence holder shall ensure that all staff are fully trained in the use of all cleaning equipment, safety procedures and cleaning procedures.

27.Wheeled bin cleaning is only an option to residents and licence holders and their staff must not insist on a resident accepting this service.
