CITY OF PANHANDLE

ORDINANCE NUMBER 580

AN ORDINANCE CALLING FOR AN ELECTION ON THE ADOPTION OF AN ADDITIONAL SALES TAX FOR ECONOMINIC DEVELOPMENT IN THE CITY OF PANHANDLE

WHEREAS, the City of Panhandle is a progressive and forward-thinking community that wants to be competitive in attracting new and expanded businesses to the City; and

WHEREAS, Texas Local Government Code Chapter 505 allows cities to create a Type B economic development corporation, and to impose an additional sales and use tax for the purpose of promoting economic development within the city, as long as the voters approve the imposition of the tax at an election that is conducted on a uniform election day; and

WHEREAS, the City Council wants the voters to decide whether an economic development corporation should be created and an additional sales and use tax should be imposed within the City.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PANHANDLE, TEXAS:

That an election shall be held on whether an additional one-fourth of one percent sales and use tax within the City of Panhandle shall be imposed for the creation of a Type B economic development corporation;

That said election shall be held on the second Saturday in May, 2015;

That notice of said election shall be published in the Panhandle Herald, a newspaper of general circulation in the City of Panhandle, at least one time, not more than 30 days and not less than 10 days before the date of the election;

That the notice of election shall contain the following proposed ballot wording:

The adoption of an additional one-fourth of one percent sales and use tax within the City of Panhandle for the purpose of creating a Type B economic development corporation, and with the proceeds of the additional tax to be used and applied for the promotion and development of new and expanded business enterprises and in the manner and for all purposes authorized by Texas Local Government Code Chapter 505, including, but not limited to: projects related to recreational or community facilities, projects related to affordable housing, projects related to water supply facilities and water conservation programs, projects related to business enterprises that create or retain primary jobs, projects related to business enterprises, projects related to airport facilities, projects related to business development, and any other projects authorized or permitted by law.

That the notice of election shall contain the location of each polling place and the hours that the polls will be open, and shall be written in both English and Spanish.
