the city of peekskill currently participates in an Intermunicipal Agreement (ima) with the County of Westchester, whereby the county provides bus passenger shelters throughout the city of peekskill and enters into licensing agreements with various companies who provide advertising and are required to maintain and repair these shelters. after the county takes $100,000 annually for administrative expenses, the city splits any remaining revenue between the county and the participating municipalities on a 50/50 basis. the city is then provided monetary compensation based upon the number of shelters within the city. this resolution authorizes the city manager to enter into an amendment of the current ima extending the term through june 30, 2016 and to enter into a new ima for a term from july 1, 2016 through june 30, 2021.

RESOLUTION AUTHORIZING THE ACTING CITY MANAGER

TO ENTER INTO AN INTERMUNICIPAL AGREEMENT WITH

WESTCHESTER COUNTY FOR THE COUNTY WIDE BUS SHELTER PROGRAM

WHEREAS, the City of Peekskill has participated in a County Wide Bus Shelter Intermunicipal Agreement with the County of Westchester; and

WHEREAS, pursuant to the Agreement, the County provides bus passenger shelters throughout the City of Peekskill for the comfort and benefit of the residents and users of the County bus system; and

WHEREAS, as part of this program, the County of Westchester enters into a License Agreement with various companies, a Licensee, to provide advertising within these bus shelters; and

WHEREAS, the Licensee shall be required to maintain all shelters in good condition and shall be required to repair any damaged shelter; and

WHEREAS, the City of Peekskill participated in this County Wide Bus Shelter Intermunicipal Agreement for a term commencing April 1, 2011 an expiring March 31, 2016; and

WHEREAS, the County is seeking to amend that Agreement to extend the term through June 30, 2016; and

WHEREAS, the County is seeking participation by the City of Peekskill for a new County Wide Bus Shelter Intermunicipal Agreement for a term to commence July 1, 2016 and expiring June 30, 2021; and

WHEREAS, after the County takes $100,000 from the revenue from this program, the participating municipalities split the remaining revenue with the County on a 50/50 ratio. The share for the City of Peekskill shall be determined by the number of shelters operated by the Licensee within the City, currently twelve; and

WHEREAS, the City shall receive payment by the County on August 1st of each year of this agreement, beginning 2017; and

WHEREAS, it shall be in the best interest of the City of Peekskill to continue to participate in this Intermunicipal Agreement.

now, therefore, be it

resolved, that the Acting City Manager, or his designee, is hereby authorized to enter into an Agreement to amend the current County Wide Bus Shelter Intermunicipal Agreement for the provision and maintenance of bus passenger shelters throughout the City to extend the terms for the period commencing April 1, 2011 and terminating June 30, 2016; and be it further

resolved, that the Acting City Manager, or his designee, is hereby authorized to enter into a County Wide Bus Shelter Intermunicipal Agreement for the provision and maintenance of bus passenger shelters throughout the City for the period commencing July 1, 2016 and terminating June 30, 2021; and be it further

RESOLVED, that the Agreement shall be subject to the review and approval of the Acting City Manager and Corporation Counsel; and be it further

RESOLVED, that this Resolution take effect immediately.
