RESOLUTION NO. 2014

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA ADOPTING GUIDELINES FOR AND IMPLEMENTING A DIVERSION PROGRAM FOR FIRST TIME NON-VIOLENT MISDEMEANOR OFFENDERS AS ATTACHED AS EXHIBIT A; AND AUTHORIZING ANINITIAL FEE OF FIVE HUNDRED ($500.00) DOLLAR; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the City Commission has determined that it is in the best interest of the residents of the City to amend Chapter 19 of the City’s Code of Ordinances by creating Section 19-17 which adopts the state criminal offense laws as they relate to criminal offense; and

WHEREAS,Code Section 19-17 allows for the establishment of a diversion program for first time non-violent misdemeanor offenders; and

WHEREAS, the adoption of such laws will enable the City of Hallandale Beach to prosecute non-violent misdemeanors, just as the City currently does for violations of all other municipal ordinances; and

WHEREAS, the City Administration has promulgated guidelines for the operations of the pre-trial diversion program consistent with guidelines utilized in the Town of Davie’s program and the City of Fort Lauderdale’s; and

WHEREAS, the Mayor and City Commission have determined that an initial fee of five hundred dollars ($500) to participate in the program is consistent with other diversionary programs in the county and appropriate for the City’s program. The fee may be amended from time to time through the annual adoption of the City’s fee schedule.

WHEREAS, the Mayor and City Commission has determined that the public is best served by the establishment of the pre-trial diversion program as set forth in the guidelines which are attached as Exhibit A to this resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:

SECTION 1:The Mayor and City Commission hereby adopt the “City of Hallandale Beach Pre-Trial Diversion Program Guidelines” as attached as Exhibit A, and authorize the implementation of an initial fee of five hundred ($500.00) dollars to participate in the program is consistent with other diversionary programs in the county and appropriate for the City’s program. The fee may be amended from time to time by the adoption of theCity’s fee schedule.

SECTION 2:Effective Date. This Resolution shall take effect immediately upon its passage and adoption.
