ORDINANCE NO. 213-2010

AN ORDINANCE OF THE CITY OF CAPE MAY AMENDING CHAPTER 7, SECTION 7-49.6 – ENTITLEDPermits in Lieu of Coins or Payment of Regular Fees in Designated LotsOF THE CODE OF THE CITY OF CAPE MAY.

Whereas, the City Council of the City of Cape May desires to amend Chapter 7, Section 7-49.6 of the Code of the City of Cape May entitled “Permits in Lieu of Coins or Payment of Regular Fees in Designated Lots” to increase the number of Bank Street parking permits.

Now, Therefore, Be It Ordained by the City Council of the City of Cape May, County of Cape May, State of New Jersey:

  1. The last paragraph of Section 7-49.6 shall be amended as follows (inserted language is underlined, removed language is stricken):

7-49.6Permits in Lieu of Coins or Payment of Regular Fees in Designated Lots.

The permits for the Jackson-Chestnut-Perry Street Parking Lot shall be honored in the Bank Street Parking Lot, but the permits for the Bank Street parking Lot shall be valid only at the Bank Street Parking Lot.

PARKING LOT PERMIT DESIGNATION AND LOCATION / PERMIT FEE / MAXIMUM NO. OF PERMITS
1) Jackson-Chestnut-Perry Streets Parking Lot Permit; Block 1038, Lots 1 and 2, and Block 1039, Lots 1 through 9 inclusive, and Lots 18 through 23, inclusive / $250350.00 / 50
(2) Bank Street Parking Lot Seasonal Permit; Block 1040, Lots 1 and 8 / $100150.00 / 225
  1. All other ordinances in conflict or inconsistent with this Ordinance are hereby repealed to the extent of such conflict or inconsistency.
  2. Should any section, paragraph, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid for any reason, the remaining portions of this Ordinance shall not be affected thereby and shall remain in full force and effect, and to this end the provision of this Ordinance are hereby declared to be severable.
  3. This Ordinance shall become effective twenty (20) days after final passage and publication, according to law.

NOTICE

This Ordinance will be introduced at a regular meeting of the City Council of the City of Cape May, to be held on September 21, 2010 and will be further considered for final passage during a meeting of the City Council, to be held at the Cape May City Hall Auditorium, 643 Washington Street, Cape May, New Jersey, on October 19, 2010, 7:00 p.m. at which time a Public Hearing will be held.
