COMMITTEE ON SCOPE AND CORRELATION OF WORK

INFORMATIONAL REPORTTO THE HOUSE OF DELEGATES

The following are the activities in which the Committee on Scope and Correlation of Work (“Scope”) has engaged since its last report to the House of Delegates at the American Bar Association’s 2011AnnualMeeting. Scope has continued to fulfill its constitutional mandate as a Committee of the House of Delegates, and the only one elected by it. It has carried forward its review of the structure, function and activities of Association committees and commissions to evaluate the effectiveness of their functioning and determine if overlapping functions exist.

Scope held its last meeting Friday, December 2, 2011, in Chicago, Illinois. Scope’s next meeting will be held Sunday, February 5, 2012, inconjunction with the ABA’s Midyear Meeting in New Orleans, Louisiana.

Scope concluded that the following entityis active and not engaging in a function that unnecessarily overlaps with or duplicates the activities of other ABA entities:

Standing Committee on Continuing Legal Education

Scope recommends the following entities sunset at the conclusion of the 2012 Annual Meeting:

Commission on Civic Education in the Nation’s Schools - work of the Commission be subsumed into the Division for Public Education.

Task Force on Financial Markets Regulatory Reform

Scope deferred final recommendations for the following entities to its:

2012 Midyear Meeting

Standing Committee on Legal Assistance for Military Personnel

Commission on Hispanic Legal Rights and Responsibilities

2012 Spring Meeting

Standing Committee on Delivery of Legal Services

Standing Committee on Group and Prepaid Legal Services

Task Force on Gatekeeper Regulation and the Profession –final recommendations deferred pending additional information from the ABA Board of Governors regarding the continuance of the Task Force. Scope will make a report to the Board of Governors to that effect so that the Board of Governors may take the appropriate action.

Scope also recommends:

Standing Committee on Bar Activities and Services - any further reductions to the Standing Committee on Bar Activities and Services’ budget be seriously discussed and reconsidered in order to prevent negatively impacting the vital role that this Standing Committee serves to the ABA as well as the state, local and special focus bar associations.

Task Force on Preservation of the Justice System - ABA management consider adding an additional full-time staff person to assist the Task Force with the high level of work it expects to do during FY2012. Currently, the Task Force relies on a part-time staff liaison. Scope also realizes the Task Force will only be successful as long as the non-ABA partners stay engaged. Therefore, Scope will do a follow-up review of the Task Force no later than fall 2012, in order to assess whether the Task Force can remain effective.

Standing Committee on Armed Forces Law - during the appointment process, when making recommendations to the president-elect, the Standing Committee should identify qualified “armed forces law experts” who might serve as members to the Standing Committee.

Commission on Lawyer Assistance Program - continue to focus on appointing individuals with the desire and expertise to serve on the Commission as members; and, consider revising jurisdictional statement to reflect its work with lawyers in America and the legal profession.

Standing Committee on Paralegals; Standing Committee on Pro Bono and Public Services; Commission on Youth at Risk; Standing Committee on Gun Violence; Commission on Hispanic Legal Rights and Responsibilities; Commission on Interest on Lawyer Trust Accounts; and Standing Committee on Lawyer Professional Liability. Deferred Items: Standing Committee on Strategic Communications; and Standing Committee on Substance Abuse

Spring:

Standing Committee on Lawyers Referral and Information Services; Standing Committee Legal Aid and Indigent Defendants; Special Committee on Death Penalty Representation; Standing Committee on Group and PrePaid Legal Services; Standing Committee on Delivery of Legal Services; Standing Committee on Judicial Independence; Coordinating Council of the Justice Center; Standing Committee on Federal Judiciary; and Standing Committee on Federal Judicial Improvements
